About procedure for realization by National Bank of gemstones to physical persons

Based on part ten of Item 4-1 of the Regulations on the State fund of precious metals and gemstones of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of April 19, 2006 No. 260, of Item 27 of the Charter of the National Bank of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of June 13, 2001 No. 320, and part one of article 39 of the Bank code of the Republic of Belarus the Board of National Bank of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for realization by National Bank of gemstones to physical persons it (is applied).

2. Declare invalid the resolution of Board of National Bank of the Republic of Belarus of January 4, 2014 No. 4 "About approval of the Instruction about procedure for realization of gemstones from fund of gemstones of the State fund of precious metals and gemstones of the Republic of Belarus to physical persons".

3. This resolution becomes effective after its official publication.

The instruction about procedure for realization by National Bank of gemstones to physical persons

Chapter 1. General provisions

1. This Instruction determines procedure for realization by National Bank of gemstones from fund of gemstones of the State fund of precious metals and gemstones of the Republic of Belarus to physical persons.

2. For the purposes of this Instruction following terms are used in the following values:

the certified diamond - the diamond which is in the extra packing ensuring its safety and impossibility of withdrawal without damage of such packaging with the certificate of quality on diamond;

the certificate of quality on diamond - the document issued by National Bank on the certified diamond and containing information on the diamond size, its weight, proportions, quality of polishing, the characteristic of color and purity, and also the chart for certain type of facet by way of illustration of purity of diamond with disaggregation of the symbols designating internal and outer defects of diamond;

diamond - the facetted natural diamond having at least seventeen polished sides;

kaletta - the most lower part of surface of diamond which can be in the form of point (thorn), side or the line on the pavilion of diamond;

carat - unit of mass of gemstones, equal 0,2 of gram;

crown (top) - the part of diamond located between the plane of the platform and rundist;

the pavilion (bottom) - the part of diamond located between rundist and kaletty (thorn);

the platform - the greatest single side of diamond on the area located in the center of crown;

rundist - the part of surface of diamond determining its form in the plan and located between crown and the pavilion;

diamond facet form - form of contour of rundist in the plan (round, fantasy);

color of diamond - relative absence (colourless diamond) or presence at diamond of shades or natural coloring;

purity of diamond - absence or degree of availability of internal defects or inclusions or outer defects or defects.

The term "gemstones" is used in the value determined by the paragraph the eighth article 1 of the Law of the Republic of Belarus of June 21, 2002 No. 110-Z "About precious metals and gemstones".

3. For the purposes of this Instruction individual entrepreneurs do not treat physical persons.

4. The certified diamonds are implemented by National Bank to physical persons.

Realization of other gemstones to physical persons is not made.

5. The financial transactions connected with realization to physical person of the certified diamonds in cases the stipulated in Article 8 Laws of the Republic of Belarus of June 30, 2014 "About measures for prevention of legalization of income gained in the criminal way, financings of terrorist activities and financing of distribution of weapons of mass destruction" are performed No. 165-Z after submission of documents (data) by physical person necessary for its identification.

Chapter 2. Procedure for realization of the certified diamonds to physical persons

6. The certified diamonds are implemented by National Bank to physical persons through cash desks of the Central storage of National Bank.

7. The certificate of quality on diamond in form according to appendix 1, being the document with certain degree of protection is attached to the certified diamond intended for realization.

8. Information on procedure for realization of the certified diamonds, reference information on gemstones, including on high-quality and color characteristics, geometrical parameters and elements of gemstones, and also the list of the certified diamonds offered by National Bank to sale and the prices of them are located in a visible place in cash desks of the Central storage of National Bank and are posted on the official site of National Bank on the global computer Internet.

9. The National Bank enables the realization of the certified diamonds to physical persons for Belarusian rubles with payment both in cash, and in non-cash form, including by means of use of bank payment cards.

10. After obtaining by the cashier from physical person of money the certified diamond, the certificate of quality on diamond, and also the check for the sold certified diamond in form 0402960025 according to appendix 2, confirming realization of the certified diamond are issued to physical person.

In case of payment of the certified diamonds by means of use of bank payment card the copy of maps checks is also issued to physical person.
