About approval of Rules of passing of accounting registration and maintaining the register of the collection agencies

1. Approve the enclosed Rules of passing of accounting registration and maintaining the register of the collection agencies.

2. Recognize invalid:

1) the resolution of Board of National Bank of the Republic of Kazakhstan of May 29, 2017 No. 92 "About approval of Rules of passing of accounting registration and maintaining the register of the collection agencies" (it is registered in the Register of state registration of regulatory legal acts at No. 15400, it is published on August 3, 2017 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan);

2) Item 11 of the List of regulatory legal acts of the Republic of Kazakhstan concerning regulation of the financial market to which changes are made the Board of National Bank of the Republic of Kazakhstan approved by the resolution of July 30, 2018 No. 157 "About modification of some regulatory legal acts of the Republic of Kazakhstan concerning regulation of the financial market" (it is registered in the Register of state registration of regulatory legal acts at No. 17559, it is published on October 22, 2018 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan).

3. To provide to department of methodology and regulation of the financial organizations in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by the subitem 2) of this Item and item 4 of this resolution.

4. To department of external communications - the press service of National Bank of the Republic of Kazakhstan to provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

5. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Smolyakov O. A.

6. This resolution becomes effective since January 1, 2020 and is subject to official publication.

Rules of passing of accounting registration and maintaining register of the collection agencies

1. These rules of passing of accounting registration and maintaining the register of the collection agencies (further - Rules) are developed according to the Law of the Republic of Kazakhstan of May 6, 2017 "About collection activities" (further - the Law) and determine procedure for accounting registration and maintaining the register of the collection agencies.

2. The legal entity having intention to perform collection activities (further - the applicant) is subject to accounting registration.

3. For passing of accounting registration the applicant represents to authorized body on regulation, control and supervision of the financial market and the financial organizations (further - authorized body) the statement in form, according to appendix 1 to Rules (further - the statement) with application of documents, provided in Item 2 of article 7 of the Law.

The authorized body within two working days from the moment of receipt of documents for passing of accounting registration checks completeness of the submitted documents.

In case of representation by the applicant, incomplete document package the authorized body in time specified directs to parts two of this Item in writing motivated refusal in further review of the statement.

4. The application with appendix of required documents is submitted on paper or in electronic form through the web portal of "the electronic government".

5. In case of submission of documents in electronic form the statement with application of documents, provided in Item 2 of article 7 of the Law, makes sure the digital signature of person authorized on filing of application.

The documents provided by subitems 2), 3), 4), 5), 6) of Item 2 of article 7 of the Law are presented in the form of electronic copies of documents in the PDF format.

6. In case of submission of documents on paper the documents provided in Item 2 of article 7 of the Law, consisting of several sheets are represented numbered and stitched.
