About approval of Rules of rendering the state services in the field of geology and use of water resources

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:

1. Approve:

1) Rules of rendering the state service "Approval of the Water Preserving Actions Directed to Prevention of Water Objects from Depletion", according to appendix 1 to this order;

2) Rules of rendering the state service "Issue of the Conclusion on Construction, Reconstruction (Expansion, Upgrade, Modernisation, Reshaping), Operation, Preservation, Liquidation (Post-utilization) of the Objects Influencing Condition of Water Objects", according to appendix 2 to this order;

3) Rules of rendering the state service "Licensing for Export of Information on Subsoil on Areas and Fields of Fuel and Energy and Mineral Raw Materials" according to appendix 3 to this order;

4) Rules of rendering the state service "Licensing for Use of Space of Subsoil" according to appendix 4 to this order;

5) Rules of rendering the state service "Licensing for Geological Studying of Subsoil" according to appendix 6 to this order;

6) Rules of rendering the state service "Issue of Permission to Temporary Export of Geological Tests within Custom Union" according to appendix 7 to this order.

2. Recognize invalid some regulatory legal acts according to the list, according to appendix 5 to this order.

3. To provide to committee of geology of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of rendering the state service "Approval of the Water Preserving Actions Directed to Prevention of Water Objects from Depletion"

Chapter 1. General provisions

1. These rules of rendering the state service "Approval of the Water Preserving Actions Directed to Prevention of Water Objects from Depletion" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law) and determine procedure for rendering the state service "Approval of the Water Preserving Actions Directed to Prevention of Water Objects from Depletion" (further – the state service).

2. The state service appears territorial subdivisions of Committee of geology of the Industry ministry and construction of the Republic of Kazakhstan (further – the service provider).

3. The service is rendered to physical persons and legal entities (further – uslugopoluchatel).

Chapter 2. Procedure for rendering the state service

4. For receipt of the state service uslugopoluchatel direct to the service provider the application for approval of the water preserving actions directed to prevention of water objects from depletion (further – the statement) by means of object of informatization information system of single platform of subsurface use (further – EPN) in electronic form in form, according to appendix 1 to these rules.

The list of the main requirements to rendering the state service including form and result of rendering the state service are stated in the list of the main requirements to rendering the state service (further – the List of requirements) according to appendix 2 to these rules.

The service provider receives data on identity documents, on state registration (re-registration) of the legal entity from the corresponding information systems through lock of "the electronic government".

In case of filing of application the uslugopoluchatel agrees to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

When giving by uslugopoluchatel of all necessary documents by means of object of informatization information system EPN - in "personal account" of uslugopoluchatel is displayed the status with indication of unique accounting number, date and time of registration of a statement and specifying of the date of receipt of result of the state service.

5. The employee of responsible division within 7 (seven) working days from the moment of receipt of the statement considers the submitted documents regarding compliance to requirements of these rules and creates the conclusion in form, according to appendix 3 to these rules, or motivated refusal in rendering the state service.

In EPN the result of rendering the state service goes and kept in "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

6. In case of identification of the bases for refusal in rendering the state service according to Article 73 of the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK), the service provider notifies uslugopoluchatel on the provisional solution, on refusal in rendering the state service, and also time and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution.

The notification on hearing goes not later than 3 (three) working days before adoption of the administrative act.

Hearing is carried out no later than 2 (two) working days from the date of the notification.

7. The service provider refuses rendering the state service in the bases, stipulated in Item 9 Lists of the main requirements to rendering the state service.

8. Data on stage of rendering the state service are automatically transferred from EPN to information system of monitoring of rendering the state services, according to the subitem 11) of Item 2 of article 5 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law).

9. The service provider within three working days from approval date or change of these rules sends information on the made changes and (or) additions to Single contact center.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider concerning rendering the state services

10. The claim to the decision, actions (bezdeystviye) of the service provider concerning rendering the state services moves addressed to the head of the service provider, authorized body on studying of subsoil (further – authorized body), in authorized body by assessment and control of quality of rendering the state services.

Consideration of the claim concerning rendering the state services is made by the higher administrative authority, the official, body considering the claim.

Claims are submitted to the service provider and (or) the official whose decision, action (failure to act) are appealed.

The service provider the official whose decision, action (failure to act) are appealed, no later than 3 (three) working days from the date of receipt of the claim send it to the body considering the claim.

At the same time the service provider, the official, the decision, action (failure to act) are appealed, does not send the claim to the body considering the claim if he within 3 (three) working days makes the decision or administrative action which is completely meeting the requirements specified in the claim.

The claim of uslugopoluchatel which arrived to authorized body according to Item 2 of article 25 of the Law is subject to consideration within 5 (five) working days from the date of its registration.

The claim of uslugopoluchatel which arrived to the body considering the claim is subject to consideration within 15 (fifteen) working days from the date of its registration.

11. If other is not provided by the laws of the Republic of Kazakhstan, appeal to the court is allowed after appeal in pre-judicial procedure according to Item 5 of article 91 APPK.
