1. Determine that:

creation, functioning and completion of the state information and analytical management system public procurements are provided with its owner and the operator;

till April 1, 2020 completion of the state information and analytical management system by public procurements by its owner and operator regarding ensuring interaction with the Automated system of financial calculations of the Ministry of Finance, electronic trading platforms, trade systems of commodity exchanges within realization in the specified Automated system of the mechanism of preliminary reservation of budgetary funds is performed when implementing public procurements.

2. Approve Regulations on procedure for functioning of the state information and analytical management system by public procurements it (is applied).

3. This resolution becomes effective after its official publication.

Regulations on procedure for functioning of the state information and analytical management system public procurements

1. This Provision establishes procedure for functioning of the state information and analytical management system by public procurements (further - the state information and analytical system).

2. For the purposes of this provision terms and their determinations in the values determined in the Law of the Republic of Belarus "About public procurements of goods (works, services)" are used.

3. The main functions of the state information and analytical system taking into account requirements of the legislation on information, informatization and information security are:

forming, processing, analysis, control, storage of information on public procurements;

ensuring interaction of the state information and analytical system with electronic trading platforms and trade systems of commodity exchanges Automated by system of financial calculations of the Ministry of Finance (further - the Automated system), other state information systems, the state information resources;

non-paid provision of information containing in the state information and analytical system with use of the official site.

4. The official site on the global computer Internet for placement on it of information containing in the state information and analytical system is the website https://www.gias.by.

5. Maintaining the state information and analytical system and placement of information in it are performed in the Russian and (or) Belarusian languages. Names of foreign legal entities (surnames, own names and middle names (in the presence) of physical persons) can be specified with use of letters of the Latin alphabet.

6. Interaction of the state information and analytical system with electronic trading platforms and trade systems of commodity exchanges Automated by system other state information systems, the state information resources is performed by means of the nation-wide automated information system.

Placement of information in the state information and analytical system is performed by her operator, authorized state body on public procurements (further - authorized state body), commodity exchange, operators of electronic trading platforms, the Automated system.

The procedure for the interdepartmental automatic and (or) automated information exchange of the operator of the state information and analytical system with commodity exchange, operators of electronic trading platforms, the Automated system, other state information systems, the state information resources is determined by the regulations (regulations) approved by these persons in coordination with authorized state body, the Ministry of Finance and the operator of the nation-wide automated information system.

The procedure specified in part three of this Item provides:

contents of information and terms of its placement in the state information and analytical system persons specified in part two of this Item;

interrelation of the procedures of public procurements which are carried out by customers (organizers) with amount of the budgetary funds and (or) funds of state non-budgetary funds allocated for these purposes to customers;

exchange of the structured information on agreements of public procurements (further - agreements), their change, execution or termination;

other requirements which are not specified in paragraphs the second or fourth to this part.

7. In the state information and analytical system take place:

the documents and data provided in Item 2 of article 6 of the Law of the Republic of Belarus "About public procurements of goods (works, services)";

protocols of opening and consideration of offers for participation in the first stage of two-stage tender, protocols of preliminary selection of participants;

explanations of authorized state body on the questions connected using the legislation on public procurements;

information on acceptance by authorized state body to consideration of claims to actions (failure to act) and (or) decisions of the customer (organizer), the commission and (or) its members, the operator of electronic trading platform (further - claims), about suspension of the procedure of public procurement and purpose of the place and time of consideration of the claim, decisions on recognition of the claim reasonable or unreasonable;

the register of persons accredited on electronic trading platforms;

register of certification centers;

addressing (hyperlink) to information portal of the State system of cataloguing of products of the Republic of Belarus.

8. The authorized state body places and supports in urgent condition in the state information and analytical system:

addressings (hyperlink) to the acts of the legislation on public procurements in control condition published on the National legal Internet portal of the Republic of Belarus;

information on conditions of the admission of goods (works, services) of foreign origin and suppliers (contractors, contractors) offering such goods (works, services), to participation in procedures of public procurements;

the list of foreign states (groups of foreign states) with which the Republic of Belarus signs the international contracts on mutual application of national treatment when implementing public procurements, and also conditions of application of national treatment;

supplier list (contractors, contractors) who are temporarily not allowed to participation in procedures of public procurements;

standard forms of agreements in case of their establishment by Council of Ministers of the Republic of Belarus;
