This Law determines legal, economic, social and organizational basis of tourism and activities in this sphere, is directed to realization of the rights of citizens to rest, leisure and development of business activity.
In this Law the following basic concepts are used:
tourism - temporary departures (travel) of citizens of the Kyrgyz Republic, foreign citizens and stateless persons (further - citizens) out of limits of the permanent residence in improving, cognitive or professional and business, sports, religious and other purposes without occupation paid activities in the country (place) of temporary stay;
the tourist - the citizen visiting the country (place) of temporary stay in improving, cognitive, professional and business, sports, religious and other purposes without the occupation right paid activities for a period of 24 hours up to 6 months in a row or performing at least one spending the night;
tour - range of services on placement, transportation, food of tourists, excursion services; services of guide-interpreters and other services provided depending on the travel purposes;
tourist resources - the natural, historical, welfare objects including subjects to tourist display, and also other objects capable to satisfy spiritual needs of tourists, to promote recovery and development of their physical forces;
tourist activities - tour operator and tourist's agency activities, and also other activities for the organization of travel;
tourism internal - travel or movement within the Kyrgyz Republic of persons who are constantly living in the Kyrgyz Republic;
outbound tourism - travel or movement to other country of persons who are constantly living in the Kyrgyz Republic;
tourism entrance - travel or movement within the Kyrgyz Republic of persons who are not living constantly in the Kyrgyz Republic;
tourism social - the travel or movement subsidized from the funds allocated by the state for social needs;
tourism amateur - the travel or movement with use of active methods of movement organized by tourists independently;
tourist product - range of services, provided to citizens (tourists);
promotion of tourist product - package of measures, directed to realization of tourist product (advertizing, participation in specialized exhibitions, fairs, the organization of tourist information centers selling tourist product, the edition of catalogs, booklets and another);
tourist service - the non-material products provided to the tourist by the company of the tourist industry for the permit or for any other payment type permitted by the law, directly or indirectly connected with satisfaction needs of tourists and their servicing;
excursion activities - activities for the organization of travel for up to 24 hours accompanied by the specialist - the guide along in advance constituted routes for the purpose of acquaintance with the nature, historical and cultural monuments, the museums, etc.;
subjects of tourist activities - the company, organization, the organization irrespective of patterns of ownership, the physical persons registered in the procedure established by the legislation of the Kyrgyz Republic;
the tourist industry - set of hotels and other means of accommodation of tourists, automobiles, objects of public catering, objects and means of entertainment, subjects to cognitive, business, improving, sports and other appointment, the organizations performing tour operator and tourist's agency activities and also the organizations providing excursion services and services of guide-interpreters;
tour operator activities - the activities for forming, promotion and realization of tourist product performed by the legal entity or the individual entrepreneur (further - tour operator);
tourist's agency activities - the activities for promotion and realization of tourist product performed by the legal entity or the individual entrepreneur (further - the travel agent);
authorized body in the field of tourism - the state body of the executive authority enabling development and the realization of state policy in the field of tourism;
services of the guide-interpreter - activities of professionally prepared physical person for acquaintance of tourists with tourist resources in the country (place) of temporary stay;
the tourist permit - the document confirming the fact of transfer of tourist product;
the agreement (contract) - the document confirming the agreement between subjects of tourist activities and tourists, determining subject of tourist services, their cost, terms and procedure for execution, the specific extent of liability of the parties for violation of its conditions.
The legislation of the Kyrgyz Republic on tourism is based on the Constitution of the Kyrgyz Republic and consists of this Law and other regulatory legal acts adopted on the basis of this Law.
State policy in the field of tourism provides:
- tourism development as priority industry of national economy and creating favorable conditions for activities in the field of tourism;
- providing the rights of citizens to rest, freedom of travel and other rights when making travel;
- regulation of the financial and currency relations in the field of tourism;
- financing of perspective state programs of tourism development;
- coordination of activities of authorized body in the field of tourism, private tourism organizations and objects of the tourist industry;
- development and enhancement of the legal base governing the relations in the field of tourism;
- assistance to development of international cooperation and professional training of specialists in the field of tourism;
- development of scientific research in the field of tourism.
Relations between subjects of tourist activities and tourists are under construction based on agreements (contracts) including subject of tourist trip, quantity and quality of the rendered services, their cost, terms and procedure for execution, the specific extent of liability of the parties for violation of its conditions.
The terms of the contract infringing the rights of tourists and contradicting the regulations and rules established by the laws or other regulatory legal acts of the Kyrgyz Republic in the field of consumer protection are recognized invalid.
If as a result of agreement performance (contract) infringing the rights of tourists they had losses, they are subject to compensation by the subject of tourist activities in full.
