RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of reforming of public administration

Cabinet of Ministers of Ukraine decides:

1. Bring changes which are applied in some acts of the Cabinet of Ministers of Ukraine.

2. Determine that managements are formed in the Secretariat of the Cabinet of Ministers of Ukraine for accomplishment of the tasks connected with coordination of work on strategic planning, the organization of preparation of offers to the Prime Minister of Ukraine concerning priorities of state policy, drafts of plans of priority actions of the Government and coordination of their further realization, carrying out the analysis of powers and functions of executive bodies, efficiency evaluations of their activities, and other tasks on expert analytically and other ensuring activities of the Cabinet of Ministers of Ukraine. Forming of structure of managements of the Secretariat of the Cabinet of Ministers of Ukraine is performed according to the requirements determined for the ministries by Item 1-1 of the resolution of the Cabinet of Ministers of Ukraine of March 12, 2005 No. 179 "About streamlining of structure of the office of the central executive bodies, their territorial subdivisions and local public administrations" (The Official Bulletin of Ukraine, 2005, No. 11, the Art. 522).

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. To the ministries:

1) within two weeks from the date of entry into force of this resolution to submit to the Secretariat of the Cabinet of Ministers of Ukraine proposals concerning the list of managements in all spheres in which the relevant ministry provides forming of state policy;

2) to perform actions for reduction of structures of the ministries in compliance with this resolution and to provide in connection with such structures filling of positions of public service by the translation of government employees or appointment by results of tender.

5. This resolution becomes effective from the date of its publication, except subitems 3 and 4 of item 4 of the changes approved by this resolution which become effective since January 1, 2020.

Changes which are made to some acts of the Cabinet of Ministers of Ukraine

1. In the resolution of the Cabinet of Ministers of Ukraine of March 12, 2005 No. 179 "About streamlining of structure of the office of the central executive bodies, their territorial subdivisions and local public administrations" (The Official Bulletin of Ukraine, 2005, No. 11, Art. 522; 2011, No. 4, Art. 204; 2017, No. 71, Art. 2161):

1) in Item 1:

word in paragraph one "the ministries and others" to exclude, after words of "the central executive bodies" to add with words "(except the ministries)";

in the paragraph the second:

words "the main objectives of high degree of complexity (mnogootraslevost, multifunctionality, program and target activity), coordination of the work connected with accomplishment of such tasks" shall be replaced with words "separate tasks on realization of state policy on certain activities of the central executive body";

exclude the words "As a part of Department of the Public Executive Service of the Ministry of Justice Managements Which Jurisdiction Extends to the Territory of Kiev, and Departments Which Jurisdiction Extends to the Territories of Areas in Kiev Can Be Created";

in paragraph three of the word "Heads of Interregional Territorial Authorities of the Ministry of Justice Can Have No More than Eight Deputies" to exclude;

in paragraph six of the word and figures "Chiefs of departments of the public executive service of interregional territorial authorities of the Ministry of Justice can have two deputies in case the number of staff of employees of such departments makes at least 14 units" to exclude;

add Item with the paragraph of such content:

"The list and the number of staff of structural divisions which can be formed as a part of the office of the central executive body is established by the head of relevant organ taking into account the extreme number of workers of the device, complexity and amount of the tasks assigned to body.";

Item 1-1 to state 2) in the following edition:

"1-1. As a part of the office of the ministries will be formed (if other is not provided by the acts having the highest legal force):

management - independent structural division which is created for accomplishment of the tasks connected with ensuring forming of state policy in one or several spheres of competence of the ministry, coordination and monitoring of its realization, carrying out the analysis and impact assessment of its realization on concerned parties and also other tasks, except those that are connected with accomplishment of functions on provision of administrative services, managements of objects of state-owned property or implementation of the state supervision (control). Expert groups and, in case of need - head departments are part of management. The management is headed by the CEO whose position belongs to positions of specialists in questions of reforms, or the director. The CEO (director) of management which number of staff does not exceed 32 units can have one deputy. If the number of staff of management makes more than 32 units, the CEO (director) of management can have no more than two deputies. The CEO (director) of management cannot have deputies who do not head expert groups (head departments);

management of strategic planning and European integration - independent structural division which can be created for accomplishment of the tasks connected with strategic planning of activities and planning of the budget of the ministry, the European integration, coordination of accomplishment by the ministry of the international obligations, and also coordination of work on ensuring forming of state policy in spheres of competence of the ministry;

expert group - structural division which is part of management and is created for accomplishment of tasks in certain directions (functions) of activities of management. The expert group is headed by the head. The state experts are part of expert groups, the leading, chief specialists, and also workers who perform functions on servicing which work is connected with documentary providing and clerical work can enter. Positions of ambassadors at large, advisers, the first, second, third secretaries and the attache can also be part of expert groups of the Ministry of Foreign Affairs. The military personnel can also be part of expert groups of the Ministry of Defence;
