About cooperation on creation and application of standard samples of structure and properties of substances and materials

The governments of the State Parties of this agreement which further are referred to as with the Parties

for the purpose of implementation of interaction in case of accomplishment of provisions of the Agreement on carrying out coordinated policy in the field of standardization, metrology and certification of March 13, 1992,

considering economic feasibility of cooperation on ensuring unity and reliability of measurements,

being interested in effective activities of metrological services for testing, metrological certification, checking and calibration of measuring instruments, in metrological support of measurements of the test and other laboratories which are carrying out testing of substances and materials in case of quality control and safety of products, safety of life and health of the person and the environment, scientific research and other spheres

understanding important role of standard samples of structure and properties of substances and materials for ensuring unity, reliability of measurements, metrological support of measurements and testing,

wishing to provide needs of the State Parties of this agreement for standard samples of substances and materials,

in view of need of preserving action of rules for interstate standardization with abbreviation of "PMG" and standards with abbreviation of "GOST" as interstate and preferential forming with their use of requirements to standard samples of structure and properties of substances and materials, to metrological regulations and rules of their development, creation and application,

agreed as follows:

Article 1

The parties, having complete independence in implementation of the activities for ensuring unity of measurements of structure and properties of substances and materials:

provide cooperation on creation and application of interstate documents on standardization (rules, standards, recommendations) in the field of standard samples of structure and properties of substances and materials on the basis of approved by national authorities on metrology (ensuring unity of measurements) of programs (plans) and procedures;

provide cooperation on creation and application of standard samples of structure and properties of substances and materials on the basis of approved by national authorities on metrology (ensuring unity of measurements) of programs (plans) and procedures;

will organize approval of types of standard samples by authorized body on metrology (ensuring unity of measurements) according to the national legal system and their entering into the national register of the approved types of standard samples;

will organize exchange of information about the approved types of standard samples of structure and properties of substances and materials created and applied in the territories of the states;

provide in initiative procedure or according to the recommendation of national authority about metrology (ensuring unity of measurements) of the State Parties of this agreement representation of types of national standard samples as the states - manufacturers of standard samples of these types to recognition as interstate standard samples.

Article 2

The parties carry out the coordinated works on creation and application of standard samples of structure and properties of substances and materials, proceeding from provisions of the international normative and technical documents, and also documents accepted by Interstate council on standardization, metrology and certification (MGS), the national standards and other documents concerning subject of this agreement.

Article 3

Creation of interstate standard samples of structure and properties of substances and materials is performed by development of new types of standard samples or on the basis of recognition of the approved types of national standard samples of the State Parties of this agreement. The decision on recognition of interstate standard samples is made by MGS. Creation, recognition and application of interstate standard samples are performed according to the procedure, the provided PMG 16 "Provision on interstate standard sample".

The interstate standard samples recognized as MGS are subject to entering into the Register of interstate standard samples of structure and properties of substances and materials which conducting performs Bureau according to the MGS standards.

Article 4

Interstate standard samples are applied in different spheres of economy, including in the field of state regulation of ensuring unity of measurements of the State Parties of this agreement which joined their recognition without additional testing or researches and approval like national standard sample according to the legislation of the State Parties of this agreement.

The parties provide conditions for application of interstate standard samples in economic and sci-tech cooperation by inclusion of their (reference) in standards, agreements or agreements (contracts) for metrological support of measurements, testing of substances and materials, calibration, checking, certification of measuring instruments, and also inclusion (reference) in documents to techniques (methods) of measurements, testing, calibration, checking, the program of testing, certification.

Article 5

This agreement extends to the interstate standard samples recognized as MGS before and after the signature of this agreement.

Article 6

Questions of legal protection and use of the inventions, industrial designs and trademarks relating to interstate standard samples are regulated by the legislation of the State Parties of this agreement.

Article 7

This agreement does not affect the rights and obligations of each of the Parties following from other international treaties which participant is its state.

Article 8

The changes which are its integral part which are drawn up by the relevant protocol can be made to this agreement in the consent of the Parties.

Article 9

The disputes between the Parties arising in case of application and interpretation of this agreement are solved by consultations and negotiations of concerned parties or by means of other procedure approved by the Parties.

Article 10

This agreement becomes effective after 30 days from the date of receipt by depositary of the third notification on accomplishment by the Parties of the interstate procedures necessary for its entry into force which signed it.

For the Parties which performed interstate procedures later this agreement becomes effective after 30 days from the date of receipt by depositary of the relevant documents.
