About approval of Rules of marking of light industrial goods means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning light industrial goods

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of light industrial goods by means of identification.

2. Determine that participants of turnover of goods of light industry according to the Rules approved by this resolution:

a) perform the registration in the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), within 7 calendar days from the date of emergence of need of implementation by participants of turnover of goods of light industry of the activities connected with input in turnover and (or) turnover, and (or) retail sale of the marked light industrial goods;

b) in time no later than 30 calendar days from the date of registration in information system of monitoring provide readiness of own software and hardware for information exchange with information system of monitoring and send the request for passing of testing of information exchange to the operator of information system of monitoring;

c) after registration in information system of monitoring send to the operator of information system of monitoring the request for provision of remote access to the issue registration device placed in infrastructure of the operator of information system of monitoring (electronically);

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning marking of light industrial goods, input of light industrial goods in turnover, their turnover and conclusion from turnover according to the Rules approved by this resolution, in time no later than 60 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring;

e) since January 1, 2021 according to the Rules approved by this resolution enter into information system of monitoring of the data on marking of light industrial goods, and also about input of light industrial goods in turnover, their turnover and conclusion from turnover (codes 14.11. 10, 14.14. 13, 14.13. 21, 14.13. 31, 13.92.12, 13.92.13 and 13.92.14 of the All-Russian Product Classifier by types of economic activity and codes 4203 10 000, 6106, 6201, 6202 and 6302 single Commodity nomenclatures of foreign economic activity of the Eurasian Economic Union). At the same time if participants of turnover of goods of light industry put funds of identification for consumer packaging, or for light industrial goods, either label, or the label since the date of entry into force of this resolution, from the specified date they have the right to represent data on drawing means of identification to information system of monitoring;

e) in the presence as of January 1, 2021 the unrealized light industrial goods introduced into circulation till January 1, 2021 till February 1, 2021 perform their marking by means of identification and represent data on marking of such light industrial goods means of identification to information system of monitoring according to the Rules approved by this resolution;

g) till February 1, 2021 perform marking of the light industrial goods acquired till January 1, 2021 and issued by customs authorities after January 1, 2021 according to customs procedure of release for internal consumption to the offer of these light industrial goods for realization (sale) and enter into information system of monitoring of the data on marking of such light industrial goods means of identification according to the Rules approved by this resolution.

3. Determine that participants of turnover of goods of light industry in the Russian Federation have the right to put funds of identification for consumer packaging, or for light industrial goods, either the label, or label from the effective date of this resolution.

4. Registration in information system in which information support of carrying out experiment according to the order of the Government of the Russian Federation of June 22, 2019 No. 790 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of separate line items of products of light industry" and methodical recommendations for participants of experiment about marking by the means of identification and to monitoring of turnover of separate line items of products of light industry in the Russian Federation approved by the Ministry of Industry and Trade of the Russian Federation was performed of the legal entities and physical persons registered as the individual entrepreneurs who are as of the date of entry into force of this resolution participants of experiment is equated to registration in information system of monitoring.

If the data provided within the specified experiment by participants of turnover of goods of light industry to information system in which information support of carrying out experiment was performed do not meet the requirements of the Rules approved by this resolution, participants of turnover of goods of light industry enter missing and (or) urgent data in information system of monitoring till January 31, 2020 inclusive.

5. Determine that the operator of information system of monitoring provides:

a) provision to participants of turnover of goods of light industry of remote access to the issue registration devices placed in infrastructure of the operator of information system of monitoring on the conditions provided by the Rules approved by this resolution, in time no later than 90 calendar days from the date of obtaining from participants of turnover of goods of light industry of the request for receipt of remote access to them;

b) the organization of testing of information exchange of software and hardware of participants of turnover of goods of light industry and information system of monitoring in time no later than 30 calendar days from the date of obtaining from participants of turnover of goods of light industry of the notification of the readiness to information exchange with information system of monitoring;

c) provision to the participants of turnover of goods of light industry performing marking by means of identification of the light industrial goods introduced into circulation till January 1, 2021, codes of marking of remaining balance of the goods necessary for forming of means of identification since the date of entry into force of this resolution;

d) provision to the participants of turnover of goods of light industry performing marking by means of identification of the light industrial goods introduced into circulation till January 1, 2021, the codes of marking necessary for forming of means of identification since the date of entry into force of this resolution on condition of submission of all data necessary for registration of the corresponding light industrial goods in information system of monitoring;

e) provision to the participants of turnover of goods of light industry performing marking by means of identification of the light industrial goods introduced into circulation after January 1, 2021, the codes of marking necessary for forming of means of identification on condition of submission of all data necessary for registration of the corresponding light industrial goods in information system of monitoring.

6. Determine that in the territory of the Russian Federation input in turnover of goods of light industry without drawing funds of identification for them and transfer to information system of monitoring of data on marking of light industrial goods means of identification, and also turnover and the conclusion from turnover of goods of light industry which are not marked by means of identification is allowed till January 1, 2021, except as specified, specified in subitems "e" and "zh" of Item 2 of this resolution.

Till February 1, 2021 release by customs authorities according to customs procedure of release for internal consumption of the unmarked light industrial goods specified in the subitem "zh" of Item 2 of this resolution is allowed.

At the same time till May 1, 2021 participants of turnover of goods of light industry have the right to perform storage and transportation being at them in ownership, and (or) use, and (or) the order of light industrial goods as of January 1, 2021 (remaining balance of goods) and to perform their marking by means of identification for the purpose of the subsequent realization (sale) in case of observance of conditions, the stipulated in Item 54(1) Rules approved by this resolution.

7. Restrictions, stipulated in Item 6 these resolutions, are not applied to light industrial goods on which according to the Rules approved by this resolution, and international treaties of the Russian Federation requirements to obligatory marking by means of identification do not extend.

8. Determine that the service fee on provision of codes of marking is levied from the effective date this resolution.

9. This resolution becomes effective from the date of its official publication.

Rules of marking of light industrial goods means of identification

I. General provisions

1. These rules determine features of marking of the light industrial goods which are subject to obligatory marking by means of identification, and also procedure for realization of the specified goods made before input of obligatory marking by means of identification and not marked by means of identification.

2. For the purposes of these rules the following concepts are used:
