1. Approve the enclosed Regulations on forming and maintaining the unified register of the certificates of conformity, provision containing in the specified register of data and on payment for provision of such data.

2. To the Ministry of Industry and Energy of the Russian Federation together with Federal Agency for Technical Regulation and Metrology and other interested federal executive bodies till September 1, 2006 to develop and approve procedure for transfer by certification bodies of data on the certificates of conformity issued by them in the unified register of the issued certificates of conformity.

3. To Federal Agency for Technical Regulation and Metrology together with the Ministry of Industry and Energy of the Russian Federation and the Ministry of Finance of the Russian Federation to determine till September 1, 2006 the amount of payment for provision by requests of data on the issued certificates of conformity containing in the unified register of the issued certificates of conformity.

Regulations on forming and maintaining the unified register of the certificates of conformity, provision containing in the specified register of data and on payment for provision of such data

I. General provisions

1. This Provision establishes procedure for forming and maintaining the unified register of certificates of conformity (further - the unified register), provisions of the data on the issued certificates of conformity, on suspension, renewal, prolongation or the termination of their action containing in the unified register (further - data on certificates of conformity) and payments for provision of data on certificates of conformity, and also the powers of federal executive bodies connected with maintaining the unified register, and certification bodies, connected with transfer of data on certificates of conformity in the unified register.

2. The unified register is created and kept by Federal Accreditation Service in interaction with certification bodies.

II. Procedure for forming and maintaining the unified register

Forming and maintaining the unified register include collection by Federal Accreditation Service of the data on certificates of conformity, suspension, renewal, prolongation or the termination of their action transferred to it by certification bodies, entering into the unified register of data on certificates of conformity, their storage, systematization, updating and change, and also protection of information containing in the unified register.

5. The basis for entering into the unified register of data on certificates of conformity is the decision on issue of the certificate of conformity, on suspension, renewal, prolongation or the termination of its action accepted in accordance with the established procedure.

6. Are not transferred to the unified register and data on certificates of conformity on products (works, services) delivered for federal state needs according to the state defensive order are not entered and also on products (works, services) used for the purpose of protection of the data which are the state secret or carried to information of limited access protected in accordance with the legislation of the Russian Federation and on products (works, services), data on which are the state secret.

7. Data on certificates of conformity are transferred by certification bodies to the Federal Service on accreditation in electronic form on communication channels:

a) within 1 working day from decision date about issue of the certificate of conformity;

b) within 1 working day from decision date about suspension, renewal, prolongation or cancellation of the issued certificate of conformity.

8. Data on certificates of conformity are entered in the unified register within 1 working day from the date of their receipt in Federal Accreditation Service in the form of the record containing:

a) name and location of the applicant;

b) name and location of the manufacturer of products;

c) the name and the location of the certification body which issued the certificate of conformity;

d) surname, name, middle name of the head of certification body;

e) information on subject to certification allowing to identify it;

e) information on technical regulations on which compliance to requirements certification was carried out;

g) information on the documents submitted by the applicant to certification body as the proof of compliance of products to requirements of technical regulations;

h) information on the conducted researches (testing) and measurements;

i) registration number of the issued certificate of conformity, effective period, accounting number of the form on which the issued certificate of conformity is drawn up;

j) date and reason of suspension, renewal or cancellation of the certificate of conformity;

k) date, renewal term of action of the certificate of conformity and basis for its prolongation.

10. Forming and maintaining the unified register is performed in the conditions providing prevention of unauthorized access to it.

For prevention of loss of data on the certificates of conformity containing in the unified register its backup copy is created.

11. Financial provision of the expenses connected with forming and maintaining the unified register is performed within the budgetary appropriations provided in the federal budget of Federal Accreditation Service on management and management in the sphere of the established functions.

III. Provision of data on the certificates of conformity containing in the unified register

12. The data on certificates of conformity containing in the unified register are provided by Federal Accreditation Service and territorial authorities subordinated to it to public authorities, local government bodies, other legal entities, and also physical persons.
