1. Approve Regulations on carrying out the tender "Tax Lottery" it (is applied).

2. To impose control over the implementation of this resolution on the State Tax Administration.

3. The expenses connected with the organization and carrying out the tender "Tax Lottery" are performed at the expense of the means approved for the State Tax Administration in the annual law on the budget.

4. This resolution becomes effective since January 1, 2020.

Regulations on carrying out the tender "Tax Lottery"

I. General provisions

1. The tender "Tax Lottery" (further – lottery) is measure which will promote fight against tax avoidance by restriction of cash payments.

2. The organizer of lottery is the State Tax Administration (further – the organizer).

3. For the organization of lottery the organizer has the right to attract the third parties.

4. The physical persons which reached 18-year age, owners of the bank card issued by licensed commercial emitting bank from the Republic of Moldova (further – the card) who made transactions on payment of goods/services according to rules of carrying out lottery participate in lottery.

5. The lottery is carried out annually on all territory of the Republic of Moldova from January 1 to December 31 the current year.

6. The lottery consists from:

1) four quarter stages:

first stage: January – March inclusive;

second stage: April – June inclusive;

third stage: July – September inclusive;

fourth stage: October – December inclusive;

2) two special releases:

special release of I – in the period of easter holidays;

special release of II – in the period of winter holidays.

7. At each stage of lottery the draw for the transactions made by means of the cards on POS terminals supported by licensed commercial emitting banks from the Republic of Moldova in case of payment of goods and services will be held.

8. Only transactions which amount exceeds 30 lei participate in lottery.

9. Do not correspond to lottery conditions:

1) transactions on cash withdrawal from the card account;

2) the transactions made by means of bank card by physical persons outside the Republic of Moldova;

3) money transfers from the card account on bank accounts of physical persons and/or legal entities (from the face to person);

4) transactions on replenishment of the card account of physical persons and/or legal entities;

5) the transactions performed by means of cards for payment of charges (rates) for participation in gamblings.

II. Determination of the winner of lottery

10. At each stage the organizer determines winners from among the participants specified in item 4.

11. Licensed commercial emitting banks from the Republic of Moldova shall provide to the organizer information on the transactions made by means of cards, quarterly, to the 10th following reporting quarter according to appendix No. 1, which shall contain the following data:

1) transaction date in the Den.Mesyats.God and Time format;

2) first 6 figures and last 4 figures of number of the card;

3) transaction amount with two decimal signs;

4) transaction currency (Moldovan lei);

5) licensed commercial emitting bank from the Republic of Moldova;

6) the authorization code issued by licensed commercial emitting bank from the Republic of Moldova for the corresponding transaction (Code approval-Approval code);

7) transaction reference number (Retrieval Reference Number);

8) the identifier of the terminal/seller where transaction was made.

12. The organizer generalizes information provided by banks to the 15th following reporting quarter.

13. Draws will be held on the third Thursday of the month following reporting quarter and will take into account only the transactions made with use of cards during the period corresponding to reporting quarter.

14. For special releases licensed commercial emitting banks from the Republic of Moldova within 10 days after the termination of holidays provide to the organizer information on the transactions made by physical persons by means of bank cards during the next periods:

1) for easter holidays (Easter, Radunitsa): since first day of the month preceding month in which, according to the Eastern Orthodox liturgical calendar, Easter, and before date of completion of easter holidays (Radunits) inclusive is celebrated;

2) for winter holidays: On December 1 previous year - on January 8 the current year inclusive.

Information shall be provided according to appendix No. 1.

15. Draws of special releases will be held within 10 days from the moment of receipt of information provided by licensed commercial emitting banks from the Republic of Moldova.

16. Draws of advantageous transactions will be held based on information provided by licensed commercial emitting banks from the Republic of Moldova in accidental procedure automatically through the Random.org platform.

17. The organizer holds draw, using the Excel database, all transactions performed and registered at each stage of lottery, at the same time the unique sequence number of participation is assigned to each transaction. On the website Random.org the minimum and maximum number of the registered transactions is specified and the website generates sequence number of potentially advantageous transaction. The results reported by random number generator shall be:

1) statistically independent;

2) protected from any hindrances which can affect the results represented by the generator.

18. Draws and confirmation of winners of lottery are made in the presence of the commission appointed by the order of the director of the organizer.

19. The list of advantageous transactions created by system for date of draw is printed on paper basis and affirms members of the commission. Based on this list the protocol with results of extraction which is signed by members of the commission according to appendix No. 2 is constituted.

20. The list of advantageous transactions goes the organizer to licensed commercial emitting banks from the Republic of Moldova for determination of winners within 5 days from the date of the draw. Licensed commercial emitting banks from the Republic of Moldova, in turn, determine and represent within 5 days from the date of receipt of the list of advantageous transactions to the organizer information on the won transactions, according to appendix No. 3, with simultaneous informing winners by phone.

21. The organizer within 5 days from the date of receipt of information on the won transactions places on the www.sfs.md web page the list of the won transactions on each stage of lottery, according to appendix No. 4.
