1. Approve the enclosed Rules of maintaining the State register of regulatory legal acts, reference control bank of regulatory legal acts of the Republic of Kazakhstan.

2. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of December 4, 1997 No. 1680 "About approval of the Regulations on the State register of regulatory legal acts of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1997, No. 52, the Art. 478);

2) the order of the Government of the Republic of Kazakhstan of August 19, 1998 No. 793 "About modification and amendments in the order of the Government of the Republic of Kazakhstan of December 4, 1997 No. 1680" (SAPP of the Republic of Kazakhstan, 1998 No. 29, the Art. 251);

3) the subitem 2) Item 1 of the order of the Government of the Republic of Kazakhstan of October 2, 2002 No. 1082 "About modification and amendments in some decisions of the Government of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2002, No. 33, the Art. 355).

Rules of maintaining the State register of regulatory legal acts, reference control bank of regulatory legal acts of the Republic of Kazakhstan

1. General provisions

1. The basic concepts used in these rules:

1) the State register of regulatory legal acts of the Republic of Kazakhstan (further - the State register) - the single system of the state accounting of regulatory legal acts of the Republic of Kazakhstan containing details of regulatory legal acts and other data of directory nature on these acts;

2) reference control bank of regulatory legal acts of the Republic of Kazakhstan (further - Reference bank) - set of the regulatory legal acts (with changes and amendments) in printing and electronic and digital form certified by means of the digital signature, data on which are entered in the State register of regulatory legal acts of the Republic of Kazakhstan;

3) reference control regulatory legal act - the derivative regulatory legal act in printing and electronic and digital form created and the "Republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" (further - RTsPI) consisting of initial regulatory legal act signed by the digital signature of the official of the Republican state company on the right of economic maintaining (with changes; and amendments) which concept is determined by the Law of the Republic" Kazakhstan of March 24, 1998 "About regulatory legal acts" (further - the Law);

4) the digital signature - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

5) information systems of electronic document management of state bodies - general concept of systems of exchange of electronic documents of the state bodies performing mutual exchange and used for the purpose of maintaining Reference bank.

2. The state register and Reference bank are created for the purpose of ensuring single state accounting of regulatory legal acts of the Republic of Kazakhstan.

3. Maintaining the State register and Reference bank performs RTsPI.

4. The regulatory legal acts brought in Reference bank are subject to accounting in chronological procedure.

5. Storage duration of reference control regulatory legal acts - it is permanent.

6. Regulatory legal acts with signature stamp "for office use", "not for seal", "are not subject to publication", 3), 4), 5), 6), 7) of Item 1 of article 17 of the Law are placed in Reference bank in electronic form in the form of details according to subitems 2).

Regulatory legal acts with signature stamp of "special importance", "top secret", "confidentially" are not subject to inclusion in the State register and Reference bank.

2. Procedure for maintaining the State register and Reference bank

Copies of regulatory legal acts of the President of the Republic of Kazakhstan, Parliament of the Republic of Kazakhstan and its chambers, the Governments of the Republic of Kazakhstan, the Constitutional Council of the Republic of Kazakhstan and the Supreme Court of the Republic of Kazakhstan go state bodies to RTsPI in printing and electronic type within five working days from the date of signing in one copy in the state and Russian languages certified by seal of state body and certified by the digital signature of person, representative to sign the regulatory legal acts specified in article 29 of the Law.

Copies of normative legal orders of ministers of the Republic of Kazakhstan and other heads of the central state bodies, heads of departments, normative legal resolutions of the central state bodies, normative resolutions of Central Election Commission, normative legal decisions of maslikhats, and also normative legal resolutions of akimats and normative legal decisions of the akims who underwent state registration in the Ministry of Justice of the Republic of Kazakhstan and its territorial authorities go state bodies to RTsPI in printing and electronic type within five working days from the date of their obtaining in one copy in the state and Russian languages certified by seal of state body and certified by the digital signature of person, representative to sign the regulatory legal acts specified in article 29 of the Law.
