About cooperation in the field of agricultural industry

The Ministry of Agriculture and Food of the Republic of Belarus and the Ministry of Agriculture of the Azerbaijan Republic which are referred to as further with the Parties

considering mutual interest of both Parties in cooperation increase between two countries in the field of agricultural industry,

highly appreciating the present economic potential for continuation of the relations in the agrarian sector on the basis of mutual advantage,

being guided by the aspiration to develop further bonds between relevant organs of the Parties,

promoting permanent strengthening of historically developed economic relations between the Parties,

agreed about the following:

Article 1

The parties will perform cooperation in all fields of agricultural industry, including veterinary activities in the field of prevention of diseases of animals, quarantine and protection of plants, seed farming and realization of seeds of agricultural plants, products of crop production, winemaking and livestock production.

Article 2

The cooperation in the field of agricultural industry will be performed in the following forms:

strengthening of the joint activities for mutual determination of access to the new markets and increase in the export potential of the agricultural products made and processed in both countries;

exchange of information and technical documentation;

exchange of genetic and biological materials of plant and animal origin;

mutual visits of experts and consultants;

organization of consulting and training programs, seminars, conferences, exhibitions and fairs of agricultural products and agricultural machinery;

mutual encouragement of investments in the agrarian sector in the territory of each of the Parties, and also research of sales opportunities of the joint projects on the priority directions of agricultural industry requiring investments;

establishment and development of the relations in the field of seed farming and development of livestock production, including the organization of breeding works, and also in the field of veterinary activities in the field of prevention of diseases of animals, quarantine and protection of plants;

development and enhancement of methods of managing in agro-industrial complex;

expansion of the mutually beneficial economic relations when implementing trading activities in the field of agrarian policy, agricultural industry and processing of agricultural products;

the organization of experience exchange and implementation of collateral actions for the purpose of executive training and specialists for agrarian education, the agricultural and processing agricultural products organizations, and also increase in their qualification in the field of marketing of grades of agricultural plants and agricultural products.

Other areas of cooperation can be also determined on the basis of mutual consent between the Parties.

Article 3

Protection of the rights to intellectual property items resulting from intellectual activities within this Agreement is provided according to the national legal system of the states of the Parties and international treaties which participants are the states of the Parties.

Any of the Parties does not transfer to any third party commercially valuable confidential information received according to this agreement without written consent of other Party from which this information was obtained.

Article 4

The parties within the competence according to the legislation of the states will render assistance to direct participants of economic cooperation of each of the Parties, to provide mutually beneficial cooperation in the field of agricultural industry with involvement of the relevant competent authorities in the conditions which are carried out in the states of the Parties of economic transformations.

Article 5

The parties, adhering to the obligations following from the existing international treaties concerning quarantine and protection of plants which participants they are will cooperate in area of development and application of methods of pest control and diseases of crops.

Article 6

Competent authorities of the Parties for the solution of the practical questions connected with implementation of this agreement in case of need in the territory of each of the states of the Parties hold joint consultations, working meetings and meetings by preliminary approval of the place, date and the discussed questions in two months prior to meetings.

Article 7

Provisions of this agreement do not infringe at the rights and obligations of the Parties of this agreement according to other existing international documents which participants are the Parties.

Article 8

The disagreements connected with interpretation and application of provisions of this agreement are solved by consultations and negotiations between the Parties.

Article 9

By mutual consent of the Parties, changes and additions which are drawn up in the form of separate protocols which become its integral part can be made to this Agreement. These protocols become effective according to the procedure provided in Article 10 of this agreement.

Article 10

This agreement becomes effective from the date of obtaining through diplomatic channels of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

This agreement is signed for a period of 5 (five) years and automatically prolonged for the subsequent five-year periods if any of the Parties in writing not later than 6 (six) months before the expiration of the above-stated term does not notify other Party through diplomatic channels about the intention to terminate this agreement.

It is made in the city of Minsk on November 19, 2018 in two authentic copies, everyone in the Russian and Azerbaijani languages, and both texts have identical legal force. In case of disagreements over interpretation of this agreement the advantage will be had by the text in Russian.
