About reforming of customs administration and enhancement of activities of bodies of the State Customs Service of the Republic of Uzbekistan

In the country the consecutive reforms directed to increase in efficiency of activities of bodies of the State Customs Service of the Republic of Uzbekistan (further - customs authorities) with use of modern information and communication technologies are undertaken.

The carried-out works on implementation in the national legal system of standards and recommendations of the World Trade Organization, World Customs Organization, and also other international organizations require enhancement of customs administration and simplification of customs procedures.

At the same time, "the paperless and electronic customs" not up to standard develop, and methods of fight against smuggling and movement of counterfeit products, corruption, illegal currency transactions and evasion demand application of the modern and approved methods of customs administration from customs payment.

For the purpose of reforming of customs administration, further enhancement and increase in efficiency of activities of customs authorities, forming of the "digital customs" which is logical continuation and development of "paperless and electronic customs" and also acceleration of implementation in the national legal system of the commonly accepted international standards and standards in the sphere of customs affairs:

1. Approve:

a) The concept on reforming of customs administration and increase in efficiency of activities of bodies of the State Customs Service of the Republic of Uzbekistan in 2020 - 2023 (further - the Concept) according to appendix No. 1, including the following directions of development and enhancement of activities of customs authorities:

further enhancement of regulatory framework in the customs sphere;

development of institutional bases of activities and infrastructure facilities of customs authorities with optimum use of the available forces and means;

ensuring transparency and efficiency of activities of customs authorities by means of implementation of modern and advanced information and communication technologies to the customs sphere within digital economy;

enhancement of realization of fiscal function of customs authorities, simplification of tariff and non-tariff regulation of foreign economic activity (further - foreign trade activities);

fight against smuggling and violations of the customs legislation;

preparation, retraining and further advanced training and skills of customs officers, strengthening of their social protection;

further development of mutually beneficial cooperation with the international organizations and Customs Services of foreign countries;

b) "Road map" on implementation of the Concept on reforming of customs administration and increase in efficiency of activities of bodies of the State Customs Service of the Republic of Uzbekistan in 2020 - 2023 (further - "Road map") according to appendix No. 2.

2. Determine sources of financing of the actions provided by "Road map":

means of Special fund of financial support, social protection, development of customs authorities and contingencies of the State Customs Committee of the Republic of Uzbekistan;

credits (loans) of international financial institutions, foreign states and other donors, grants and means of technical assistance;

other sources which are not forbidden by the legislation.

3. Determine that:

a) since August 1, 2020 the organizations of rail transport in real time on a grant basis provide in customs authorities information on movement within the country of the cars and containers which are under customs control by integration of the information systems with information systems of customs authorities;

b) since September 1, 2020 the customs information system "Single Window" takes root on border customs posts;

c) since November 1, 2020:

the procedure according to which time of execution of the cargo customs declaration is reduced from 3 days to 1 day depending on risk level takes root;

cases of customs escort of goods, except the cases established by the legislation with expansion of use of alternative types of customs control are reduced;

risk management system of the State Customs Committee of the Republic of Uzbekistan takes root on road border customs posts;

in case of temporary import of vehicles the carrier is given opportunity in real time electronically beforehand before the expiration of the return export to perform prolongation of term of temporary import and payment of receivable collection;

in customs regime "conversion on customs area" the technique of identification and assessment of regulation of exit of products of conversion is developed by the subject of entrepreneurship.

4. Assign the following additional tasks to the State Customs Committee of the Republic of Uzbekistan:

implementation of customs audit after release of goods as form of the customs control providing assessment of activities of participants of foreign trade activities, and also check of their accounting after release of goods and vehicles;

coordination of activities of bodies of sanitary and quarantine, phytosanitary control and veterinary supervision (further - monitoring bodies) at check points through Frontier of the Republic of Uzbekistan behind application of measures of non-tariff regulation of foreign trade activities by them;

carrying out deep factor analysis of structure and dynamics of import and commodity export, and also analysis of the reasons of growth in volumes of import, both physical, and cost indicators;

establishment of cooperation with the interested departments concerning deepening of localization of production and expansion of industrial cooperation.

5. Grant to customs authorities the right:

perform customs audit of goods and vehicles with departure on places of their storage and realization;

perform accounting of the imported and (or) exported goods and vehicles, including documents of financial accounting and the reporting, and also source documents.

6. In structure of the State Customs Committee of the Republic of Uzbekistan within the general number of staff:

a) create Management of customs audit with assignment of the following tasks on it:

check of the fact of goods placement under customs regimes;

comparison and verification of the data specified in the cargo customs declaration and the customs receipt order to the data specified in supporting documents;

check and studying of the documents connected with financial and economic activities for the purpose of determination of correctness of application of preferences concerning goods, complete collection of customs payments, and also identification of the facts of violation of requirements of the customs legislation and currency control;

check of correctness of application of privileges on customs payment and determinations of customs value of goods;

check of observance of restrictions on the order with conditionally released goods;

the analysis and verification of the documents submitted in case of customs clearance of goods;

check of correctness of classification of goods according to the Commodity nomenclature foreign trade activities and implementation of customs clearance;

check of accomplishment by persons performing activities in the customs sphere, the obligations provided by the customs legislation;

detection of illegal ("gray") schemes when implementing customs transactions and carrying out scheduled maintenance on prevention and suppression of such cases;

b) To head department on the organization of customs control and registration to assign the following additional tasks:

coordination of activities of monitoring bodies at check points through Frontier of the Republic of Uzbekistan;

coordination of application of measures of non-tariff regulation by monitoring bodies concerning goods which when implementing foreign trade activities require receipt of documents of allowing and other nature, and also the goods which are subject to licensing and quoting;

coordination of activities of monitoring bodies behind application by them of prohibitions and restrictions during the importing and (or) commodity exportation;

development of methodology of application and enhancement of the customs information system "Single Window";

introduction of the customs register of intellectual property items;

development and deployment of methodology of control over customs clearance of objects of export control.

7. To national news agency and National broadcasting company of Uzbekistan to organize in mass media of the publication and thematic telecasts on illumination of essence of this Decree, and also the course of implementation of "Road map".

8. To the State Customs Committee of the Republic of Uzbekistan:

a) in a month:

together with the interested ministries and departments to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on the changes and amendments in the legislation following from this Decree;

together with the interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this Decree;

b) in three-months time to introduce the draft of the Regulations on procedure for carrying out customs audit to the Cabinet of Ministers of the Republic of Uzbekistan, having provided in it the principles and methods of customs audit, methods and the mechanism of selection of objects of audit, and also stages of carrying out customs audit.

9. Make changes and additions to the resolution of the President of the Republic of Uzbekistan of April 12, 2018 No. PP-3665 "About the organization of activities of bodies of the State Customs Service of the Republic of Uzbekistan" according to appendix No. 3.

10. Recognize invalid some acts of the President of the Republic of Uzbekistan according to appendix No. 4.

11. To impose control of execution of this Decree on the Prime Minister of the Republic of Uzbekistan A. N. Aripov.

Section I. General provisions

1. The concept on reforming of customs administration and increase in efficiency of activities of bodies of the State Customs Service of the Republic of Uzbekistan in 2020 - 2023 (further - the Concept) is developed in pursuance of the Presidential decree of the Republic of Uzbekistan of November 24, 2018 No. UP-5582 "About Additional Measures for Enhancement of Customs Administration and Increase in Efficiency of Activities of Bodies of the State Customs Service of the Republic of Uzbekistan".

2. The concept includes recommendations of World Customs Organization (further - WCO) and the approaches based on experience of the advanced countries concerning reforming of customs administration.

3. The concept determines the purposes, priorities and the main directions of development of activities of customs authorities and is basis of development of the programs and complex actions aimed at their development.

Section II. Current status and the available shortcomings of activities of customs authorities
