About some questions of service in operational investigative divisions of bodies for financial monitoring (service of economic investigations)

1. Approve:

1) Rules of establishment of qualification classes in operational investigative divisions of bodies for financial monitoring (service of economic investigations) according to appendix 1 to this order;

2) Rules and conditions of passing of computer testing of the employee who is subject to certification on knowledge of the legislation of the Republic of Kazakhstan and logical thinking, standard rates of determination of professional suitability, and also threshold values for categories of positions of staff of service of economic investigations of bodies for financial monitoring according to appendix 2 to this order;

3) Rules of application of encouragement to the staff of service of economic investigations of bodies for financial monitoring according to appendix 3 to this order;

4) Rules of the organization of professional office and physical training of staff of service of economic investigations of bodies for financial monitoring according to appendix 4 to this order;

5) Rules of service by the employees who are at the disposal of bodies for financial monitoring according to appendix 5 to this order;

6) Rules of maintaining the personal records containing personal data of staff of service of economic investigations of bodies for financial monitoring according to appendix 6 to this order;

7) the Description of official IDs, and also Rules of their issue to the staff of service of economic investigations of bodies for financial monitoring according to appendix 7 to this order.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Ergozhin of E.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. Recognize invalid some orders of the Minister of Finance of the Republic of Kazakhstan according to appendix 11 to this order.

4. This order becomes effective after ten calendar days from the date of its first official publication.

Rules of establishment of qualification classes in operational investigative divisions of bodies for financial monitoring (service of economic investigations)

1. These rules of establishment of qualification classes in operational investigative divisions of bodies for financial monitoring (service of economic investigations) (further - Rules) are developed in realization of the provisions provided by Articles 22-1, 25, 27 Laws of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" (further - the Law), and determine procedure for establishment and lowering of qualification classes in operational investigative divisions of bodies for financial monitoring (service of economic investigations).

2. The list of positions which occupation grants the right to establishment of qualification classes to the officials who are carrying out directly main objectives and functions assigned to law enforcement agencies according to Item 8 of article 22 of the Law affirms the President of the Republic of Kazakhstan or the Government of the Republic of Kazakhstan according to their powers.

3. Persons appointed to positions of average and the senior commanding structure, before establishment of qualification class or transfer by it in personnel of bodies for financial monitoring, fulfill service duties on post.

4. According to article 22-1 of the Law for the staff of service of economic investigations the following qualification classes and terms of stay in them are established:

1) the average commanding structure:

qualification class 6 categories - one year;

qualification class 5 categories - three years;

qualification class 4 categories - four years;

2) the senior commanding structure:

qualification class 3 categories - five years;

qualification class 2 categories - seven years;

the qualification class of 1 category - the term of stay is not established.

Depending on the sequence of establishment qualification classes are subdivided into the first and next.

The first qualification class is the qualification class 6 categories.

The next qualification classes are established in consecutive procedure after the term of stay in the previous qualification classes.

5. To the employees in case of transfer from one law enforcement agency in another, and also earlier serving in law enforcement and special state bodies, to the military personnel having the class rank or qualification class, special or military rank, equating of qualification classes is performed in the following procedure:

1) the average commanding structure:

qualification class 6 categories - the lieutenant, the lawyer 3 classes;

qualification class 5 categories - the senior lieutenant, the lawyer 2 classes;

qualification class 4 categories - the captain, the lawyer of 1 class;

2) the senior commanding structure:

qualification class 3 categories - the major, the junior adviser;

qualification class 2 categories - the lieutenant colonel, the adviser;

qualification class of 1 category - the colonel, the senior adviser.

6. The term of period of service in special rank or the class rank is estimated from the date of assignment to the employee of the corresponding special or military rank, the class rank, at the same time in time periods of service enter the actual time of service on positions, and also service in cases, the stipulated in Article 44 Laws, and the period of finding of the employee on leave non-paid on child care before achievement of age of three years by it.

In case of unreasonable delay of representation of the employee to establishment of the next qualification class the corresponding qualification class is established from the next day after the term of stay in the previous qualification class.

7. The next qualification classes to the employees are not established respectively before position assignment in case of stay on hand, in the presence of not remitted authority punishment, to the solution of question of post compliance in case of repeated certification, before the termination of investigation verification, before the termination of criminal case on the rehabilitating bases, to the introduction in legal force of the verdict of not guilty, before the end of office investigation.

In case of decision about illegality of imposing of authority punishment or the solution of question of post compliance in case of repeated certification, the terminations of criminal case on the rehabilitating bases, introductions in legal force of the verdict of not guilty the next qualification class to employees is established from the date of approach of term of their establishment in case of compliance of the next qualification classes to qualification class on the held established post.

8. The term of period of service in qualification class is interrupted from the date of the publication of the order on attraction to disciplinary responsibility in the form of lowering of qualification class and is resumed from the date of the publication of the order on recovery of qualification class.

The employees lowered in qualification class are recovered in former qualification class irrespective of the held established post according to the order of the chairman of Committee on financial monitoring of the Ministry of Finance of the Republic of Kazakhstan (further - Committee), but not earlier than in six months from the date of lowering in qualification class.

Before recovery of the employee in former qualification class and establishments to it the next qualification class repeated lowering in qualification class is not made.

9. For establishment and lowering of qualification class heads of structural divisions of service of economic investigations, the first heads of departments of economic investigations on areas, the cities of republican value and the capital (further - authorized heads) direct to the address of the chairman of Committee representation, in form according to appendices 1 and 2 to these rules.

Representation is subject to consideration of human resources by division (further - personnel service) Committee no more than twenty working days in time.

10. Orders on establishment and lowering of qualification classes are drawn up by orders which project is prepared by personnel service of Committee. About establishment and lowering of qualification class is brought to the attention of employees management or personnel service of bodies for financial monitoring.

The order is signed by the chairman of Committee or person who is fulfilling or temporarily fulfilling its duties.

11. Account of qualification classes is kept by personnel service of bodies for financial monitoring.

12. All data on establishment and lowering of qualification classes are entered by personnel services of bodies for financial monitoring in the personal record of the employee after the publication of the relevant order in time no later than three working days.

13. Responsibility for timely representation to establishment and lowering of qualification classes is assigned to the chairman of Committee both authorized heads and personnel services of Committee and bodies for financial monitoring.
