AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF BELARUS AND GOVERNMENT OF THE RUSSIAN FEDERATION

About mutual exchange of geospatial information between armed forces of the Republic of Belarus and the Russian Federation

The government of the Republic of Belarus and the Government of the Russian Federation which are hereinafter referred to as with the Parties

being guided by provisions of the Agreement on creation of the Union State of December 8, 1999, Agreements between the Republic of Belarus and the Russian Federation on joint ensuring regional security in the military sphere of December 19, 1997 and the Agreement between the Republic of Belarus and the Russian Federation on mutual ensuring protection of the state secrets of the Republic of Belarus and the state mystery of the Russian Federation of January 20, 2003,

aiming to provide regulation of mutual exchange of geospatial information for the solution of tasks of functioning of regional grouping (forces) of the Republic of Belarus and the Russian Federation (further - regional grouping (forces),

agreed as follows:

Article 1

The agreement regulates questions of mutual exchange of geospatial information for the solution of tasks of functioning of regional grouping (forces).

For the purposes of this agreement the following concepts are used:

geospatial information - data set about the area and objects located on the Earth's surface in the subsurface layer of Earth, near-surface layer of the atmosphere of Earth and near-earth space necessary for the solution of tasks of functioning of regional grouping (forces);

databank of geospatial information - complex of technical, program and information means of centralized accumulating, storage, accounting and issue of geospatial information for the purpose of ensuring regional security.

Article 2

For the purpose of implementation of this agreement of the Party appoint authorized bodies:

from the Belarusian Side - the Ministry of Defence of the Republic of Belarus;

from the Russian Side - the Ministry of Defence of the Russian Federation.

Inform each other on replacement of the authorized bodies of the Party through diplomatic channels.

Article 3

The parties perform cooperation in the field of mutual exchange of geospatial information for the solution of tasks of functioning of regional grouping (forces) in the following forms:

creation of databanks of geospatial information;

mutual exchange of information, the geospatial information containing in databanks, and also information on opportunities and requirements of the Parties in the field of geospatial information;

training (preparation and advanced training) of geospatial information specialists;

experience exchange of work on forming of databanks of geospatial information and to modern technologies of its creation (forming);

exchange of the specifications and technical documentation regulating creation (forming) of geospatial information, methodical, educational and special literature.

Mutual exchange of geospatial information, specifications and technical documentation, the methodical, educational and special literature necessary for ensuring functioning of regional grouping (forces) is performed between authorized bodies of the Parties on a grant basis.

Article 4

The parties create databanks of geospatial information respectively in one of military units of Armed Forces of the Republic of Belarus determined by authorized body of the Belarusian Side and in one of military units of the Armed Forces of the Russian Federation determined by authorized body of the Russian Side.

Databanks of geospatial information are created and function on the principles:

uses of single requirements to the geospatial information which is subject to inclusion in databanks of geospatial information;

creations (forming) of geospatial information on single technologies with use of single normative and technical documents and files of resources;

unification of technical means of creation (forming), processing and storage of information and exchange of it between authorized bodies of the Parties;

applications in databanks of geospatial information of compatible geoinformation technologies and the software;

guaranteeing information security against unauthorized access.

Article 5

Procedure for accumulating of geospatial information in databanks, and also procedure for exchange of the specified information are determined in Regulations on databanks of geospatial information which affirm heads of authorized bodies of the Parties in six-months time from the effective date of this agreement.

Authorized bodies of the Parties will organize work on accumulating, updating and timely replacement in process of obsolescence of geospatial information, and also to exchange of it between databanks of geospatial information of the Parties.

Transfer of geospatial information is performed in the established exchange formats on machine carriers and in analog type.

Article 6

Any of the Parties does not open and does not transfer to any third party the geospatial information obtained from other Party if the Parties operating through authorized bodies do not agree on mutual basis about other in writing.

Information of limited distribution which is not relating to the classified information is determined that according to the procedure established by the legislation of each of the states of the Parties and designated on carriers of this information in the Republic of Belarus and the Russian Federation by the mark "For Office Use". The parties provide protection and the address with the acquired information of limited distribution according to the legislation of the states.

Responsibility for designation of information of limited use is conferred on that Party which information requires it.

Article 7

The parties are recognized that information obtained within this agreement may contain the data which are constituting the state secrets in the Republic of Belarus and being the state secret in the Russian Federation. The procedure for exchange, condition and measure for protection of such data during realization and upon termination of action of this agreement are determined by the Agreement between the Republic of Belarus and the Russian Federation on mutual ensuring protection of the state secrets of the Republic of Belarus and the state mystery of the Russian Federation of January 20, 2003, the Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation on interaction of bodies and organizations of the Republic of Belarus and the Russian Federation in case of placement of confidential orders, to broadcast (obtaining) and (or) use of the state secrets of the Republic of Belarus and the state mystery of the Russian Federation of December 10, 2009 and the Contract between the Ministry of Defence of the Republic of Belarus and the Ministry of Defence of the Russian Federation on transfer of the state secrets of the Republic of Belarus and the state mystery of the Russian Federation when implementing bilateral cooperation in the military sphere of September 15, 2015.
