About implementation of the Presidential decree of the Republic of Belarus of August 9, 2019 No. 304

In pursuance of Item 8 of the Presidential decree of the Republic of Belarus of August 9, 2019 "About implementation of agreements on financing of cross-border cooperation" the Council of Ministers of the Republic of Belarus DECIDES: No. 304

1. Establish the following order of registration of projects of cross-border cooperation (further, unless otherwise specified, - TGS):

1.1. the receiver of the international technical assistance (further, unless otherwise specified, - MTP) sends to the Ministry of Foreign Affairs the appeal constituted in any form, the draft copy of TGS approved by governing bodies of the TGS programs and its transfer on Belarusian or Russian;

1.2. The Ministry of Foreign Affairs no later than 20 calendar days from the date of receipt of the documents specified in subitem 1.1 of this Item issues the conclusion about project implementation of MTP within the TGS programs. The center of the international technical assistance of the European Union in the Republic of Belarus renders advisory and technical assistance to the Ministry of Foreign Affairs in issue of such conclusion;

1.3. The Ministry of Economics registers the TGS project within 5 calendar days from receipt date from the receiver of MTP of the following documents:

addresses of the receiver of MTP constituted in any form;

the conclusion issued by the Ministry of Foreign Affairs according to subitem 1.2 of this Item;

statements for registration of the MTP project in the form established by the Ministry of Economics;

the original or the draft copy of TGS in duplicate with transfer on Belarusian or Russian if the document is constituted in foreign language. The draft copy of TGS with transfer is certified by the receiver of MTP who bears responsibility for its reliability. The citizens of the Republic of Belarus acting as receivers of MTP represent the copies certified notarially in accordance with the established procedure.

2. Determine that the inventory (works, services), the money provided for projects implementation of MTP within joint financing of TGS (further if other is not established, - the list), is the document confirming reference of goods (works, services), money to TGS provided for projects implementation within joint financing of TGS.

3. Establish the following procedure for issue of confirmations about purpose of goods (works, services), the money provided for implementation of the TGS projects registered by the Ministry of Economics within joint financing of TGS (further - confirmations):

3.1. the receiver of MTP represents to regional executive committee (The Minsk Gorispolkom) in the place of state registration of the legal entity or finding of state body or registration of the citizen of the Republic of Belarus at the place of residence or stay:

the address of the receiver of MTP constituted in any form;

the list in form according to appendix in four copies on paper, and also in electronic form in the Microsoft Excel format;

reasons to the list;

the copy of the document confirming assignment to the receiver of MTP of accounting number of the payer;

in the presence of the documents confirming delivery of goods (works, services), provision of money - copies of the deed of conveyance, shipping documents, the agreement (contract) for goods receipt (property, money), performance of works, rendering services within the TGS project. The specified documents shall contain the reference to the TGS project registered by the Ministry of Economics and in case of their creation in foreign language to be followed by transfer on Belarusian or Russian;

3.2. copies of the documents specified in subitem 3.1 of this Item with transfer on Belarusian or Russian if the document is constituted in foreign language, are certified by the receiver of MTP who bears responsibility for their reliability. The citizens of the Republic of Belarus acting as receivers of MTP represent the copies certified notarially in accordance with the established procedure;

3.3. the regional executive committee (The Minsk Gorispolkom) considers the list regarding compliance to the purposes and project tasks of TGS and in case of approval of the list no later than 20 days from the date of submission of the documents specified in subitem 3.1 of this Item sends to the relevant inspectorate of the Ministry of Taxes and Tax Collection for areas and Minsk, the State Customs Committee the letter with confirmation and one copy of the list, and also the list in electronic form in the Microsoft Excel format, and to the receiver of MTP - the letter with confirmation and one copy of the list;

3.4. in case of discrepancy of the list to the purposes and project tasks of TGS the regional executive committee (The Minsk Gorispolkom) notifies on it the receiver of MTP no later than 20 calendar days from the date of submission of the documents specified in subitem 3.1 of this Item;

3.5. according to the decision of regional executive committee (The Minsk Gorispolkom) for consideration of the list the commission (working group) can be created. The procedure for its creation and activities is determined by regional executive committee (The Minsk Gorispolkom);

3.6. in the list approved by regional executive committee (The Minsk Gorispolkom) modification and (or) amendments in names of goods (works, services), increase in their physical and cash amounts without change of total cash amount, the purposes and tasks determined by the TGS project is allowed. Modification and (or) amendments in the list is performed according to the procedure, established in subitems 3.1-3.4 of this Item.

4. Delivery, transfer (accomplishment, rendering) of goods (works, services) within joint financing of TGS to the receiver of MTP is performed based on the contract (contract) between the supplier of these goods (works, services) and the receiver of MTP. Such agreement (contract) shall contain the reference to the TGS project registered by the Ministry of Economics and to be signed by heads of the receiver of MTP and the supplier.

5. The receiver of MTP and (or) the supplier represent to inspectorate of the Ministry of Taxes and Tax Collection for the place of registration the documents confirming delivery, transfer (accomplishment, rendering) of goods (works, services) within joint financing of TGS in the territory of the Republic of Belarus or commodity importation on the territory of the Republic of Belarus from the territory of the state members of the Eurasian Economic Union for use for the purpose of determined by the TGS project and also copies of the list and the TGS project registered by the Ministry of Economics.

6. For the purposes of this resolution terms and their determinations in the values established in the Presidential decree of the Republic of Belarus of August 9, 2019 No. 304 are used.

7. This resolution becomes effective since October 14, 2019.
