About approval of the Regulations on licensing of activities in the field of electric and mail service

According to article 15 of the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on licensing of activities in the field of electric and mail service according to appendix.

2. Bring in the order of the Government of the Kyrgyz Republic "About licensing of separate types of activity" of May 31, 2001 No. 260 the following change:

- to recognize Chapter 36 of the Regulations on licensing of separate types of activity approved by the above-stated resolution invalid.

3. Bring in the order of the Government of the Kyrgyz Republic "About approval of the Register of the allowing documents issued by executive bodies and their structural divisions" of February 25, 2004 to No. 103 the following changes:

in the Register of the allowing documents issued by executive bodies and their structural divisions:

- in the Section "National Communication Agency of the Kyrgyz Republic":

to state the name of the Section in the following edition:

"The state communication agency under the State committee of information technologies and communication of the Kyrgyz Republic";

in Items 2 and 3 of the column "Basis for Issue of Permission (Name of Regulatory Legal Act)" after words of "mail service" to add with words ", the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic";

to add Item 3 of the column "Name" after the words "Frequency Assignment" with the words "on the right of operation of radio-electronic means".

4. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on licensing of activities in the field of electric and mail service

Chapter 1. General provisions

1. This Regulations on licensing of activities in the field of electric and mail service (further - the Provision) regulate procedure for issue, renewal, suspension, renewal and cancellation of licenses for activities in the field of electric communication, data transmission, mail service and (or) permission to the admission to import to the territory of the Kyrgyz Republic of radio-electronic means by the State communication agency under the State committee of information technologies and communication of the Kyrgyz Republic.

Requirements of this provision do not extend to import to the Kyrgyz Republic and export out of its limits, and also use of special technical means, the cryptographic equipment and means of cryptographic information security.

2. Physical persons and legal entities, irrespective of legal forms and patterns of ownership, shown willingness to be engaged in the licensed type of activity in the field of electric and mail service, shall obtain the corresponding license and (or) permission.

3. Licensor in the field of electric and mail service is the State communication agency under the State committee of information technologies and communication of the Kyrgyz Republic (further - the Licensor) which grants the following licenses and (or) permissions:

1) licenses for activities:

- in the field of electric communication (except for operators and services of the internal and closed networks of telecommunication);

- in the field of data transmission (except for operators and services of the internal or closed networks of telecommunication);

- in the field of mail service;

2) permissions:

- the admission on import to the territory of the Kyrgyz Republic of radio-electronic means (further - RES) and high-frequency devices (further - VChU), other technical means giving radio-frequency radiation or being source of high-frequency electromagnetic waves.

4. The license for activities in the field of electric communication includes the following types of service:

- services of cable communication - transfer on distance of alphanumeric messages - telegrams, with obligatory record them in collection point;

- services of local telephone communication - provision of services of telecommunication, rendered in network of local telephone communication;

- services of international telecommunication - the services of telecommunication rendered in network of international telecommunication by means of which communication between the terminal equipment of network of the Kyrgyz Republic and the terminal equipment of network of other countries is performed;

- services of long distance communication - provision of services of telecommunication, rendered in network of long distance telephone communication;

- services of telematic services - telecommunication services intended for information transfer through networks of telecommunication, except for to telephone communication, cable communication, data transmission;

- services of mobile radiotelephone communication - the acceptance and transmission of messages performed by means of mobile radiotelephone communication;

- services in distribution TV, and radio programs - distribution of electric signal of broadcasting in networks of telecommunication.

5. Recognition of the licenses for the territories of the Kyrgyz Republic granted by authorized bodies of foreign states is performed according to the procedure and the cases provided by the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic".

6. Licenses for activities in the field of electric communication, activities in the field of data transmission, activities in the field of mail service and permission are termless and inaliennable.

7. Issue, renewal of the license and (or) permission to issue of the duplicate of the license and (or) permission are performed according to the procedure, established by the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic".

Chapter 2. Principles of licensing

8. The principles of licensing are:

1) transparency, openness of procedures of licensing;

2) the equal bases and conditions of licensing and (or) permission for all physical persons and legal entities, irrespective of patterns of ownership, including foreign physical persons and legal entities;
