About introduction of emergency state in the Republic of Kazakhstan

For the purpose of safety of the population of the Republic of Kazakhstan according to the subitem 16) article 44 of the Constitution of the Republic of Kazakhstan and Articles 4, 5, 6 Laws of the Republic of Kazakhstan "About emergency state" POSTANOVLYAYU:

1. In connection with the announcement the World Health Organization of new coronavirus of COVID-19 pandemic for the purpose of protection of life and health of citizens to enter according to the legislation of the Republic of Kazakhstan in all territory of the Republic of Kazakhstan emergency state for the period from 08 hours 00 minutes on March 16, 2020 for a period of up to 07 hours 00 minutes on April 15, 2020.

2. Create for emergency state State commission on providing emergency rule in case of the President of the Republic of Kazakhstan and give to her the authority provided by the Law of the Republic of Kazakhstan "About emergency state" in structure according to appendix to this Decree.

3. Enter the following measures and temporary restrictions for action of emergency state:

1) to strengthen protection of public order, protection of especially important state and strategic, osoborezhimny, regime and especially protected objects, and also objects providing life activity of the population and functioning of transport;

2) to limit functioning of large objects of trade;

3) to suspend activities of shopping centers, movie theaters, theaters, exhibitions and other objects with mass accumulation of people;

4) to enter quarantine, to perform large-scale sanitary and anti-epidemic actions, including with participation of structural divisions of the Ministry of Defence of the Republic of Kazakhstan and the law-enforcement bodies performing activities in the field of sanitary and epidemiologic wellbeing of the population;

5) to prohibit holding spectacular, sporting and other mass events, and also family, commemorative events;

6) to set restrictions for entrance for the territory of the Republic of Kazakhstan, and also for departure from its territory with all modes of transport, except for personnel of diplomatic service of the Republic of Kazakhstan and foreign states, and also members of delegations of the international organizations going to the Republic of Kazakhstan by the invitation of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

4. Determine responsible for implementation of the measures applied in the conditions of emergency rule, State commission on providing emergency rule in case of the President of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan, Committee of homeland security of the Republic of Kazakhstan, the Ministry of Defence of the Republic of Kazakhstan, the Ministry of Health of the Republic of Kazakhstan, the Ministry of the industry and infrastructure development of the Republic of Kazakhstan, the Ministry of Finance of the Republic of Kazakhstan, akims of the cities of Nour-Sultan, Almaty, Shymkent and areas.

5. To provide to the Attorney-General of the Republic of Kazakhstan respecting the rule of law in case of implementation of measures and the temporary restrictions set by this Decree.

6. To the government of the Republic of Kazakhstan:

1) to allocate necessary funds from reserve of the Government of the Republic of Kazakhstan for providing emergency rule;

2) to strengthen control of the persons evading from physical examination and treatment, observance of the quarantine mode, hiding the data important for determination of epidemiological situation, and also measure of responsibility of specified persons;

3) together with the central and local state bodies to take other measures for implementation of this Decree for the purpose of non-admission of spread of coronavirus of COVID-19 in the territory of the Republic of Kazakhstan.

7. This Decree becomes effective from the date of signing.
