About approval of Rules of marking of tires means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning tires

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of tires by means of identification.

2. Determine that participants of turnover of tires according to the Rules approved by this resolution:

perform registration in the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), within 7 calendar days from the date of emergence of need of implementation by the participant of turnover of tires of the activities connected with input in turnover, and (or) turnover, and (or) conclusion from turnover of the marked tires;

no later than 30 calendar days from the date of registration in information system of monitoring provide readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring (further - the operator) the request for passing of testing of information exchange;

after registration in information system of monitoring send to the operator the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring, electronically;

pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator on the Internet concerning marking of tires means of identification, input of tires in turnover, their turnover and conclusion from turnover according to the Rules approved by this resolution no later than 60 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring;

since November 1, 2020 according to the Rules approved by this resolution, producers and importers of tires enter into information system of monitoring of the data on marking of tires means of identification, and also about input in turnover, about turnover and about conclusion from turnover of tires (codes under the All-Russian Product Classifier by types of economic activity - 22.11. 11, 22.11.12. 110, 22.11.13. 110, 22.11.14 (regarding the tires and tires intended for wheel vehicles, including agricultural and forestry and landscape tractors and trail cars to them, machines and the equipment (except for the tires intended for carriages for people not capable to move), code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union - 4011 10 000 3, 4011 10 000 9, 4011 20 100 0, 4011 20 900 0, 4011 40 000 0, 4011 70 000 0, 4011 80 000 0, 4011 90 000 0 (regarding the tires and tires intended for wheel vehicles, including agricultural and forestry and landscape tractors and trail cars to them, machines and the equipment (except for the tires intended for carriages for people not capable to move), at the same time in case, if participants of turnover of tires put funds of identification for tires or for the label of tires or implement means of identification in tires since the date of entry into force of this resolution, then from the specified date they have the right to provide the information on drawing means of identification in information system of monitoring;

since November 1, 2020 according to the Rules approved by this resolution, the organizations of wholesale trade acquiring the tires marked by means of identification it is direct at producers and importers, enter into information system of monitoring of the data concerning acquisition of the tires marked by means of identification at producers and importers and conclusion of such tires from turnover, and the participants of turnover of tires performing retail sale of the tires marked by means of identification enter into information system of monitoring of the data concerning conclusion from turnover of such tires;

since March 1, 2021 according to the Rules approved by this resolution, the organizations of wholesale trade acquiring tires directly at producers and importers and also the other organizations of wholesale trade and the participants of turnover performing retail sale of tires enter into information system of monitoring of the data concerning all actions on turnover of tires;

in the presence as of December 15, 2020 the unrealized tires introduced into circulation till November 1, 2020 till March 1, 2021 perform their marking by means of identification and represent data on marking of such tires means of identification to information system of monitoring according to the Rules approved by this resolution;

till December 15, 2020 perform marking by means of identification of the tires imported into the Russian Federation after November 1, 2020, but acquired till November 1, 2020 and represent data on marking of such tires means of identification to information system of monitoring according to the Rules approved by this resolution.

3. Determine that participants of turnover of tires in the Russian Federation have the right to put funds of identification for tires or the label of tires or to implement means of identification in tires from the effective date of this resolution.

4. Registration in information system in which information support of carrying out experiment according to the order of the Government of the Russian Federation of June 11, 2019 No. 753 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of tires and tires pneumatic rubber new" and methodical recommendations for participants of experiment about marking by means of identification and to monitoring of turnover of tires and tires pneumatic rubber new in the Russian Federation was performed, the legal entities and individual entrepreneurs who are as of December 1, 2019 the participants of experiment approved by the Ministry of Industry and Trade of the Russian Federation is equated to registration in information system of monitoring.

If the data provided within the specified experiment by participants of turnover of tires to information system of monitoring in which information support of carrying out experiment was performed do not meet the requirements of the Rules approved by this resolution, participants of turnover of tires enter missing and (or) urgent data in information system of monitoring till March 31, 2020 inclusive.

5. Determine that the operator provides:

provision to participants of turnover of tires of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by the Rules approved by this resolution no later than 90 calendar days from the date of obtaining from participants of turnover of tires of the request for receipt of remote access to them;

the organization of testing of information exchange of software and hardware of participants of turnover of tires and information system of monitoring no later than 30 calendar days from the date of obtaining from participants of turnover of tires of the notification of the readiness to information exchange with information system of monitoring;

provision to the participants of turnover of tires performing marking by means of identification of the tires introduced into circulation till November 1, 2020, codes of marking of remaining balance of the goods necessary for forming of means of identification since the date of entry into force of this resolution;

provision to the participants of turnover of tires performing marking by means of identification of the tires introduced into circulation till November 1, 2020, the codes of marking necessary for forming of means of identification since the date of entry into force of this resolution on condition of submission of all data necessary for registration of the corresponding tires in information system of monitoring;

provision to the participants of turnover of tires performing marking by means of identification of the tires introduced into circulation after November 1, 2020, the codes of marking necessary for forming of means of identification on condition of submission of all data necessary for registration of the corresponding tires in information system of monitoring.

6. Determine that in the territory of the Russian Federation input in turnover of tires without drawing funds of identification for them and transfer to information system of monitoring of data on marking of tires means of identification, acquisition unmarked by means of identification of tires directly at producers and importers, and also conclusion from turnover of the tires marked by means of identification without transfer of data in information system of monitoring according to the Rules approved by this resolution is allowed till November 1, 2020.

7. Determine that in the territory of the Russian Federation turnover and conclusion from turnover of the tires which are not marked by means of identification is allowed till December 15, 2020.

8. The restrictions set by Items 6 and 7 of this resolution are not applied to tires on which according to the Rules approved by this resolution, and international treaties of the Russian Federation do not extend to requirements about obligatory marking by means of identification.

9. Determine that the service fee on provision of codes of marking is levied from the effective date this resolution.

10. This resolution becomes effective from the date of its official publication.

Rules of marking of tires means of identification

I. General provisions

1. These rules determine features of marking of the tires which are subject to obligatory marking by means of identification, and also procedure for realization of the specified tires made before input of obligatory marking by means of identification and not marked by means of identification.

2. The concepts used in these rules mean the following:

"aggregation" - process of combination of tires in shipping package with drawing on the created shipping package of code of identification of shipping package;

"aggregative customs code" - the unique sequence of symbols for each separate set of tires representing consolidation of codes of identification of each goods, including codes of identification of the packaging uniting goods in the course of aggregation, created by the operator of information system of monitoring for the purposes of identification of goods according to these rules, used by the participant of turnover of goods in case of customs declaration of goods;
