About public service of the Russian Cossacks

Article 1. Subject of regulation of this Federal Law

1. This Federal Law determines legal and organizational bases of execution by the Russian Cossacks of public service.

2. This Federal Law does not extend to the activities of the Russian Cossacks which are not connected with public service.

Article 2. The basic concepts used in this Federal Law

1. For the purposes of this Federal Law the following basic concepts are used:

1) the Russian Cossacks - the citizens of the Russian Federation who are members of the Cossack societies;

2) the state register of the Cossack societies in the Russian Federation - the information resource containing data on the Cossack societies;

3) the Cossack society - form of self-organization of the citizens of the Russian Federation who united on the basis of community of interests for the purpose of revival of the Russian Cossacks, protection of its rights, preserving traditional conduct of life, managing and culture of the Russian Cossacks according to the federal legislation (non-profit organization). The Cossack society is created in the form of farm, stanitsa, city, district (yurtovy), district (otdelsky), army or All-Russian Cossack society which members in accordance with the established procedure assume liabilities on execution of the public or other service. Control of the Cossack society is exercised of the supreme body of management of the Cossack society, the ataman of the Cossack society, and also other governing bodies of the Cossack society formed according to the Federal Law, the presidential decree of the Russian Federation and the charter of the Cossack society. The Cossack society according to this Federal Law is subject to entering into the state register of the Cossack societies in the Russian Federation;

4) farm, stanitsa, city Cossack society - primary consolidation of citizens of the Russian Federation and members of their families - inhabitants of one or several rural and residential locations or other settlements, entered in the state register of the Cossack societies in the Russian Federation and which members in accordance with the established procedure assumed liabilities on execution of the public or other service;

4. 1) district (yurtovy) Cossack society - the Cossack society which is created (is created) by merging of farm, stanitsa and city Cossack societies;

5) district (otdelsky) Cossack society - the Cossack society which is created (is created) by merging of the district (yurtovy) Cossack societies and farm, stanitsa and city Cossack societies which are not part of district (yurtovy) Cossack societies;

6) army Cossack society - the Cossack society which is created (is created) by merging of district (otdelsky) Cossack societies and performs the activities in the territories of two and more subjects of the Russian Federation or in the territory of one subject of the Russian Federation which is formed as a result of consolidation of two and more subjects of the Russian Federation;

7) the All-Russian Cossack society - the Cossack society which is created (is created) by merging of army Cossack societies, and also the district (otdelsky) Cossack societies which are not part of army Cossack societies. The charter of the All-Russian Cossack society affirms the President of the Russian Federation.

Procedure for coordination of the charters of the farm, stanitsa, city, district (yurtovy), district (otdelsky) and army Cossack societies created (created) or existing within the territory in which other Cossack society performs the activities and approval procedure of charters of the Cossack societies with heads of municipalities, management officials of subjects of the Russian Federation and the federal executive body authorized by the Government of the Russian Federation with the Cossack societies are determined by interaction by the President of the Russian Federation.

Article 3. Legal basis of public service of the Russian Cossacks

The legal basis of public service of the Russian Cossacks are the Constitution of the Russian Federation, this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, and also the laws and other regulatory legal acts of subjects of the Russian Federation in the field of public service.

Article 4. Basic principles of execution by the Russian Cossacks of public service

1. The basic principles of execution by the Russian Cossacks of public service are:

1) legality;

2) priority of rights and freedoms of man and citizen, their direct action, obligation of their recognition, observance and protection;

3) equal access for citizens of the Russian Federation to public service, interrelation of the public and municipal service;

4) professionalism and competence of government employees;

5) security of government employees from illegal intervention in their professional office activity of state bodies and officials, physical persons and legal entities.

2. Realization of the principles of execution by the Russian Cossacks of public service is provided with the federal legislation about public service.

3. Members of the Cossack societies entered in the state register of the Cossack societies in the Russian Federation the assumed liabilities on execution of the public or other service, shall suspend the membership in the political parties, other public associations pursuing the political goals having no right to enter them and to take part in their activities. Activities of political parties, other public associations pursuing political goals in the Cossack societies entered in the state register of the Cossack societies in the Russian Federation are not allowed.

Article 5. Public service of the Russian Cossacks

1. The Russian Cossacks pass the public civil service in accordance with the legislation of the Russian Federation.

2. The Russian Cossacks pass military service in the Armed Forces of the Russian Federation, other troops, military (special) forming and bodies according to the federal legislation. For passing of military service the Russian Cossacks go, as a rule, to connections and military units of the Armed Forces of the Russian Federation to which traditional Cossack names, troops of national guard of the Russian Federation and boundary bodies are appropriated.

3. The Russian Cossacks pass the Federal State Service connected with law-enforcement activities according to the federal legislation.

4. Russian Cossacks in accordance with the established procedure:

1) renders assistance to state bodies in the organization and conducting military accounting of members of the Cossack societies, will organize military patriotic education of recruits, their preparation for military service and extra army training of members of the Cossack societies during their stay in inventory;
