DECISION OF BOARD OF THE EURASIAN ECONOMIC COMMISSION

About the technological documents regulating information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 № 200, the Board of the Eurasian economic commission decided:

1. Approve enclosed:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union";

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union";

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union";

Procedure for accession to general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union".

2. Ask state members of the Eurasian Economic Union to provide accomplishment of the procedure of enforcement of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union" within 9 months from the date of the introduction of this Decision in force.

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union"

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further - the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The agreement on movement of office and civil weapon between state members of the Eurasian Economic Union of May 20, 2016 (further - the Agreement);

The decision of Board of the Eurasian economic commission of May 16, 2012 No. 45 "About single form of the conclusion (the allowing document) for import, export and transit of the separate goods included in the single inventory to which measures of non-tariff regulation in trade with the third countries, and methodical instructions for its filling are applied";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Eurasian economic commission of April 21, 2015 No. 30 "About measures of non-tariff regulation";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 No. 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission";

The decision of Board of the Eurasian economic commission of November 17, 2015 No. 155 "About single system of normative reference information of the Eurasian Economic Union";

The decision of Board of the Euroasian economic commission of December 19, 2016 №. 169 "About approval of the Procedure for realization of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of November 27, 2017 No. 162 "About single form of the allowing document applied according to the Agreement on movement of ozone-depleting substances and products containing them and accounting of ozone-depleting substances when implementing mutual trade of state members of the Eurasian Economic Union of May 29, 2015 and the Agreement on movement of office and civil weapon between state members of the Eurasian Economic Union of May 20, 2016".

II. Scope

2. These rules are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union" (further - general process), including the description of the procedures performed within this general process.

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"condition of information object of general process" - property which characterizes information object at certain stage of accomplishment of the procedure of general process and changes in case of accomplishment of transactions of general process.

The concepts "internal transit", "movement", "allowing document" and "office and (or) civil weapon" used in these rules are applied in the values determined in the Agreement.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

IV. Main data on general process

5. Full name of general process: "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union".

6. Specification symbol of general process: P.LL.01, version 1.0.0.

1. Purpose and tasks of general process

7. The purpose of general process is realization of the mechanism of information exchange between competent authorities of state members of the Union (further - state members) when moving and internal transit of office and civil weapon across customs area of the Union.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the automated exchange of the data necessary for control of movement and internal transit of office and civil weapon, between competent authorities of state members with use of the integrated system of the Eurasian Economic Union (further - the integrated system) according to the international treaties and acts constituting the right of the Union;

b) provide application of the unified structures of the electronic documents and data constructed on the basis of use of general model of data of the integrated system;

c) provide use of state members of single system of normative reference information of the Union by authorized bodies.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of procedures:

a) submission of data on the issued allowing document;

b) submission of data on the cancelled allowing document;

c) submission of data on the issued allowing documents for the accounting period;

d) submission of data on the issued allowing documents on demand;

e) submission of the statement on receipt of the allowing document.

11. In case of performing procedures of general process competent authorities the member states provide maintaining the national information resource intended for accounting and storage of data on the issued allowing documents, and represent data from national information resource to competent authorities of other state members.

The competent authority representing data represents data on the issued allowing document to the competent authority accepting data. At the same time the "Submission of Data on the Issued Allowing Document" procedure is performed (P.LL.01.PRC.001).

In case of cancellation of earlier issued allowing document, the competent authority representing data represents data on the cancelled allowing document to the competent authority accepting data. At the same time the "Submission of Data on the Cancelled Allowing Document" procedure is performed (P.LL.01.PRC.002).

The competent authority representing data quarterly no later than the 15th following reporting quarter represents data on the issued allowing documents for the accounting period to the competent authority accepting data. At the same time the "Submission of Data on the Issued Allowing Documents for the Accounting Period" procedure is performed (P.LL.01.PRC.003).

In case of need of receipt of data on the issued allowing documents the competent authority requesting data sends to the competent authority representing data, request for submission of data on the issued allowing documents. At the same time the "Submission of Data on the Issued Allowing Documents on Demand" procedure is performed (P.LL.01.PRC.004).

When obtaining by the competent authority representing data, data for receipt of the allowing document from the applicant the "Submission of the Statement on Receipt of the Allowing Document" procedure is performed (P.LL.01.PRC.005).

Submission of the specified data is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union", the approved Decision of Board of the Eurasian economic commission of December 3, 2019 No. 216 (further - Regulations of information exchange).

The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Ensuring exchange between authorized bodies of state members of the Eurasian Economic Union with data when moving and internal transit of office and civil weapon across customs area of the Eurasian Economic Union", to No. 216 approved by the Decision of Board of the Eurasian economic commission of December 3, 2019 (further - the Description of formats and structures of electronic documents and data).

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, including the disaggregated activity description, is given in the Section VIII of these rules.

14. The general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided in the Section. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language - Unified Modeling Language) and supplied with the text description.

VI. Responsibility of participants of general process

17. For non-compliance with the requirements aimed at providing timeliness and completeness of transfer of data, the officials and the staff of authorized bodies of state members participating in information exchange are made responsible according to the legislation of state members.

VIII. Procedures of general process

"Submission of Data on the Issued Allowing Document" procedure (P.LL.01.PRC.001)

19. The scheme of accomplishment of the "Submission of Data on the Issued Allowing Document" procedure (P.LL.01.PRC.001) is provided in the figure 2.

20. The "Submission of Data on the Issued Allowing Document" procedure (P.LL.01.PRC.001) is carried out in case of issue of the allowing document.

21. The first carries out transaction "Submission of data on the issued allowing document" (P.LL.01.OPR.001) by results of which accomplishment the competent authority representing data creates and represented to the competent authority accepting data, data on the issued allowing document.

22. When obtaining by the competent authority accepting data, data on the issued allowing document transaction "Acceptance and processing of data on the issued allowing document" is carried out (P.LL.01.OPR.002) by results of which accomplishment acceptance and processing of the specified data are performed. The notification on processing of data on the issued allowing document goes to the competent authority representing data.

23. When obtaining by the competent authority representing data, notifications on processing of data on the issued allowing document transaction "Receipt of the notification on processing of data on the issued allowing document" is carried out (P.LL.01.OPR.003) by results of which accomplishment acceptance and processing of the specified notification are performed.

24. Result of accomplishment of the "Submission of Data on the Issued Allowing Document" procedure (P.LL.01.PRC.001) is obtaining by the competent authority representing data, notifications on processing of data on the issued allowing document.

25. The list of the transactions of general process which are carried out within the "Submission of Data on the Issued Allowing Document" procedure (P.LL.01.PRC.001), is given in table 5.
