1. Approve the enclosed Rules of passing of accounting registration of the organizations performing microfinancial activities including the list of the documents provided for passing of accounting registration, and also maintaining and exception of the register of the organizations performing microfinancial activities.

2. Recognize invalid regulatory legal acts of the Republic of Kazakhstan, and also structural elements of some regulatory legal acts of the Republic of Kazakhstan according to the list according to appendix to this resolution.

3. To provide to department of methodology and regulation of the financial organizations in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by the subitem 2) of this Item and item 4 of this resolution.

4. To department of external communications - the press service of National Bank to provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

5. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Smolyakov O. A.

6. This resolution becomes effective since January 1, 2020 and is subject to official publication.

Rules of passing of accounting registration of the organizations performing microfinancial activities including the list of the documents provided for passing of accounting registration, and also maintaining and exception of the register of the organizations performing microfinancial activities

Chapter 1. General provisions

1. These rules of passing of accounting registration of the organizations performing microfinancial activities including the list of the documents provided for passing of accounting registration, and also maintaining and exception of the register of the organizations performing microfinancial activities (further - Rules), are developed according to the Law of the Republic of Kazakhstan of November 26, 2012 "About microfinancial activities" (further - the Law) and determine procedure for passing of accounting registration of the organizations performing microfinancial activities including the list of the documents submitted for passing of accounting registration, and also maintaining the register and exception of the register of the organizations performing microfinancial activities.

For the purposes of Rules the organizations performing microfinancial activities are understood as the microfinancial organizations, credit partnerships and pawnshops performing activities for provision of the microcredits.

2. Accounting registration of the organizations performing microfinancial activities is performed according to article 14 of the Law and Rules.

Chapter 2. Procedure for passing of accounting registration of the organizations performing microfinancial activities, and the list of the documents provided for passing of accounting registration

3. For passing of accounting registration the organization performing microfinancial activities represents through the web portal of "the electronic government" to authorized body on regulation, control and supervision of the financial market and the financial organizations (further - authorized body) the statement certified by the digital signature of person authorized on filing of application in form according to appendix 1 to Rules with appendix of the following documents:

1) copies of the documents confirming authorized capital payment, and also data on observance of the minimum size of equity in form according to appendix 2 to Rules;

2) the document confirming payment of collection for passing of accounting registration;

3) data on system of safety and technical reinforcement of rooms of pawnshop in form according to appendix 3 to Rules (for pawnshops).

The documents provided by part one of this Item are presented in the form of electronic copies of documents in the PDF format.

4. Within 10 (ten) working days from the date of representation of complete document package the authorized body brings the organization performing microfinancial activities in the register of the organizations performing microfinancial activities and notifies the organization performing microfinancial activities on its entering into the specified register or directs the motivated answer in writing about causes of failure in accounting registration.

5. The refusal in accounting registration of the organization performing microfinancial activities is made on the bases, stipulated in Item 1 article 15 of the Law.
