About tourist activities in the Republic of Kazakhstan

This Law determines legal, economic, social, organizational basis of tourist activities as one of industries of economy of the Republic of Kazakhstan.

Chapter 1. Basic provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

3-2) insurance certificate - the document testimonial of availability of the operating insurance protection concerning insured and containing information on insurance coverage conditions on the insurance risks accepted on insurance, drawn up by the insurer in confirmation of the signed insurance contract (insurance policy);

4) tour - the complex of tourist services including travel along certain route within certain terms;

5) tourism - the temporary stay of the tourist in travel which is not connected with change of the permanent residence;

5-1) tourism infrastructure - set of the organizations, complex of the constructions and networks of production, social and recreational appointment intended for functioning of the sphere of tourism and requirements satisfaction of the tourist;

6) the instructor of tourism - professionally prepared physical person which is performing activities in the Republic of Kazakhstan as the individual entrepreneur or hired employee having the corresponding qualification and experience of passing of tourist routes;

7) the tourist - the physical person visiting the country (place) of temporary stay from twenty four hours to one year and performing at least one spending the night in it (in it) in improving, cognitive, professional and business, sports, religious and other purposes without occupation paid activities;

7-1) card of turistifikation - the territories of republican and regional levels which are of interest to tourists;

8) locations of tourists - the hotels, motels, campings, tourist centers, guest houses, rest houses, boarding houses and other buildings and constructions used for accommodation of tourists and their servicing;

8-1) tourist agent (further - the travel agent) - the physical person or legal entity performing tourist's agency activities;

9) tourist agency activities (further - tourist's agency activities) - business activity of physical persons or legal entities on promotion and realization of the tourist product created by the tourist operator of the Republic of Kazakhstan based on the agency agreement on realization of tourist product without the right of addition of additional services and also activities for rendering to tourists the services which are not tourist product;

10) the tourist voucher - the document confirming the tourist's right to the services which are part of tour, and the fact of their payment;

11) it is excluded

11-1) tourist code - the unique number assigned to the tourist by tour operator in the field of outbound tourism, guaranteeing obligations of tour operator within organized outbound tourism;

12) tourist activities - business activity of physical persons or legal entities on provision of tourist services;

13) tourist services - the services necessary for requirements satisfaction of the tourist provided during its travel and with respect thereto by travel (placement, transportation, food, excursions, services of instructors of tourism, guides, and other services provided by the contract for tourist servicing, rendered depending on purposes of visit;

13-1) compensation of tourist services - compensation by the employer of costs of the worker for the tourist services rendered in the territory of the Republic of Kazakhstan;

14) the contract for tourist servicing - the agreement between person performing tourist activities and the tourist on paid rendering tourist services;

15) persons performing tourist activities - travel agents, tour operators, instructors of tourism, and also the rendering tourist services independently guides, guides;

16) No. 269-V ZRK is excluded according to the Law of the Republic of Kazakhstan of 29.12.2014

17) tourist route - the transit of the tourist for satisfaction of his requirements which is developed by the tourist operator and includes visit of objects of tourist activities with detailed regulation of such visit (the used transport, places of stop, subjects to visit, the place of lodging for the night, medical care in case of emergency and other conditions);

18) the state register of tourist routes and tracks - the document of accounting of tourist routes and tracks;

19) tourist operator activities (further - tour operator activities) - business activity of the physical persons or legal entities having the license for this type of activity on forming, promotion and realization of tourist product in the field of outbound tourism through travel agents and tourist product in the field of entrance and internal tourism to tourists, including through travel agents;

19-1) tourist operator (further - tour operator) - the physical person or legal entity performing tourist operator activities, tourist operator activities in the field of internal, entrance or outbound tourism;

20) tourist product - complex of all necessary tourist services sufficient for requirements satisfaction of the tourist during the travel;

21) promotion of tourist product - package of measures (advertizing, participation in specialized exhibitions and fairs, the organization of tourist information centers for realization of tourist products, the edition and distribution of the catalogs, booklets) directed to rendering tourist services;

22) tourist resources - the climatic, historical, welfare, improving objects including subjects to tourist display, and also other objects capable to satisfy spiritual needs of tourists, to promote recovery and development of their physical forces;

23) the tourist market - the goods circulation (works, services) and money in the field of tourist activities;
