About approval of Rules of rational use of lands of agricultural purpose and modification and amendments in some orders of the Minister of Agriculture of the Republic of Kazakhstan

According to subitem 2-1) of Item 1 of Article 14 of the Land code of the Republic of Kazakhstan I ORDER:

1. Approve the enclosed Rules of rational use of lands of agricultural purpose.

2. Make changes and addition to some orders of the Minister of Agriculture of the Republic of Kazakhstan:

1) in the order of the Minister of Agriculture of the Republic of Kazakhstan of July 3, 2019 No. 252 "About approval of Rules of the organization and carrying out monitoring of use of the lands agricultural purpose provided for maintaining country or farm, agricultural production" (it is registered in the Register of state registration of regulatory legal acts No. 18997, it is published on July 18, 2019 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following change:

The rules of the organization and carrying out monitoring of use of the lands agricultural purpose provided for maintaining country or farm, agricultural production (further - Rules), approved by the specified order to be reworded as follows according to appendix 1 to this order;

2) in the order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of April 24, 2017 No. 173 "About approval of Rules of rational use of pastures" (it is registered in the Register of state registration of regulatory legal acts No. 15090, it is published on May 16, 2017 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes and amendment:

in Rules of rational use of the pastures approved by the specified order:

state Item 2 in the following edition:

"2. In these rules the following basic concepts are used:

1) the web portal of monitoring of use of lands of agricultural purpose (further - the web portal) - the automated information system intended for introduction, collection, processing, data analysis about use of the lands of agricultural purpose received by introduction of results of systematic observations, land shootings, inspections, inventory counts, materials of the state control of use and protection of lands, contemporary records, the this remote sensing of lands, the data received from the state information systems and electronic information resources, and also other data on high-quality condition of lands;

2) pasture rotation - system of periodic and consecutive use of pastures and care of them for their maintenance in productive condition according to the Plan for management of pastures and their use;

3) the farm animals grazed on pastures (further - farm animals) - cattle, sheep, goats, horses, camels;

4) kormoyemkost of pastures - productivity of pasturable herbage per acre pastures;

5) pastbishchepolzovatel - the physical person or legal entity having right to use pastures according to the Law and other regulatory legal acts of the Republic of Kazakhstan;

6) rational use of pastures - use of fodder resources of pastures in case of which their normal state and reproduction taking into account ecological features and with observance of nature protection regulations remains (including maximum permissible regulation of load of total area of pastures);

7) number of pasture on the web portal - the unique code of the pasturable site assigned by the web portal and intended for determination of its location (identification);

8) the book of history of pasture - the electronic document created on the web portal, giving evident idea of space provision and the sizes of pasture, containing information on pasture rotations, structure and the areas of pasture;

9) distant pastures - pastures which are used for maintaining distant-pasture livestock production in the territories, remote from settlements.";

add with Item 2-1 of the following content:

"2-1. For determination of rational use of pastures the data of monitoring of use of the lands of agricultural purpose provided for maintaining country or farm, agricultural production, established by the order of the Minister of Agriculture of the Republic of Kazakhstan of July 3, 2019 No. 252 are used (it is registered in the Register of state registration of regulatory legal acts No. 18997).";

1) use of pastures taking into account pasture rotations and sources of water uses;

3) ensuring maximum permissible regulation of the load of total area of pastures (further - loading Regulation) approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of April 14, 2015 No. 3-3/332 "About approval of maximum permissible regulation of load of total area of pastures" (it is registered in the Register of state registration of regulatory legal acts No. 11064);

4) use of pastures taking into account the schedule;

5) taking measures to prevention of disposal of pastures from economic circulation, non-admission of overgrowing of lands weed and wood and shrubby vegetation, and also litterings by household and production waste.

4. When using pastures the local executive body or pastbishchepolzovatel independently provides forming of the book of history of pasture on the web portal from the date of acquisition of rights the parcel of land, and also availability of farm animals in the quantity which is not exceeding Norma of loading in a month.

5. For the purpose of Norma's providing of loading data on livestock of farm animals, kormoyemkost of the pastures which are in use of pastbishchepolzovatel are used.

For calculation of quantity of livestock of the farm animals belonging to pastbishchepolzovatel the average value received on the basis of data as of April 1 and on October 1 the corresponding year according to data from the database on identification of farm animals is accepted.";

3. Recognize invalid some orders of the Ministry of national economy of the Republic of Kazakhstan and the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan according to appendix 2 to this order.

4. To provide to management committee with land resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

5. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

6. Paragraphs the fifth, the eleventh, twelfth, nineteenth and twenty third the subitem 2) of Item 2 of this order become effective since January 1, 2021, except for Akmola, Kostanay, East Kazakhstan and Mangystau regions in which the specified paragraphs become effective in the pilot mode.

7. Chapter 3 of Rules is effective till January 1, 2021.

8. This order becomes effective from the date of its first official publication.

Rules of rational use of lands of agricultural purpose

Chapter 1. General provisions

1. These rules of rational use of lands of agricultural purpose (further – Rules) are developed according to subitem 2-1) of Item 1 of Article 14 of the Land code of the Republic of Kazakhstan and determine procedure for rational use of lands for agricultural purpose.

2. In these rules the following concepts are used:
