About temporary commissions of inquiry and the temporary special commissions of the Verkhovna Rada of Ukraine

Section I. General provisions

Article 1. Status of temporary commissions of inquiry and temporary special commissions of the Verkhovna Rada of Ukraine

1. Temporary commission of inquiry of the Verkhovna Rada of Ukraine (further - commission of inquiry) - collegiate temporary organ of the Verkhovna Rada of Ukraine which is formed of number of People's Deputies of Ukraine which task is implementation of parliamentary control by conducting investigation on the questions which are of public interest.

2. The temporary special commission of the Verkhovna Rada of Ukraine (further - the special commission) - collegiate temporary organ of the Verkhovna Rada of Ukraine which is created from among People's Deputies of Ukraine for preparation and preliminary consideration of questions, and also for preparation and completion of drafts of the laws and other acts of the Verkhovna Rada of Ukraine as head committee if the subject of legal regulation of such projects does not belong to areas of jurisdiction of the committees formed by the Verkhovna Rada of Ukraine except case of acceptance by the Verkhovna Rada of Ukraine of the decision on creation of the special commission with the rights of the main committee for further work on the bill of introduction of amendments to the Constitution of Ukraine.

3. The organization and procedure for activities of commissions of inquiry and special commissions are determined by the Constitution of Ukraine, the Regulations of the Verkhovna Rada of Ukraine approved by the Law of Ukraine "About Regulations of the Verkhovna Rada of Ukraine" (further - Regulations of the Verkhovna Rada of Ukraine), present and other laws of Ukraine.

4. The terms "real conflict of interest", "potential conflict of interest", "family members", "close persons" which are used in this Law are used in the value given in the Law of Ukraine "About prevention of corruption".

Article 2. Principles of activities of commissions of inquiry and special commissions

1. Commissions of inquiry and the special commissions operate on the principles of supremacy of law, legality, respect and observance of rights of man and citizen, collective nature, equality of members of the commission, free discussion and the solution of questions, objectivity, impartiality and justification of the made decisions, the conclusions and offers.

Article 3. Accountability and term of activities of commissions of inquiry and special commissions

1. Commissions of inquiry and the special commissions are accountable to the Verkhovna Rada of Ukraine.

2. Commission of inquiry in the time determined by the Verkhovna Rada of Ukraine, but no later than in six months from the date of its education, submits to the Verkhovna Rada of Ukraine the written report about the done work, and also the offers prepared by it concerning drafts of acts of the Verkhovna Rada of Ukraine, the conclusion, the offer and other materials which are provided to People's Deputies of Ukraine for acquaintance.

3. The special commission in the time determined by the Verkhovna Rada of Ukraine, but no later than in six months from the date of its education, submits to the Verkhovna Rada of Ukraine the written report about the done work, and also the corresponding drafts of acts of the Verkhovna Rada of Ukraine and other materials prepared by it which are provided to People's Deputies of Ukraine for acquaintance.

4. The term of the report of commission of inquiry and special commission is determined by the Verkhovna Rada of Ukraine in the resolution on creation of the relevant commission.

5. The question of hearing of the report, the conclusions and offers of commission of inquiry, the special commission according to the procedure established by this Law, and in time determined in the resolution of the Verkhovna Rada of Ukraine on creation of the relevant commission out of turn without vote joins in the agenda of plenary sessions of the Verkhovna Rada of Ukraine of plenary meetings after day of submission of the report, the conclusions and offers next day and is considered by the first at plenary meeting.
