About approval of the Regulations on procedure and conditions of conducting the state sanitary and hygienic examination

Based on the paragraph of third subitem 8.32 of Item 8, of subitem 9.1 of Item 9 of the Regulations on the Ministry of Health of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 28, 2011 No. 1446, of subitem 2.2 of Item 2, of paragraph two of Item 3 of the resolution of Council of Ministers of the Republic of Belarus of July 11, 2012 No. 635 "About some questions of sanitary and epidemiologic wellbeing of the population" the Ministry of Health of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure and conditions of conducting the state sanitary and hygienic examination it (is applied).

2. Recognize invalid:

the resolution of the Ministry of Health of the Republic of Belarus of January 3, 2013 No. 1 "About approval of the Regulations on procedure and conditions of conducting the state sanitary and hygienic examination";

the resolution of the Ministry of Health of the Republic of Belarus of December 12, 2016 No. 125 "About introduction of amendments to the resolution of the Ministry of Health of the Republic of Belarus of January 3, 2013 No. 1".

3. This resolution becomes effective after its official publication.

Regulations on procedure and conditions of conducting the state sanitary and hygienic examination

Chapter 1. General provisions

1. This Provision establishes procedure and conditions of conducting the state sanitary and hygienic examination (further if other is not determined, – examination), except for examinations of activities of the subject of managing for production of food products, and also procedure and conditions of suspension, renewal, cancellation of the sanitary and hygienic conclusion.

2. For the purposes of this provision the following terms and their determinations are applied:

the applicant – the legal entity or the individual entrepreneur who addressed for conducting examination;

the place of performance of works and (or) rendering services – capital structure (the building, construction), the isolated room or its part in which subjects of managing perform performance of works and (or) rendering services;

assessment with exit to the place – assessment of conformity of the object which is subject to examination (further – object of examination), to requirements of the legislation in the field of sanitary and epidemiologic wellbeing of the population with exit to the place, carried out by officials of body (organization) exercising the state sanitary inspection without use of the control (supervising) powers conferred by the legislation on control (supervising) activities;

expansion or increase in capacity of objects – construction of additional capital structures (buildings, constructions), including objects of production, social, transport, engineering infrastructure, upgrade, reconstruction and technical upgrade of the existing certain shops and objects of the basic, the subsidiary and serving purpose, including due to installation of additional processing equipment in the territory of operating plants or the platforms adjoining them for the purpose of creation of additional or new production capacities.

Other terms and their determinations are applied in the values established by the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures", the Law of the Republic of Belarus of January 7, 2012 No. 340-Z "About sanitary and epidemiologic wellbeing of the population".

Chapter 2. Procedure and conditions of acceptance, consideration of the applications about issue of the sanitary and hygienic conclusion

For conducting examination the applicant represents to the body (organization) exercising the state sanitary inspection, the statement for issue of the sanitary and hygienic conclusion, and also the documents and (or) data provided by the regulations of the ministerial procedures performed concerning subjects of managing, approved by the resolution of the Ministry of Health of the Republic of Belarus of February 21, 2022 No. 13 "About approval of regulations of ministerial procedures in the field of health care" (further – regulations of ministerial procedure), for the corresponding ministerial procedure.

The documents and (or) data necessary for examination implementation are provided by the applicant in the form and procedure determined by regulations of ministerial procedure.

4. The body (organization) exercising the state sanitary inspection accepts and considers, and also refuses adoption of the statement for issue of the sanitary and hygienic conclusion according to the procedure and on the bases, stipulated by the legislation about ministerial procedures.

Chapter 3. Procedure and conditions of conducting examination

5. Examination includes:

acceptance and registration of a statement about issue of the sanitary and hygienic conclusion;

consideration of the submitted documents and (or) data necessary for conducting examination;

assessment of conformity of objects of examination to requirements of the legislation in the field of sanitary and epidemiologic wellbeing of the population, including with exit to the place;

acceptance and execution of the decision by results of examination.

Elimination of separate notes on object of examination can directly be performed during examination.

The withdrawal of the statement of the interested person for issue of the sanitary and hygienic conclusion is performed according to the procedure, stipulated by the legislation about ministerial procedures.
