Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of realization by citizens of the right to consolidation in labor unions, and also creations and the organizations of activities of labor unions.

Article 2. Legislation on labor unions

The legislation on labor unions consists of this Law and other acts of the legislation.

By the legislation features of application of this Law in Armed Forces, law-enforcement bodies, Service of state security, National guard of the Republic of Uzbekistan and other military forming can be established.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about labor unions then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

labor union (labor union) - the voluntary public association of the citizens connected by common professional interests by the nature of their activities or study, created for the purpose of representation and protection of their labor, other social and economic rights and interests, which is acting on the basis of the own charter;

primary trade-union organization - the voluntary consolidation of the members of labor union who are working for one or several employers or pupils in the relevant educational institution, which is acting on the basis of the Charter the relevant labor union;

trade union association - the voluntary consolidation created for the purpose of coordination and achievement of unity of actions in realization and protection of the professional, labor, social and economic privileges and interests of workers, on industry, territorial or to other, considering professional specifics, to sign;

division of labor union - the division formed according to the charter of labor union, performing its functions or their part in the corresponding territory.

Article 4. The right to consolidation in labor unions

The citizens performing labor activity, and also the faces which reached age of fifteen years, studying in averages special, professional, the highest educational and research establishments (further - workers), without any distinction have the right to voluntarily create at the choice and without preliminary permission labor unions, and also the right to join trade unions on condition of observance of their charters.

Chapter 2. Principles of activities of labor unions

Article 5. Basic principles of activities of labor unions

The basic principles of activities of labor unions are:

legality;

voluntariness;

inadmissibility of discrimination;

independence and self-government;

equality;

publicity and openness.

Article 6. Principle of legality

Labor unions in the activities shall observe and perform strictly the Constitution of the Republic of Uzbekistan, this Law and other acts of the legislation.

Article 7. Principle of voluntariness

Citizens have the right at the choice voluntarily to create labor unions for protection of the legitimate interests, to enter them, to be engaged in trade-union activities and to leave labor unions.

The procedure and conditions of the introduction in members of labor union and exit from it, and also preserving membership in labor union after the termination of the employment contract are regulated by the charter of the relevant labor union.

Hindrance to implementation of the right of citizens to consolidation in labor unions, and also their coercion is not allowed to the accession to labor union or exit from it.
