About approval of Rules of carrying out accreditation of associations of subjects of private entrepreneurship

(as amended on 31-12-2013)

According to the Law of the Republic of Kazakhstan of January 31, 2006 "About private entrepreneurship" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of carrying out accreditation of associations of subjects of private entrepreneurship.

2. This resolution becomes effective from the date of its official publication.

Rules of carrying out accreditation of associations of subjects of private entrepreneurship

1. General provisions

1. These rules of carrying out accreditation of associations of subjects of private entrepreneurship (further - Rules) are developed according to the Law of the Republic of Kazakhstan of January 31, 2006 "About private entrepreneurship" and establishes procedure for the organization and implementation of carrying out accreditation of associations of subjects of private entrepreneurship.

2. Accreditations are subject:

at the republican level - the union (association) of associations of subjects of private entrepreneurship, republican consolidation on small business, republican branch associations of subjects of private entrepreneurship;

at the regional level - branches republican, regional associations of subjects of private entrepreneurship, branches republican, regional associations on small business;

at the city, district levels - branches republican, regional, city, district associations of subjects of private entrepreneurship, branches republican, regional, city, district associations on small business.

4. If two and more non-profit organizations representing one administrative and territorial unit, one field of activity apply for accreditation, the non-profit organization which combines the bigger number of citizens is subject to accreditation.

5. Accreditation of associations of subjects of private entrepreneurship (further - associations) is performed by the central state and local executive bodies (further - state bodies).

6. Accreditation is performed by state body annually, after publication of the announcement of terms and conditions of implementation of accreditation in the state and Russian languages.

When implementing accreditation at the republican level of the announcement are published in the periodic printing editions distributed in all territory of the Republic of Kazakhstan or on the official sites of state bodies. Announcements of implementation of accreditation at the regional, city and district levels are published in the periodic printing editions distributed to the territories of the corresponding administrative and territorial unit or on the official sites of state bodies.

7. For the purpose of objective and competent implementation of accreditation in each state body the commission on accreditation is created (further - the commission). The structure and Regulations on the commission affirms the decision of the head of state body.

2. Procedure for carrying out accreditation

8. For receipt of accreditation the applicant submits the following documents to state body:

1) the statement according to appendix 1 to these rules;

2) notarized copies of constituent documents and the certificate * or certificates of state registration (re-registration) of consolidation as the legal entity, in case of non-presentation of the original for reconciliation;

Note: * the certificate on the state (accounting) registration (re-registration) of the legal entity granted before enforcement of the Law of the Republic of Kazakhstan of December 24, 2012 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning state registration of legal entities and accounting registration of branches and representations" is valid before the termination of activities of the legal entity.

9. The procedure for carrying out accreditation includes the following stages:

1) consideration of accreditation materials by the commission;

2) adoption by state body of the decision on accreditation or about refusal in accreditation;

3) issue of the certificate on accreditation or the written notice of refusal in accreditation with reasons.

10. Consideration of documents is performed on commission sessions. The commission recommends:

1) to accredit consolidation;

2) to refuse accreditation to consolidation;

3) to suspend or terminate the certificate on accreditation.

11. The state body based on the recommendation of the commission makes the decision on issue of the certificate on accreditation or on refusal in accreditation.

The certificate on accreditation or the written notice of refusal in accreditation with reasons for the reasons is issued to consolidation within five working days from the date of adoption of the relevant decision by state body.

12. The term of consideration of documents and decision making about issue of the certificate on accreditation or about refusal in accreditation shall not exceed ten working days from the moment of the termination of term of reception of applications.

13. Accreditation it can be refused if:

1) the submitted documents do not conform to requirements of Item 8 of these rules;

2) consolidation does not perform activities for protection of the rights and legitimate interests of his members;

3) the submitted documents contain the false or incomplete information.

14. The certificate on accreditation is granted for a period of 3 years in form according to appendix 2 to these rules.

15. The certificate on accreditation is inaliennable and is not subject to transfer to other legal entities.

16. In case of loss of the certificate on accreditation consolidation can receive its duplicate in the state body which granted the certificate within ten working days from the date of submission of the corresponding statement.

17. The certificate on accreditation is suspended by state body in case of detection of the doubtful or distorted data in the documents submitted on accreditation.
