About approval of the Instruction about the notification of external obligations

Based on Item l) parts (1) Articles 5, parts (1) Articles 11, Item a) Article 51 and article 52 of the Law on National Bank of Moldova No. 548/1995 (repeated publication: Monitorul Oficial al Republicii Moldova, 2015, Art. No. 297-300, 544), with subsequent changes, and also parts (5) and (6) Article 6 and article 67 of the Law on currency control No. 62/2008 (repeated publication: Monitorul Oficial al Republicii Moldova, 2016, Art. No. 423-429, 859), with subsequent changes, DECIDES: Executive committee of National Bank of Moldova

1. Approve the Instruction about the notification of external obligations it (is applied).

2. Declare invalid the Resolution of Administrative board of National Bank of Moldova No. 185/2006 on approval of the Instruction on external obligations (Monitorul Oficial al Republicii Moldova, 2006, Art. No. 116-119, 427), registered in the Ministry of Justice of the Republic of Moldova at No. 1151 of November 24, 2016, with subsequent changes.

3. Residents which external obligations notified to National Bank according to the instruction specified in Item 2 of this resolution were not accepted on accounting on the date of entry into force of this resolution repeatedly represent to National Bank of Moldova on paper, depending on case, the form of Notification about external loan / credit or the form of Notification about external guarantee completed according to appendix No. 2 and, respectively, according to appendix No. 3 to the instruction specified in Item 1 of this resolution, in time no more than 15 working days from the effective date of this resolution. Acceptance on accounting of the specified external obligations will be performed according to provisions of the instruction specified in Item 1 of this resolution, in time 15 working days from registration date in National Bank of Moldova of the form of the filled notification. If residents did not submit forms of the filled notifications within the specified term, the National Bank of Moldova notifies residents by means of the official letter on the termination of the procedure of consideration.

4. This resolution becomes effective since April 1, 2020, except for provisions of the instruction specified in Item 1 of this resolution which provide the notification, acceptance on accounting and provision of the reporting electronically under external obligations which become effective in six-months time from the date of publication of this resolution in Monitorul Oficial al Republicii Moldova.

1. This instruction regulates:

a) obligations of residents which perform transactions according to external obligations, subject to the notification;

b) conditions and the notification procedure, including electronically, to National Bank of Moldova (further - NBM) residents of external obligations of subjects to the notification;

c) requirements to the notification on the external obligation, the list of the documents attached to it and also requirements to confirmation of NBM;

d) procedure for submission to NBM, including electronically, the reporting on the performed transactions within the external obligations assumed on accounting.
