1. Approve enclosed:

1) Rules of submission by brokers of data on transactions of physical persons with securities according to appendix 1 to this order;

2) the form of data represented by brokers about transactions of physical persons with securities according to appendix 2 to this order;

3) Rules of submission by commodity exchanges of data on transactions of physical persons with the exchange goods realized at commodity exchange according to appendix 3 to this order;

4) the form of data represented by commodity exchanges about transactions of physical persons with the exchange goods realized at commodity exchange according to appendix 4 to this order.

2. Declare invalid:

1) the order of the Minister of Finance of the Republic of Kazakhstan of July 28, 2016 No. 408 "About approval of Rules and forms of submission by brokers of data on transactions of the checked physical persons with the securities or exchange goods realized at commodity exchange" (it is registered in the Register of state registration of regulatory legal acts at No. 14178, it is published on September 9, 2016 in information system of law of Ad_let);

2) item 4 of the List of orders of the Ministry of Finance of the Republic of Kazakhstan to which changes and additions are made the Minister of Finance of the Republic of Kazakhstan approved by the order of March 31, 2017 No. 213 "About modification and amendments in some orders of the Ministry of Finance of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 15096, it is published on June 13, 2017 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan).

3. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. This order becomes effective since January 1, 2021 and is subject to official publication.

Chapter 1. General provisions

1. These rules of submission by brokers of data on transactions of physical persons with securities (further - Rules) are developed according to Item 15 of article 26 of the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget" (Tax code) and determine procedure for submission by brokers of data on transactions of physical persons with securities (further - Data).

Chapter 2. Procedure for submission of Data

2. Data are represented by brokers at the request of bodies of state revenues in form according to appendix to these rules.

3. Data are represented by brokers by electronic method by means of transfer on the information and communication network providing protection, authenticity confirmation, integrity checking and enciphering of the data on form transferred on network according to appendix 2 to this order and are certified by the digital signature of the head.

4. In case of impossibility of submission of Data on information and communication network, and also in case of technical errors of the Data are represented in electronic form in the format "Microsoft Excel" or "Microsoft Access".
