About payment terms of work of heads of the state organizations subordinated to the Ministry of Agriculture and Food
Based on subitem 8.5-1 of Item 8 of the Regulations on the Ministry of Agriculture and Food of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of June 29, 2011 No. 867, of Item part two 3, of subitem 6 part two. 1, subitem 6 parts two. 2, 6, of part four of Item 8 and Item 10 of the Regulations on payment terms of work of heads of the state organizations and organizations from ownership ratios of the state in their property approved by the resolution of Council of Ministers of the Republic of Belarus of July 8, 2013 No. 597, I ORDER to part two of subitem 6.8 of Item:
1. Approve the Instruction about payment terms of work of heads of the state organizations subordinated to the Ministry of Agriculture and Food of the Republic of Belarus it (is applied).
2. Recognize invalid:
the order of the Ministry of Agriculture and Food of the Republic of Belarus of June 28, 2017 No. 193 "About payment terms of work of heads of the state organizations subordinated to the Ministry of Agriculture and Food of the Republic of Belarus";
the order of the Ministry of Agriculture and Food of the Republic of Belarus of February 28, 2018 No. 69 "About entering of amendments and changes into the order of the Ministry of Agriculture and Food of the Republic of Belarus of June 28, 2017 No. 193".

1. This Instruction developed according to Regulations on payment terms of work of heads of the state organizations and the organizations from ownership ratios of the state in their property determines payment terms of work of heads of the state organizations subordinated to the Ministry of Agriculture and Food (further - Ministry of Agriculture and Food Production), except for the state-financed organizations and other organizations receiving subsidies which workers are equated on compensation to employees of state-financed organizations (further, unless otherwise specified, - the organizations).
The payment terms of work of heads of the organizations determined according to this Instruction join in the contracts signed with them.
2. The salary of the head of the organization whose payment terms of work are determined according to the legislation on work and employment of the population, and this Instruction consists from:
salary, the allowance, award, remuneration following the results of work in year and other payments, except for heads of the organizations specified in paragraph three of this part;
salary, award, remuneration following the results of work in year and other payments - in the organizations according to appendix 1.
The salary of the head of the organization (further - salary) is created by summing of the basic salary estimated according to Item 3 of this Instruction (further - basic salary), and the amounts of its increase provided in item 4 of the Regulations on payment terms of work of heads of the state organizations and the organizations from ownership ratios of the state in their property.
3. The basic salary of the head of the organization for the decision of the Minister of Agriculture and Food (further - the Minister) can be established:
in the amount of, not exceeding the average monthly salary which developed by the corresponding type of economic activity from the beginning of year, preceding month of establishment of basic salary;
on the basis of tariff coefficients of the Single scale of charges of the workers of the Republic of Belarus specified in appendix to the Regulations on payment terms of work of heads of the state organizations and the organizations from ownership ratios of the state in their property and the tariff charge of the first category operating in the organization or established to the head of the organization by the order of Ministry of Agriculture and Food Production;
on the basis of the tariff coefficients of scale of charges determined by the Tariff agreement between the Ministry of Agriculture and Food, the Belarusian labor union of employees of agro-industrial complex and the Republican agro-industrial union "BELAPS", and the tariff charge of the first category operating in the organization or established to the head of the organization by the order of Ministry of Agriculture and Food Production.
4. To the head of the organization are not charged and all types of awards and (or) remunerations in the cases established by acts of the legislation, including the Presidential decree of the Republic of Belarus of August 13, 1996 No. 292 "About provision to legal entities of delay on debt repayment on taxes and penalty fee", the resolution of Council of Ministers of the Republic of Belarus of July 8, 2013 No. 597 "About enhancement of payment terms of work of heads of the organizations depending on results of financial and economic activities, recognition voided some resolutions of Council of Ministers of the Republic of Belarus and their separate structural elements are not paid".
5. The basic salary of the head of the organization established according to the paragraph the second Item 3 of this Instruction increases monthly depending on growth of the average monthly salary which developed by the corresponding type of economic activity by the accruing result since the beginning of year and does not decrease in case of its decrease.
6. The basic salary of the head of the organization established according to the paragraph the fourth Item 3 of this Instruction changes annually based on annual accounting (financial) accounts which are submitted no later than April 1 of the year following after accounting year.
7. For decision making about change of the size of the basic salary established to the head of the organization according to paragraphs second and third Item 3 of this Instruction, the organization sends the following documents to Ministry of Agriculture and Food Production:
the petition for change of the size of basic salary with indication of the reasons of change of the size of basic salary of the head of the organization of any form signed by the head of the organization;
information on accomplishment of the forecast indicators by the organization within ensuring accomplishment of the forecast of social and economic development of the Republic of Belarus established by the business plan of organization development for year with indication of actual data for last year and the corresponding period of last year;
