About questions of selection and promotion by state bodies of candidates for positions of members of governing bodies of economic societies with the state share

For the purpose of enhancement of corporate management in economic societies with the state share, according to articles 10 and 17   of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve:

- Regulations on the state representatives in governing bodies of economic societies with the state share according to appendix 1;

- Procedure for selection, promotion of members of governing bodies of economic societies with the state share according to appendix 2.

1-1. Operation of this resolution does not extend to economic societies which state blocks of shares (shares) are delivered in trust management to Kyrgyzindustriya open joint stock company, for validity of trust management.

2. Recognize invalid:

2)  the order of the Government of the Kyrgyz Republic "About modification and amendments in  the order of the Government of the Kyrgyz Republic "About measures for increase in system effectiveness of management of business entities with the state share" of July 20, 2012 No. 513" of January 30, 2013 No. 41;

3) the order of the Government of the Kyrgyz Republic "About the new principles of forming and use of reserve of personnel of candidates for positions of members of the boards of directors, audit committees and secretaries of economic societies with the state share" of December 19, 2014 No. 716;

4)  the order of the Government of the Kyrgyz Republic "About entering of amendment and change into  the order of the Government of the Kyrgyz Republic "About measures for increase in system effectiveness of management of economic societies with the state share" of July 20, 2012 No. 513" of June 17, 2014 No. 338;

5)  the order of the Government of the Kyrgyz Republic "About modification and amendments in  the order of the Government of the Kyrgyz Republic "About the new principles of forming and use of reserve of personnel of candidates for positions of members of the boards of directors, audit committees and secretaries of economic societies with the state share" of December 19, 2014 No. 716" of May 8, 2015 No. 279.

4. This resolution becomes effective from the date of official publication.

5. To impose control of execution of this resolution on department of economy and investments of Government office of the Kyrgyz Republic.

Regulations on the state representatives in governing bodies of economic societies with the state share

1. General provisions

1. This Provision determines tasks, functions, the rights and obligations of the state representatives in governing bodies of economic societies with the state share, procedure for their interaction with the principal, conditions of promotion and dismissal.

This Provision does not extend much selection, promotion and implementation of powers of independent board members.

2. For the purposes of this provision the following terms and determinations are used:

the state representative - the person elected or appointed in governing bodies of economic society according to the offer of authorized body in the sphere of management of state-owned property the Ministries of Finance of the Kyrgyz Republic, the Ministry of digital development of the Kyrgyz Republic or Social fund of the Kyrgyz Republic;

the principal - authorized body in the sphere of management of state-owned property, the Ministry of Finance of the Kyrgyz Republic, the Ministry of digital development of the Kyrgyz Republic or Social fund of the Kyrgyz Republic;

the register of the state representatives dismissed on the negative bases - the register of persons holding positions of members of governing bodies of economic societies with the state participation which powers were stopped for unsatisfactory work, in connection with loss of trust, or on other discrediting bases created by authorized body;

industry state body - the state body supervising questions of development and realization of policy in the sphere corresponding to profile of activities of economic society;

authorized body - authorized state body in the sphere of management of state-owned property;
