About approval of Rules of conducting examination of scientific research within the state defense order

1. Approve the enclosed Rules of conducting examination of scientific research within the state defense order.
2. To provide to development department of defense industry complex of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan after its official publication.
3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of conducting examination of scientific research within the state defense order (further - Rules) are developed according to the subitem 32) of article 6 of the Law of the Republic of Kazakhstan of March 18, 2019 "About defense industry and the state defense order" (further - the Law) and determine procedure for conducting examination of scientific research (reports on the executed scientific research) within the state defense order (further - examination).
2. In these rules the following concepts are used:
1) authorized body in the field of defense industry and the state defense order (further - authorized body) - the state body performing management and cross-industry coordination in the field of defense industry and the state defense order;
2) experimental testimony - the official expert opinion of advisory council constituted according to appendix 1 to these rules on the basis of generalization of points on each criterion for evaluation of object of examination;
3) advisory councils - the collegiate organs created in the specialized scientific directions approved by the Defense scientific and technical commission which provision and structure affirms according to the subitem 34) of article 6 of the Law;
4) the conclusion of advisory council - the document which is signed by the chairman of the relevant advisory council (further - the chairman) or replacement his face and contains the list of scientific research (reports on the executed scientific research) ranged in GPA size, with indication of in it the declared financing amounts according to appendix 2 to these rules;
5) the expert of advisory council (further - the expert) - the physical person representing the expert opinion, requirements to which are established according to the subitem 34) of Article 6 and Item 6 of article 21 of the Law.
3. The main objectives of examination are:
1) objective and complex consideration of scientific research (reports on the executed scientific research) on informative, organizational, material security, comparison of the received results with stated purposes of scientific research (reports on the executed scientific research);
2) generalization of expert evaluations of object of examination.
4. Examination is performed by the experts determined by the head of authorized body for the purpose of preparation of analytical assessment of scientific research (reports on the executed scientific research) on the principles of independence, objectivity, competence, complexity, reliability, completeness and justification of expert opinions.
5. Experts within thirty calendar days consider scientific research (reports on the executed scientific research), prepare experimental testimony and send to authorized body.
In experimental testimony the point according to System of expert evaluations of object of examination, according to appendix 3 to these rules is given.
6. The authorized body within ten calendar days considers the experimental testimonies signed by experts, removes GPA and creates the draft of the conclusion of the relevant advisory council.
7. The conclusion of advisory council is signed by the chairman or replacement his face.
8. In case of disagreement with the draft of the conclusion of the relevant advisory council, the chairman or replacement person within five calendar days convenes meeting of advisory council.
Holding meeting requires presence at least two thirds of structure of the relevant advisory council.
The conclusion of the relevant advisory council is considered valid in case of the unanimous decision more than a half of voices of attendees at meeting. The meeting is held in presentia and (or) by means of conference online.
Following the results of meeting within five working days the chairman or replacement his face sign the conclusion of the relevant advisory council and goes to authorized body.
