About some questions of the organization of ensuring public order and traffic safety in the Kyrgyz Republic

For the purpose of enhancement of activities of law-enforcement bodies for ensuring public order and traffic safety, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About some questions of the organization of activities of the Ministry of Internal Affairs of the Kyrgyz Republic" of November 9, 2017 No. 734 the following changes:

1) in Regulations on the Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic approved by the above-stated resolution:

- to state the subitem 14 of Item 7 in the following edition:

"To direct 14) to medical examination regarding determination of state of intoxication of persons managing vehicles and also to carry out survey on alcohol intoxication of persons managing vehicles using special technical means;";

The control circuit of Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic approved by the above-stated resolution to state 2) in edition according to appendix to this resolution.

2. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 06.06.2022 No. 299

3. To the Ministry of Internal Affairs of the Kyrgyz Republic:

- realize during 2020-2021 based on divisions of Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic the project on creation and functioning of divisions of patrol service of militia by merging of divisions of Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic and divisions of security guard and patrol services of militia of territorial authorities of internal affairs of the Kyrgyz Republic;

- approve the corresponding actions plans and resolve the organizational and technical and other issues connected with project implementation on creation and functioning of divisions of patrol service of militia (in accordance with the established procedure to make transfer of established posts, material and money, selection and training of candidates for service according to appropriate programs, passing qualification examinations, contracting about service with the persons which successfully underwent competitive selection and successfully completed training);

- carry out explanatory and information work among the population on all project implementation phases on creation and functioning of divisions of patrol service of militia;

- provide to the acting staff of law-enforcement bodies of the Kyrgyz Republic, in case of their written address, the participation right in competitive selections to substitution of vacant positions in newly created divisions of patrol service of militia;

- take the necessary measures following from this resolution.

4. Determine that:

- functions in the field of traffic safety control, and also function on protection of life, health, the rights and legitimate interests of citizens against criminal and other illegal encroachments, immediate response to crimes, offenses and violations, acceptance of necessary measures for control of offenses, offenses and violations, to detention of persons suspected of making of crimes and offenses, to acceptance of the immediate measures directed to rescuing of life and health of citizens in case of natural disasters, emergency situations and catastrophic crashes, to ensuring protection of law and order in the fixed territory by carrying out preventive actions and also identification of the circumstances promoting their making are assigned to the created divisions of patrol service of militia;

- for project implementation on creation and functioning of divisions of patrol service of militia, the regulations granting the right to material stimulation do not extend to the staff of divisions of patrol service of militia.

5. To the Ministry of Finance of the Kyrgyz Republic in accordance with the established procedure:

1) in coordination with Committee on the budget and finance of Jogorku Kenesh of the Kyrgyz Republic to allocate to Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic additional money in the amount of 44384900 (forty four million three hundred eighty four thousand nine hundred) som for project implementation on creation and functioning of division of patrol service of militia in the territory of the city of Osh;

2) by preparation of the bill of the Kyrgyz Republic "About introduction of amendments to the Law of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2020 and the forecast for 2021-2022" to provide the changes following from this resolution;

3) in case of project development of the Law of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2021 and the forecast for 2022-2023" to provide for 2021 means in the amount of 239340600 (two hundred thirty nine million three hundred forty thousand six hundred) som to Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic.

6. To headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic:

- within the means provided in the budget for 2020 to allocate funds in the amount of 34235000 (thirty four million two hundred thirty five thousand) som for project implementation on creation and functioning of division of patrol service of militia in the territory of the city of Osh;

- use 25 percent of the money intended to Headquarters on safety control of traffic of the Ministry of Internal Affairs of the Kyrgyz Republic from the amounts of the penalties collected for making of violations in the field of traffic safety and operation of vehicles for project implementation on creation and functioning of divisions of patrol service of militia.

7. To impose control of execution of this resolution on department of defense, law and order and emergency situations, department of financial and credit policy of Government office of the Kyrgyz Republic.

8. This resolution becomes effective after seven days from the date of official publication.
