About approval of Rules of certification of legal entities on the work right in the field of industrial safety

1. Approve the enclosed Rules of certification of legal entities on the work right in the field of industrial safety.

2. To provide to committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification of legal entities on the work right in the field of industrial safety

Chapter 1. General provisions

1. These rules of certification of legal entities on the work right in the field of industrial safety (further – Rules) are developed according to Item 2 of article 72 of the Law of the Republic of Kazakhstan "About civil protection" (further – the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services), and determine procedure for certification of legal entities on the work right in the field of industrial safety, and procedure for rendering the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety".

2. Certification of legal entities on the work right in the field of industrial safety is carried out for the purpose of official recognition by authorized body in the field of industrial safety of competences of the legal entity to carry out the following work types in the field of industrial safety:

1) expertize of industrial safety;

2) preparation, retraining of specialists, workers in the field of industrial safety;

3) conducting examination in the field of explosive works;

4) carrying out maintenance of gas-consuming systems;

5) installation, maintenance, technical diagnosing, engineering certification and repair of elevators, escalators, travelators, and also elevators for persons with disability.

3. Certification of legal entities on the work right in the field of industrial safety is carried out according to the procedure of rendering the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety".

4. Are issued to the legal entities certified on the work right in the field of industrial safety the Certificate on the work right in the field of industrial safety (further – the certificate).

5. Effective period of the certificate constitutes five years.

The certificate terminates in cases:

1) representations by the legal entity certified on the work right in the field of industrial safety of the statement with request for cancellation of the certificate;

2) expirations of its action;

3) liquidations of the legal entity;

4) deprivations of the certificate.

Deprivation of the certificate is performed judicially in case of not elimination of the reasons for which it was suspended the certificate.

Chapter 2. Procedure for rendering the state service

6. The state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety" (further – the state service), appears Committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan (further – the service provider) according to these rules.

7. For receipt of the state service legal entities (further – uslugopoluchatel) send to the service provider through the web portal of "the electronic government" www.egov.kz (further – the portal) the statement in electronic form certified by the digital signature of uslugopoluchatel in form according to appendix 1 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated according to appendix 2 to these rules in the form of the List of the main requirements to rendering the state service.

8. The portal performs reception of an application in the automatic mode.

The employee of office of the service provider performs registration of a statement and sends to the head of the service provider or replacement his face (according to the distribution of service duties established by the service provider) which appoints the executive in charge.

When giving the uslugopoluchatel of the statement by means of the portal in "private office" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.
