About approval of the Notification procedure of the state administrator or allowing body about compliance of material and technical resources of the subject of housekeeping to requirements of the legislation

According to article 1 of the Law of Ukraine "About authorization system in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

Approve the Notification procedure of the state administrator or allowing body about compliance of material and technical resources of the subject of housekeeping to requirements of the legislation which is applied.

The notification procedure of the state administrator or allowing body about compliance of material and technical resources of the subject of housekeeping to requirements of the legislation

1. Action of this Procedure extends to subjects of housekeeping irrespective of pattern of ownership who intend to make certain actions concerning implementation of economic activity or types of economic activity, the rights to which are acquired based on the declaration of compliance of material and technical resources of the subject of housekeeping to requirements of the legislation.

2. In this Procedure the terms "state administrator", "declaration of compliance of material and technical resources to requirements of the legislation" and "allowing body" are applied in the value given in the Law of Ukraine "About authorization system in the field of economic activity".

Material and technical resources of the subject of maintaining the hozyaystvaproizvodstvenny areas, material resources, means of production and documents which are used by the subject of housekeeping in the course of making of certain actions concerning implementation of economic activity or types of economic activity.

3. The subject of housekeeping or person authorized by it gives to directly state administrator or allowing body, or sends the registered mail in duplicate the declaration of compliance of material and technical resources of the subject of housekeeping to requirements of the legislation (further - the declaration).

The form of the declaration is given in appendix to this Procedure.

The model of filling of the declaration is posted on the official website of the relevant allowing organ and in the allowing centers.

Form of the declaration of compliance to requirements of the legislation concerning fire safety; concerning labor protection and industrial safety affirms the Cabinet of Ministers of Ukraine on representation according to the Ministry of Emergency Situations and Gosgorpromnadzor and to approval of Gospredprinimatelstv.

In case of the message of the declaration the signature of the physical person - the entrepreneur is certified by the registered mail by seal such physical person (in case of lack of seal the declaration is subject to notarial assurance), and the signature of the head of the legal entity - seal of the legal entity.

4. Receipt date of the declaration date of its registration as entrance correspondence the state administrator or allowing body, and in case of the message its custom the pismomdata noted on postage stamp of telecommunications agency is considered.

5. The state administrator within one working day after receipt of the declaration reports it to the relevant allowing organ.

6. The allowing body within one working day after receipt of the declaration registers it in register of subjects of housekeeping which acquired the right to making of certain actions concerning implementation of economic activity or types of economic activity based on the declaration of compliance of material and technical resources of the subject of housekeeping to requirements the legislation, except cases when the declaration is completed not in full or not according to the established form.

The form of the magazine is approved by the Ministry of Economic Development.

In case of submission of the declaration completed not in full or not according to the established form, the next working day after receipt of the declaration allowing body in writing or the official of allowing body personally makes to the subject of housekeeping inquiry concerning provision by it in the five-day time of the additional and/or specified information according to the established form.

The subject of housekeeping acquires the right to make certain actions concerning implementation of economic activity or types of economic activity from registration date of the declaration in register of subjects of housekeeping of the relevant allowing organ.

7. The first copy of the declaration remains in allowing body, the second copy not later than the next working day after receipt is transferred to the subject of housekeeping or the state administrator with mark about date and number of registration. The state administrator within one working day after day of receipt of the declaration from allowing body notifies the subject of housekeeping on receipt of the registered declaration copy.

8. The subject of housekeeping bears responsibility according to the law for representation to allowing body or the state administrator of unreliable information on material and technical resources compliance to requirements of the legislation.
