About determination of places of customs clearance of goods

For the purpose of ensuring optimum task allocation in activities of customs bureaus, and also based on Art. provisions 12, 132, 135 and 175 Customs codes of the Republic of Moldova No. 1149 of July 20, 2000 (переопубликован in the Official monitor of the Republic of Moldova, special release of 1:01. 2007), with subsequent changes and amendments, Item 1 of the Order of the Government No. 1001, about declaration of goods by economic agents of east regions of the Republic of Moldova (The official monitor of the Republic of Moldova No. 116-118, of Art. 1050 of 27.09.2001), with subsequent changes and amendments, Items 7 and 8 of the Regulations on the organization and functioning of the Customs Service approved by the Order of the Government No. 4 of 2.01.2007. 1. Make customs clearance in the places determined for this purpose in zones of activities of customs posts in which there is sender or the receiver of goods, or its structural division, except for provisions of the current legislation.

2. In departure from provisions of item 1 of this order to customs authorities to make customs clearance of goods for all economic agents, regardless of its legal address, in the following procedure:

1) On customs posts: 1160 – BRIChEN (VTP), 1170 – BELTs (VTP), 2021 – ZTK UNGEN, UNGEN (PTPM, railway), 2100 – CHISINAU 4 (VTP, mail), 2150 – KEUShEN 1 (VTP), 3120 – KAHUL (VTP), 3130 – COMRAT (VTP), including the goods transported in one vehicle which have different senders and different receivers (grupaj) and/or mass sales items (cargo type).

2) On any internal or boundary customs post:

a) the goods transported by railway transport – on railway customs posts;

b) the goods transported by sea and river transport, transported by embankment – on river customs posts;

c) the goods transported by means of the international mailings - on customs post of 2100 – CHISINAU 4 (VTP, mail);

d) live animals – group 0101, 0102, 0103, 0104, 0105, 0106, live fish - group 0301, Crustacea in armor or without armor, live - group 0306, mollusks in sink or without sink, live – group 0307 and other live water invertebrates – group 0308, live plants – group 0601, 0602;

e) the goods intended for projects implementation of technical assistance and investment;

f) mixes bituminous on the basis of natural asphalt, natural bitumen, oil bitumen, mineral pitches or pitch of mineral pitches (for example, bituminous mastics, asphalt mixes for pavings (in liquid state, special temperature condition) - group 2713; 2714; 2715;

g) blood human - group 3002, lymph - group 3002 and human bodies - group 3001;

h) medicines - group 3003, 3004, reagents - group 3006 and vaccines with temperature condition – group 3002 (including goods which are their component);

i) cars the automobile and other motor vehicles intended mainly for transportation of people (which are placed on trail cars and semitrailer trucks of platform type and which are easily identified) – group 8703;

j) strategic goods (which require special conditions of maintenance).

3) On boundary customs post of 2300 – The international airport Chisinau (PTPM, avia), the goods which crossed border in the air way (24/24):

a) blood, lymph and human bodies;

b) excise stamps;

c) products from gold and silver – group 7113;

d) medicines, reactants and vaccines with temperature condition (including the goods constituting their part);

e) isotopes and pharmaceutical radioactive medicines - goods item of 2844;

f) isotopes with the short term of disintegration;

g) weapon and ammunition;

h) other goods of economic agents which arrived in the air way (800-1700);

i) live animals - group 0101, 0102, 0103, 0104, 0105, 0106, live fish - group 0301, Crustacea in armor or without armor, live - group 0306, mollusks in sink or without sink, live – group 0307 and other live water invertebrates - group 0308".

4) Economic agents from east regions of the Republic of Moldova will perform customs clearance of goods on the following customs posts: 2150 - KEUShEN of 1 (VTP), 2170 - BULBOAKA (VTP), 2180 - BENDER 2 (VTP, railway), 2190 - RUBBER (VTP), 2200 - RYBNITsA (VTP), 2241 - ZTK KRIULEN (Kriulen 14, 18) (VKTP), 2320 - KUChURGAN (PTPM, car).

5) the Economic agents registered in municipium Chisinau perform procedures of customs clearance of import goods (the mode-IM 4) (except for the goods moved with railway/air/river transport, the international mailings) on customs post of 2080 - the Regional customs post Chisinau 2 (PVI) - for customs clearance of types of goods which country of departure is Ukraine, Belarus and Russia.

3. The customs clearance of goods on the internal customs posts which are not place of registration of the economic operator and specified in Item 2, is allowed in case of presentation by the economic operator Soglasheniya about customs clearance of goods on other customs posts (further - the Agreement), issued by customs authority in which zone of activities the economic operator applicant is registered. The customs clearance on boundary customs posts is accepted only concerning perishable goods based on Soglasheniya which is issued by central office of Customs Service after consideration of the application in the commission. The standard application form and Soglasheniya, and also procedure for their issue are stated in the Instruction which is attached.

3-1. Structure of the Commission on consideration of the applications about issue of agreements, and also procedure for carrying out commission sessions are established by the order of the director of Customs Service.

4. For ensuring accomplishment of this order boundary customs posts will direct the goods transported under cover of cornet of TIR and transit customs declarations (T 1) strictly on the specified customs posts.

5. For the purpose of execution of this order to provide to management of information development and safety entering of necessary changes and amendments into IS "Asycuda World".

6. To assign execution of this order to chiefs of customs bureaus which will notify the subordinate staff of customs, customs brokers and customs applicants on its own behalf.

7. To impose control of execution of this order on Department of the income and customs control (Management of the organization of customs control and assistance to trade).
