About Regulations on passing of military service (training) by cadets of the highest military educational institutions (ва&оенных educational divisions of institutions of higher education) Security Service of Ukraine

1. Approve Regulations on passing of military service (training) by cadets of the highest military educational institutions (military educational units of institutions of higher education) of the Security Service of Ukraine it (is applied).

2. In partial replacement of the Presidential decree of Ukraine of November 7, 2001 with No. 1053 "About regulations On passing of military service as the corresponding categories of the military personnel" to recognize the voided paragraph of the seventh Article 1 and the Regulations on passing of military service (training) in the contract cadets (listeners) of the highest military educational institutions of the Security Service of Ukraine approved by the specified Decree.

3. This Decree becomes effective from the date of its publication.

Regulations on passing of military service (training) by cadets of the highest military educational institutions (military educational units of institutions of higher education) of the Security Service of Ukraine

I. General provisions

1. This Provision determines procedure for passing of military service (training) by cadets of the highest military educational institutions of the Security Service of Ukraine and military educational units of the Security Service of Ukraine of institutions of higher education (further - the highest military educational institutions), their rights and obligation.

2. Terms in this Provision are used in such values:

the cadet - person who is in accordance with the established procedure enlisted in the highest military educational institution also studies for the purpose of receipt of the higher education on certain degree and to which the military rank of ordinary, sergeant and foreman structure or such rank is given it had during revenues to training;

the contract on passing of military service (training) by cadets of the highest military educational institutions (further - the contract) - the written agreement signed between the citizen of Ukraine and the state on behalf of which the Security Service of Ukraine, for establishment of legal relations between the parties acts during passing of military service (training).

3. Training of cadets in the highest military educational institutions is carried out for the purpose of further passing of military service by them under the contract of faces of officers in the Security Service of Ukraine and other state bodies which perform management of military forming and signed with the Security Service of Ukraine the relevant agreements, stipulated by the legislation Ukraine (further - the interested state bodies).

Training of cadets of the highest military educational institutions is performed according to educational programs on the first (baccalaureate) and the second (master) levels of the higher education according to the procedure, determined by the legislation of Ukraine, regulatory legal acts of the Security Service of Ukraine and the central executive body which provides forming and realizes state policy in education and sciences.

4. Terms of military service in calendar calculation for cadets correspond to training time in the highest military educational institution.

Terms of military service (training) of cadets of the highest military educational institutions are estimated from the date of their appointment to positions of cadets according to the procedure, established by this Provision.

Cadets who before receipt did not go military service to the highest military educational institutions personally take Military oath of allegiance to the Ukrainian people according to the procedure, established by the Charter of internal service of the Armed Forces of Ukraine.

During the special period cadets pass military service (training) taking into account features, stipulated by the legislation Ukraine, this Provision and regulatory legal acts of the Security Service of Ukraine.

II. Transfer on training and acceptance on military service (training) in the contract

5. Requirements for professional psychologically selection, procedure for matching, studying and direction in the highest military educational institutions of candidates for training for participation in competitive selection, including those which go the interested state bodies are established by regulatory legal acts of the Security Service of Ukraine.

6. Reception of citizens of Ukraine on training in the highest military educational institutions is performed according to the procedure, established by the Law of Ukraine "About the higher education".

Amounts of reception of citizens in the highest military educational institutions according to programs of training of citizens for passing of military service on positions of faces of officers on specialties (specializations) and Articles, including amounts of acceptance of persons which are granted the transfer right on quotas stipulated by the legislation Ukraine, are determined by the Chairman of the Security Service of Ukraine and heads of other interested state bodies taking into account requirements of completing.

7. On military service (training) of cadets of the highest military educational institutions citizens of Ukraine, by age from 17 to 30 years are enlisted, including those by which 17 years are performed in year of the beginning of military service which successfully underwent competitive selection and meet the established requirements of passing of military service on positions of cadets, have complete general secondary, professional or higher education and not having military ranks of officers.

8. Transfer of the citizen on training in the highest military educational institution is performed according to the order of the head of the highest military educational institution.

The citizens enlisted on training in the highest military educational institution sign the contract.

The refusal of the conclusion of the contract involves expel of the citizen from the highest military educational institution which is performed by order of the head of the highest military educational institution.

The citizens enlisted on training in the highest military educational institution are appointed to the cadet's position by the order of the head of the highest military educational institution in day of the conclusion of the contract.

9. The contract is signed in form which is applied, in duplicate, signed by the cadet and the head of the highest military educational institution, sealed official the highest military educational institution and stored at each of the parties.
