"About single methods of determination of high-quality qualities of seeds of agricultural plants within the Eurasian Economic Union"

For the purpose of implementation of article 5 of the Agreement on the address of seeds of agricultural plants within the Eurasian Economic Union of November 7, 2017 and ensuring application of single methods of determination of high-quality qualities of seeds of agricultural plants within the Eurasian Economic Union Council of the Eurasian economic commission DECIDED:

1. Approve enclosed:

method of field approbation of high-quality crops (landings) of agricultural plants;

method of soil control of agricultural plants.

2. Determine that till January 1, 2022 issue of the documents containing data on high-quality qualities of seeds of agricultural plants in the forms established according to the legislation of state members of the Eurasian Economic Union is allowed.

The specified documents are valid before use of batch of seeds on which they were issued.

3. This Decision becomes effective after 30 calendar days from the date of its official publication, but not earlier than January 1, 2021.

Method of field approbation of high-quality crops (landings) of agricultural plants

I. General provisions

1. This document the practician of the international organizations is developed according to the subitem 13 of Item 7 of article 95 of the Agreement on the Eurasian Economic Union of May 29, 2014, article 5 of the Agreement on the address of seeds of agricultural plants within the Eurasian Economic Union of November 7, 2017 (further the Agreement), on the basis of the best and establishes single requirements in case of determination in state members of the Eurasian Economic Union (further respectively - state members, the Union) indicators of high-quality qualities of seeds of agricultural plants by method of field approbation of high-quality crops (landings) of agricultural plants.

2. This document is applied when carrying out high-quality identification of high-quality crops (landings) grain, leguminous, groat, feed, industrial, oil-bearing, essential oil-bearing, vegetable, melon, medicinal crops and potatoes to establishment of suitability of their harvest on the seed purposes.

II. Basic concepts

3. For the purposes of this document concepts which mean the following are used:

"aprobator" - the physical person authorized according to the procedure, established by the legislation of state member, on carrying out field approbation of high-quality crops (landings) agricultural plants;

"aprobatsionny signs" - set of essential morphological features of the agricultural plants characterizing their belonging to certain grade;

"biological contamination of grade" - contamination of grade of agricultural plant as a result of natural repollination of different grades or emergence of mutations;

"specific purity" - the attitude of number of stalks of the approved agricultural plant towards total number of stalks of the approved type of agricultural plant and other types of agricultural plants;

"the magazine of field investigation" - the table of accounting of these (results) of field approbation of high-quality crops (landings) of agricultural plants;

"applicant" - the legal entity or physical person which submitted the application for carrying out field approbation of high-quality crops (landings) agricultural plants to the organization of state member performing according to the legislation of state member activities for rendering services on carrying out field approbation (field inspection) of high-quality crops (landings) of agricultural plants;

"mechanical contamination of grade" - the contamination of grade of agricultural plant seeds of other grades of agricultural plants and (or) other types of agricultural plants occurring during crops (landing), cleaning, cleaning and other engineering procedures;

"the national register" - the register of the grades of the agricultural plants allowed (permitted, recommended) to use in the territory of state member, created according to the legislation of state member;

"the original seeds (OS) (dobazovy seeds)" - the seeds of agricultural plants made by originator of grade of agricultural plants or person authorized by it according to the procedure, established by the legislation of state member;

"grade originator" - the physical person or legal entity of state member which created removed, revealed grade of agricultural plant and (or) provides its preserving and data on which are entered in the national register;

"the official description of grade" - the document (the list of data) containing the description of the essential signs of grade of agricultural plant determined by the organization performing according to the legislation of state member testing of grades of agricultural plants by criteria of distinguishability, uniformity and stability of grade of agricultural plant;

"field approbation of high-quality crops (landings)" - inspection (field inspection) of high-quality crops (landings) of agricultural plants for the purpose of determination (assessment) of high-quality qualities (specific purity, varietal purity, high-quality typicalness), contaminations their other types of plants, prevalence diseases and damages wreckers of agricultural plants and establishments of compliance of high-quality crops (landings) of agricultural plants to the official description of grade, with registration of results of inspection;

"the trial site" - part of high-quality crops (landing) of agricultural plants on which inspection of plants for determination of value of signs of high-quality qualities of seeds is performed;

"distance isolation" - minimum admissible regulations of distance between crops (landings) of different grades and types perekrestnoopylyayushchikhsya agricultural plants, and also use of the different isolating devices or cultures, dividing strips for prevention of repollination of agricultural plants;

"the reproductive seeds (RS) (the certified seeds)" - the seeds of grades of agricultural plants received from consecutive reproduction of elite seeds (the first and the subsequent generations which number is determined according to the legislation of state member);

"reproductive seeds for production of products (RUTI)" - the seeds of grades of agricultural plants received from consecutive reproduction of reproductive seeds and intended only for production of products;

"grade" - group of agricultural plants within the lowest of botanical taxons which is determined by degree of expressiveness of the signs characterizing this genotype or combination of genotypes differs from other groups of agricultural plants of the same botanical taxon in one or several signs or degree of expressiveness of signs and is stable. Categories of grade are the clone, the line, hybrid of the first generation, population and other categories of grade used in farm-production;

"high-quality crops (landing)" - the field (site) sowed by seeds of grade of agricultural plant which high-quality accessory is supported by the documents on seeds and intended for receipt of high-quality seeds;

"high-quality typicalness" - indicator of varietal purity perekrestnoopylyayushchikhsya agricultural plants;

"varietal purity" - the relation of number of plants (stalks) of the main grade of agricultural plants to total quantity of the inspected developed plants (stalks) on trial sites of the approved agricultural plant expressed as a percentage;

"high-quality qualities of seeds" - set of the signs characterizing belonging of seeds of agricultural plants to certain grade;

"the special trial site" - the part of crops (landing) of agricultural plants intended for observation of pollination in case of production of seeds of hybrid varieties of the first generation;

"the elite seeds (ES) (basic seeds)" - the seeds received from consecutive reproduction of original seeds according to the schemes of their production established according to the legislation of state member.

Other concepts used hereunder are applied in the values determined by the Agreement and acts of bodies of the Union adopted in its realization.

III. General requirements when carrying out field approbation of high-quality crops (landings) agricultural plants (further respectively - approbation, high-quality crops (landings))

1. Requirements to high-quality crops (landings)

4. Requirements to high-quality crops (landings) include:

crops (landing) by net graded seeds;

observance of regulations of distance isolation of high-quality crops (landings) and (or) availability of dividing strip (except for high-quality crops (landings) intended for cultivation of seeds in culture of i No. vitro);

exception of possibility of mechanical contamination of grade seeds of hardly separable agricultural plants at all stages of seed farming;

exception of possibility of contamination of high-quality crops (landings) by hardly separable, malicious, poisonous and quarantine weeds;

exception of possibility of infection of high-quality crops (landings) with the diseases transmitted through seeds;

observance of production technologies of the seeds (including schemes of production of hybrid seeds) established by grade originator (ratio of men's and female plants on hybridization plots);

observance on prior cultures of the minimum interval of time between crops (landings) of agricultural plant of the same type, and any other agricultural plant of the same type which shall constitute for grain, leguminous crops and corn - at least two years, for cruciferous, feed, oil-bearing crops, cereals and bean herbs - at least five years, flax and sunflower - at least seven years, other agricultural plants - at least one year.

2. Actions of aprobator

5. Aprobator shall:

a) receive from the applicant and check the following data:

about the area of high-quality crops (landing) intended for approbation;

about arrangement of high-quality crops (landing) according to maps of fields;

about stories of crops (landings) on the subject approbation of the area of high-quality crops (landing) (according to the paragraph the eighth Item 4), including information on the predecessor (predecessors) of high-quality crops (landing), crop rotation of agricultural plants on this square;

about the seeds used for crops (landing), the confirmed document containing data on high-quality and sowing (landing) qualities of seeds (with indication of in case of acquisition of seeds of date of acquisition of seeds, names of legal entity or physical person at which were acquired (are received) seeds, agreement number between the supplier and the buyer of seeds, term of its action);

about other grades of the approved agricultural plant, their name and acreage (landing);

about use of herbicides;

about the direction of tests for carrying out soil control (soil assessment) of grades of agricultural plants (in the presence of this type of agricultural plant in the list of agricultural plants and categories of seeds concerning which assessment of high-quality qualities of seeds by method of soil control (soil assessment) is obligatory in compliance the legislation of state member);

b) have on hand the main data on the approved grade, including the official description of aprobatsionny signs of grade or parent components of hybrid received in authorized body (organization) of state member for carrying out testing of grade for distinguishability, uniformity and stability (OOS) or from the national register;

c) check:

availability of the index (label) on the edge of the field containing data on the name of the applicant, the name of sort, type and the name of grade of agricultural plant, category (generation, reproduction) the sowed seeds of agricultural plant, the area of high-quality crops (landing);

availability at the applicant of the documents confirming the right to use grade of the agricultural plant which is object of legal protection according to legislations of state members (further - the protected grade);

observance of regulations of distance isolation of crops (landings) of agricultural plants;

availability of impurity of other grades of the approved type of agricultural plants;

availability in high-quality crops (landing) of quarantine objects according to the list approved by the Decision of Council of the Eurasian economic commission of November 30, 2016 No. 158;

availability in high-quality crops (landing) of hardly separable agricultural plants, hardly separable, malicious, poisonous weeds, prevalence of high-quality crops (landing) by diseases and wreckers.

6. The aprobator brings results of inspection of high-quality crops (landing) in the magazine of field investigation (forms of the magazine of field investigation of all high-quality crops (landings), except for high-quality crops (landings) of hybrids of the first generation, and the magazine of field investigation of high-quality crops (landings) of hybrids of the first generation are given in appendices No. 1 and 2 to this document (further - appendices No. 1 and 2) and on their basis draws up the act of approbation (field inspection) (form of the act of approbation (field inspection)) it is given in appendix No. 3 to this document).

7. In case of approbation of the mixed crops of agricultural plants which production of seeds requires use of the supporting plants approbation is carried out on each formulation component separately with execution of the magazine of field investigation and the act of approbation (field inspection) on each formulation component. In the specified documents the mark "Production of Seeds in the Mixed Crops" becomes.

IV. Stages of carrying out approbation of high-quality crops (landings)

1. General requirements to stages of approbation of high-quality crops (landings)

8. Approbation of high-quality crops (landings) is carried out in several steps:

preliminary survey of high-quality crops (landings);

final inspection of high-quality crops (landings).

9. Depending on biological features of agricultural plant and condition of high-quality crops (landing) during vegetation several preliminary surveys can be conducted.

10. Confirmation of accessory of the sowed seeds and origins of the sowed seeds is provided to the declared grade with the applicant by means of providing to aprobator the documents containing data on high-quality and sowing (landing) qualities of seeds.

11. Additional confirmation of data on the declared grade of the sowed seeds is the tare label provided by the applicant from batch of the sowed seeds on which the name of sort and type of agricultural plant, the name of grade, category (stage of reproduction of grade, stage of reproduction of seeds, reproduction), year of harvest, batch number and origin of seeds without fail is specified.

12. If the reproductive seeds (RS) and reproductive seeds for production of products (RUTI) were stored by embankment, the label which was placed on the index (plate) established on batch of seeds in storage of seeds of agricultural plants in case of their storage is submitted.

13. In case of impossibility of identification of grade in the course of approbation the aprobator can obtain the additional information about manifestation of high-quality signs of grade or hybrid on sites of soil control.

14. In case of approbation of hybridization plots high-quality identity of each parent component of hybrid variety (fatherly and maternal forms) with use of their official description in the national register of grades of agricultural plants is checked.

15. If necessary on high-quality crops (landings) rogueing and phytopathologic clearings with creation by their results of the relevant act in any form with inclusion of data on availability in crops (landings) of quarantine weeds, hardly separable weed and cultural plants, impurity of other grades, sick plants, with indication of terms of their removal are carried out specific. In acts of approbation (field inspection) of high-quality crops (landings) data on the impurity removed when rogueing are specified.

Specific, rogueing and phytopathologic clearings are carried out on high-quality crops (landings) of annual, biannual and perennial agricultural plants during vegetation of plants (to all phases of vegetation) before approbation of high-quality crops (landings), in process of the detection of the specific and high-quality impurity and plants affected with diseases and damaged by wreckers.

Rogueing at perekrestnoopylyayushchikhsya agricultural plants will see to blossoming phase.

16. After inspection of the approved crops (landing) in general, the aprobator passes to its detailed research, including perimeter of the site on which crops (landing) are placed.

17. In the course of inspection of high-quality crops (landing) all possible reasons of its mechanical and (or) biological contamination are noted.

18. In case of research of perimeter of the site on which high-quality crops (landing) are placed observance of regulations of distance isolation for perekrestnoopylyayushchikhsya agricultural plants and availability of dividing strip for other agricultural plants is established. For receipt of information on possible sources of foreign pollen the applicant provides to aprobator the map of fields.

19. High-quality crops (landings) perekrestnoopylyayushchikhsya agricultural plants require observance of regulations of distance isolation (taking into account method of pollination of plants (natural pollination - wind or insects, hand pollination, tendencies of plants to self-pollination, etc.)), features of grade according to its biological and economic characteristics, features of the place of cultivation of plants (relief, availability of barriers to pollen, etc.).

The minimum regulations of distance isolation between high-quality crops (landings) shall correspond to the indicators given in table 1. The specified minimum regulations of distance isolation can be cut by half in the presence of barriers to pollen transfer.

20. The aprobator specifies data on observance of regulations of distance isolation of high-quality crops (landings) in the magazine of field investigation (appendices No. 1 and 2).

21. Placement of high-quality crops (landings) (except for high-quality crops (landings) intended for cultivation of seeds in culture of i№vitro shall guarantee inadmissibility of their accidental contamination when carrying out technology transactions in case of crops, care of crops and harvesting.

22. For the agricultural plants which are made multiple copies actually by seeds, the size of dividing strip shall be at least the doubled maximum height of the plants growing in adjacent crops (landings).

23. For the agricultural plants which are made multiple copies by vegetative parts of plants, the dividing strip between crops shall be established taking into account length of stolon, the size of tubers, bulbs, rhizomes, etc. for exception of mixing of seeds in crops and deteriorations in their high-quality qualities.

24. In case of non-compliance with requirements to distance isolation or to dividing strip high-quality crops (landing) are recognized unsuitable on the seed purposes, except for high-quality crops (landings) of essential, drug plants for which in that case in the act of approbation (field inspection) after the name of agricultural plant instead of the name of grade "mix" is put down, the category of seeds is established "reproductive seeds", and reproduction stage - "the subsequent reproduction".

25. Aprobator establishes on high-quality crops (landing) and on nearby sites availability of weeds or agricultural plants which can be source of alien pollen for pollination.

26. By results of approbation the aprobator establishes category (reproduction stage, reproduction) of seeds and stage of reproduction of grade of agricultural plants based on the documents submitted to it on the sowed seeds taking into account the varietal purity of high-quality crops (landing) established during approbation.

Hybridization plots shall be evaluated taking into account observance of the scheme of production of hybrid seeds established by originator of grade, sowing time (landing) of parent components and required level of male sterility of plants of maternal component.

27. The applicant or his representative has the right to be present when carrying out approbation of high-quality crops (landings) at all stages.

If necessary approbation of high-quality crops (landings) at all stages is carried out with participation of originator (author) of grade or person authorized by it.

28. Approbation of high-quality crops (landings) of the protected grades of agricultural plants is performed according to the legislation of state member.

29. On high-quality crops of vegetable cultures additional examination before blossoming of seed plants of biannual, long-term cultures, garden radish and radish summer is conducted.

30. In case of approbation of high-quality crops of rye, buckwheat, lupine narrow-leaved bitter, Wicky shaggy and pannonsky varietal purity is not established. Belonging to grade, category of seeds, stage of reproduction of grade establish by the number of years of reproduction of high-quality seeds based on the documents containing data on high-quality qualities of the sowed seeds by which it is possible to determine generation (reproduction) after release of seeds of elite.

The approved crops of these cultures recognize high-quality if distance isolation is observed (except lupine of narrow-leaved bitter) and mechanical mixing of seeds with other grade or off-grade seeds is not established.

In the act of approbation (field inspection) in the column "Varietal purity" the word "typical" in confirmation of complete typicalness of grade is put down.

31. Approbation of high-quality landings and microplants of the grades of potatoes landed in vegetative rooms for receipt of minitubers and in the first field generation from minitubers carry out according to Section 7 state standard specification 33996-2016 "Seed potato. Specifications and methods of determination of quality".

2. The first stage of approbation - preliminary survey of high-quality crops (landings)

32. Preliminary survey of high-quality crops (landings) is conducted by check:

quality certificates and origin of the sowed (planted) seeds;

observance of rules of conducting seed farming (observance of crop rotation, the minimum regulations of distance isolation, the scheme of crops (landing) for hybridization plots);

degrees of general contamination weeds, prevalence diseases and damages wreckers;

survey on perimeter of crops (landing) and crops (landing) in general.

33. During preliminary survey the aprobator visually establishes belonging of the approved high-quality crops (landing) to the declared grade (carries out high-quality identification of crops). High-quality identification is performed during vegetation when aprobatsionny signs of grade are most expressed.

34. Aprobatsionny signs of grade are determined according to the official description of grade. In the absence of the official description of grade it is allowed to use the description of grade provided by its originator.

In attention accept aprobatsionny signs which during preliminary survey have explicit expressiveness.

35. Specific identification is carried out based on inspection of plants of high-quality crops (landing) on signs of their specific accessory.

36. For carrying out high-quality or specific identification, or identification of typicalness of hybrids the aprobator plans lines of pass of crops (landing) according to one of schemes of survey of high-quality crops (landing) during preliminary survey and for placement of the trial sites given in appendix No. 4 to this document (further - the scheme). For determination of uniformity of high-quality crops (landing) and belonging of the prevailing plants of high-quality crops (landing) to the declared type, grade, hybrid the aprobator passes across the planned lines provided by the chosen scheme and visually inspects plants.

37. If the quantity of the plants of high-quality crops (landing) which are subject to approbation less 100, that in case of high-quality identification or identification of typicalness of hybrids inspect all plants of cellular crops (landing).

38. By results of preliminary survey of high-quality crops (landing) the aprobator issues (if necessary) to the applicant of the recommendation of holding actions for preserving and improvement of high-quality qualities of seeds in which specifies the revealed shortcomings, terms and methods of their elimination (the form of the recommendation is given in appendix No. 5 to this document).

39. If shortcomings by results of preliminary survey are not revealed or recommendations of holding actions for preserving and improvement of high-quality qualities of seeds are executed timely and completely, high-quality crops (landing) are recognized suitable for final inspection about what the mark in the magazine of field investigation (appendices No. 1 and 2) becomes.

40. High-quality crops (landing) are recognized unsuitable for approbation and unsuitable for use on the seed purposes in the following cases:

in high-quality crops (landing) at any stage of approbation quarantine objects or poisonous weeds are found;

distance isolation for perekrestnoopylyayushchikhsya agricultural plants does not correspond to indicators of the minimum regulations given in table 1 or there is no dividing strip between crops (landings) of other grades (except for high-quality crops of essential oil-bearing and medicinal cultures concerning which in the act of approbation (field inspection) after the name of agricultural plant instead of the name of grade "mix" is specified, the category of seeds is established "reproductive seeds (RS)", and reproduction stage - "the subsequent reproduction");

for agricultural plants concerning which requirements to varietal purity, quantity of the plants relating to the declared grade are established constitutes for the self-pollinated agricultural plants less than 80 plants on 100 inspected plants, for perekrestnoopylyayushchikhsya agricultural plants - less than 75 plants on 100 inspected plants (except for high-quality crops of essential oil-bearing and medicinal cultures concerning which in the act of approbation (field inspection) after the name of agricultural plant instead of the name of grade "mix" is specified, the category of seeds is established "reproductive seeds (RS)", and reproduction stage - "the subsequent reproduction");

in the high-quality crops (landing) containing less than 100 plants the plant is revealed at least one atypical to the declared grade.

41. In case of identification in case of preliminary survey of high-quality crops (landings) of violations of crop rotation, regulations of distance isolation, contamination weeds, defeats by diseases, vermin damages they are recognized unsuitable for approbation degree in case of which carrying out specific and rogueing, phytopathologic clearings is inexpedient and (or) unsuitable for use on the seed purposes about what the corresponding mark in the magazine of field investigation (appendices No. 1 and 2) and the act of approbation (field inspection) (appendix No. 3 to this document) becomes.

3. The second stage of approbation - final inspection

42. The second stage of approbation is carried out after conducting preliminary survey and recognition of high-quality crops (landing) suitable for final inspection.

43. Carrying out approbation along with preliminary survey on condition of compliance of high-quality crops (landing) to requirements to phytosanitary condition, distance isolation and uniformity of plants of the approved grade on aprobatsionny signs is allowed. If necessary phytopathologists can be involved in approbation.

44. Final inspection of high-quality crops (landings) for determination of varietal purity, typicalness of crops (landing) is carried out by visual inspection of plants on root on trial sites.

45. For carrying out final inspection of high-quality crops (landing) the aprobator shall determine the number of trial sites and plan their arrangement in crops (landing).

46. In case of approbation of high-quality crops (landings) of medicinal, essential oil-bearing cultures allocation of trial sites is not performed, and all high-quality crops (landing) are surveyed.

47. In case of determination of aprobatsionny signs of grades of agricultural plants in the course of approbation the aprobator is guided by the signs established in techniques of carrying out testing of the plant varieties for distinguishability, uniformity and stability (OOS) of the corresponding botanical taxon based on methods of International union of protection of new plant varieties and which are most expressed during approbation.
