The Republic of Belarus and the Republic of Moldova which are hereinafter referred to as by the Parties

aiming to develop cooperation in the field of social security,

agreed as follows:

I. General provisions

Article 1 of Determination

1. For the purposes of application of this Agreement the following determinations mean:

1) "legislation" - the laws and other regulatory legal acts of the Parties regulating the legal relationship specified in Article 2 of this Agreement;

2) "authorized body":

in the Republic of Belarus - the Ministry of Labour and Social Protection - regarding provision of pensions, the Ministry of Health - regarding medical examination and re-examination of persons for the purpose of establishment of group and the reason of disability, extent of loss of professional working capacity / working capacity, the Ministry of Finance - regarding compulsory insurance from labor accidents and occupational diseases;

in the Republic of Moldova - the Ministry of Health, work and social protection;

3) "competent organization" - organization of the Parties to which application of the legislation regulating the legal relationship specified in Article 2 of this Agreement is assigned;

4) "the residence (accommodation)" - the place of permanent residence on legal causes in the territory of one of the Parties determined or recognized as that according to the legislation of this Party;

5) "pensions" - the state periodical money payments, stipulated by the legislation in case of old age, loss of working capacity/restriction of opportunities, loss of the supporter;

6) "insurance payment":

in the Republic of Belarus - lump and (or) monthly insurance sum payment in connection with labor accident or occupational disease;

in the Republic of Moldova - benefit on restriction of opportunities owing to labor accident or occupational disease;

7) "insurance years of service":

in the Republic of Belarus - the periods of payment of insurance premiums considered in case of determination of the right to pensions;

in the Republic of Moldova - the periods of payment of fees of social insurance, and also the equated periods recognized as those the legislation of the Republic of Moldova;

8) "length of service" in the Republic of Belarus - the periods considered according to the legislation in case of determination of the right to pensions and their sizes;

9) "insurance premiums":

in the Republic of Belarus - fees on the national pension insurance;

in the Republic of Moldova - the compulsory contributions paid to the state system of social insurance;

10) "moving" - the change by person of the permanent residence (accommodation) providing removal from the corresponding registration accounting in one Party and statement on the corresponding registration accounting in other Party.

2. Other determinations used in this Agreement have significance which are attached to them by the legislation of the relevant Party.

Article 2 Scope of the Agreement

1. This Agreement extends to the legal relationship regulated by the legislation of the Parties regarding appointment and payment:

1) in the Republic of Belarus:

- work pensions (on age, for long service, on disability, on the occasion of loss of the supporter), allowances, increases and surcharges to pensions;

- insurance payments;

2) in the Republic of Moldova:

- old-age pensions;

- pensions on restriction of opportunities owing to general disease;

- pensions and benefits on restriction of opportunities owing to labor accident or occupational disease;

- pensions on the occasion of loss of the supporter.

2. This Agreement also extends to the legal relationship regulated by the legislation of the Parties on payment of insurance premiums.

3. This Agreement also extends to the legal relationship regulated by the legislation of the Parties which changes and (or) supplements provisions of the legislation specified in Items 1 and 2 of this Article. Within three months from the effective date of the specified legislation the authorized body of one Party informs authorized body of other Party on the restrictions concerning corresponding changes and (or) amendments.

4. This Agreement does not extend:

in the Republic of Belarus - on the legal relationship regulated by the legislation on provision of pensions of the military personnel and persons equated to them regarding provision of pensions according to the legislation, members of their families, government employees and also on legal relationship to destination and payment of social pensions;

in the Republic of Moldova - on the legal relationship regulated by the legislation on special pensions, early old-age pensions and the public social benefits to some categories of citizens.

Article 3 of Person, falling under validity

This Agreement extends on living in the territory of one of the Parties:

1) the persons falling or falling under operation of the legislation of the Parties specified in Items 1-3 of Article 2 of this Agreement;

2) persons whose rights follow according to the legislation of the Parties from the rights of persons specified in Item 1 of this Article.

Article 4 Equal relations

1. The persons of one Party determined in Article 3 of this Agreement, living in the territory of other Party have the equal rights with citizens of this other Party in application of the legislation specified in Items 1-3 of Article 2 of this Agreement.

2. If this Agreement does not provide other, to persons determined in Article 3 of this Agreement cannot be refused award of pension, insurance payments on which there is right by the legislation of one Party or according to provisions of this agreement, only for the reason that these persons live in the territory of other Party.

II. Application of the legislation

Article 5 General provisions

If this Agreement does not provide other, the legislation of this Party extends to person working on hiring for the employer registered in the territory of one of the Parties even if person lives in the territory of other Party.

The legislation of the Party in the territory of which work is performed extends to self-employed persons.
