About approval of the Instruction about procedure of control of observance by workers of requirements for labor protection in the organization and structural divisions
Based on the paragraph of the eighth of part two of article 9 of the Law of the Republic of Belarus of June 23, 2008 No. 356-Z "About labor protection" and subitem 6.71-4 of Item 6 of the Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1589, the Ministry of Labour and Social Protection of the Republic of Belarus DECIDES:
1. Approve the Instruction about procedure of control of observance by workers of requirements for labor protection in the organization and structural divisions it (is applied).
2. Declare invalid the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of December 26, 2003 No. 159 "About approval of the Standard instruction about monitoring procedure behind compliance with law about labor protection in the organization".
3. This resolution becomes effective since June 28, 2020.

1. This Instruction determines procedure of control of observance by workers of requirements for labor protection in the organization and structural divisions (further - control of observance of requirements for labor protection).
2. For the purposes of this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus "About labor protection" are used.
3. Based on this Instruction and according to management system labor protection (further - SUOT) in the organization determines procedure of control of observance of requirements for labor protection.
The procedure of control of observance of requirements for labor protection can provide system of the personified accounting of the violations of requirements for labor protection allowed by workers.
4. The main objectives of control of observance of requirements for labor protection are:
inspection of condition of working conditions of workers;
analysis of observance of requirements for labor protection;
injury prevention and occupational diseases;
accomplishment by workers of obligations in the field of labor protection.
5. Control of observance of requirements for labor protection is exercised:
the head of the organization or his deputy authorized according to SUOT (further - the head of the organization or his deputy);
the officials responsible for the organization of labor protection and control of observance of requirements for labor protection, and also in case of accomplishment of separate work types, appointed from number of persons employed under which direct supervision other workers are (further - direct heads), heads of structural divisions;
employees of security service of work (the labor protection specialist or the authorized officer of the employer to whom obligations of the labor protection specialist are assigned).
6. Can take part in control of observance of requirements for labor protection:
members of the commission on labor protection (during its creation);
trade union representatives (further - labor unions), including public safety inspectors.
7. In case of impossibility of performance of obligations of the labor protection specialist control of observance of requirements for labor protection can be performed by employees of the organization with participation of the legal entity (individual entrepreneur) accredited on rendering services in the field of labor protection, involved according to the procedure and on conditions, stipulated by the legislation and the signed service provision agreement in the field of labor protection.
8. Control of observance of requirements for labor protection is carried out:
daily on workplaces of workers their direct heads (further – daily control);
monthly in each structural division of the organization by heads of these structural divisions (further – monthly control);
quarterly in the organization by the head of the organization or his deputy with participation of employees of security service of work (the labor protection specialist or the authorized officer of the employer to whom obligations of the labor protection specialist are assigned), members of the commission on labor protection, heads of structural divisions and direct heads, other employees of the organization (further – quarterly control);
as required in each structural division of the organization by employees of security service of work (the labor protection specialist or the authorized officer of the employer to whom obligations of the labor protection specialist are assigned).
Other frequency of control of observance of requirements for labor protection, but at least once a month, can be established according to SUOT in the organizations of service industry and the organizations numbering workers up to 15 people inclusive.
9. When implementing daily control are established:
compliance of content of the territory, the passes, drives adjacent to workplace, the condition providing free and safe movement of vehicles and workers;
compliance of equipment and organization of workplaces, equipment, tool, devices, vehicles to requirements for labor protection;
availability (serviceability) of lighting, heating, ventilation;
use by workers of safe methods of storage and transportation of materials, finished goods;
