About the offal of animal origin and derivative products which are not intended for consumption by the person

(as amended of the Law of the Republic of Moldova of 09.06.2022 No. 156)

The parliament adopts this ordinary law.

This law shifts in the national legal system of provision of Regulations (EU) of the European parliament and Council of the European Union No. 1069/2009 of the October 21, 2009 establishing sanitary standards concerning the offal of animal origin and derivative products which are not intended for consumption by the person and the No. 1774/2002 canceling Regulations (EU) (Regulations about offal of animal origin) published in the Official magazine of the European Union by L 300 of November 14, 2009.

Chapter I General provisions

Article 1. Purpose and subject of regulation

(1) the Purpose of this law is strengthening of legal and institutional base in the field of the organization and carrying out the processes concerning the offal of animal origin or derivative products which are not intended for the consumption by the person, for the purpose of the prevention and minimizing generated by these products of risk of deterioration in public health and health of animals and, in particular, for protection of safety of food and fodder chain.

(2) This law establishes the regulations of public health and health of animals concerning the offal of animal origin and derivative products which are not intended for consumption by the person.

Article 2. Scope

(1) Provisions of this law are applied to the offal of animal origin and derivative products which are not intended for consumption by the person and also to the subsequent products which, as a result of the irreversible decision made by the operator, are intended for the purposes other than consumption by the person:

a) animal products which can be intended for consumption by the person;

b) raw materials for production of animal products.

(2) Provisions of this law are not applied to the following offal of animal origin:

a) the whole carcasses or parts of wild animals, except game which are not presumably infected or infected with the disease which is transmitted to people or animals, except for the water animals caught for commercial purposes;

b) the whole carcasses or parts of game which were not utilized after killing;

c) the offal of animal origin received from the wild animals got on hunting and from their meat;

d) ova, embryos and the seed material intended for reproduction;

e) raw milk, colostrum and derivative products which are received are stored, destroyed or used on origin farm;

f) sinks of mollusks whose soft fabrics and meat are separated;

g) waste of catering, except for situations, when remaining balance:

– arrive from vehicles of the international message;

– are intended for feeding to animals;

– processings or transformations to biogas or receipts of compost are intended for processing by sterilization under pressure;

h) material from the fishing boats observing requirements of hygiene which is formed as a result of trade works and is destroyed in the sea, except for the material remaining as a result of imboweling on board the vessels of fish with signs of diseases, including the parasites who are transferred to people;

i) not processed forage for unproductive animals from shops of retail trade where cutting and storage are made only for the purpose of direct sale, on the place, to consumers;

j) not processed forage for unproductive animals received from the animals slaughtered in farms of origin for private house consumption;

k) the dung and urine other than manure and not mineralized guano.

Article 3. Basic concepts

For the purposes of this law the following basic concepts mean:

soil improvers – materials of animal origin, used for maintenance or improvement of food of plants, and also physical and chemical properties and biological activity of soils, either separately, or together; they can include manure, digestive tract content, compost and remaining balance of digestion;

joint burning – utilization or destruction of offal of animal origin or derivative products if they are waste, on installation of joint burning;

burning – process of oxidation or burning for the purpose of use of energy value of offal of animal origin or derivative products if they are not waste;

waste of catering – any food wastes, including the vegetable oils used by restaurants, the catering companies, centralized and home cuisine;

manure – excrement and/or urine of farm animals, except the divorced fish, with laying or without;

forage for animals – any substances or products, including additives, irrespective of whether are they processed, partially processed or not processed, intended for oral feeding of animals;

burning – destruction of offal of animal origin or the derivative products received as waste on installation for burning;

introduction on the market – paid or free delivery of the offal of animal origin or the derivative products classified, warehoused and processed for the purpose of their delivery;

materials with the specified risks – the following fabrics are described as materials with the specified risks: the head (except for language), including brain, eyes, trigeminal gangliya, almond, timus, spleen and spinal cord of cattle at the age of more than six months and intestines from duodenum to rectum of cattle, irrespective of age; the backbone (except for tail vertebras), apofiza of bodies of vertebras and cross shoots, and also median sacral crest and wings of sacrum, including radicular dorsalny gangliya of animals is more senior than 30 months; the skull, including brain and eyes, almonds, spinal cord of sheep and goats is more senior than 12 months or having the cutters which are constantly growing from gum, and also spleen of all sheep and goats of local origin;

the slimes received as a result of centrifugation or separation – the material collected as offal as a result of purification of raw milk and separation of raw milk into skim milk and sour cream;

the operator – any physical person or legal entity, including carrier, the dealer and the user having offal of animal origin or derivative products under the direct control;

derivative products – the products received as a result of one or several processings, transformations or stages of conversion of offal of animal origin;

animal products – food of animal origin, including honey and blood, the sea live clams, erinaceouses, tunicates and Gastropoda intended for consumption by the person and also other animals intended for preparation for the purpose of delivery in live type to the final consumer;

the authorized platform for garbage – the platform for garbage for which permission according to provisions of the Law on veterinary and sanitary activities No. 221/2007 is issued;
