I DECIDE:

1. Approve the enclosed Rules of forming of the Presidential reserve of management of law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan.

2. Ceased to be valid according to the Presidential decree of the Republic of Kazakhstan of 31.07.2023 No. 290

3. To impose control of execution of this Decree on Administration of the President of the Republic of Kazakhstan.

4. This Decree becomes effective from the date of signing.

Rules of forming of the Presidential reserve of management of law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan

1. General provisions

1. Rules of forming of the Presidential reserve of management of law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan (further – Rules) determine special procedure for selection, transfer of law enforcement officers, employees and military personnel of special state bodies and bodies of civil protection (further – employees) in the Presidential reserve of management of law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan, their preparation and exception of it.

2. Presidential reserve of management of law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan (further – the Presidential reserve) – the list of the employees who passed the special procedure for selection provided by these rules for promotion on vacant higher executive positions of law enforcement and special state bodies, bodies of civil protection including the staff of bodies of the public fire service (further – bodies of civil protection).

3. The purpose of forming of the Presidential reserve – creation of professional personnel structure by means of high-quality employee screening and their preparation for occupation of vacant higher executive positions in law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan.

4. Forming of the Presidential reserve is performed to the positions provided by the List of the positions of the political government employees, the official and other persons designated and exempted by the President of the Republic of Kazakhstan and (or) in coordination with it, chosen on representation of the President of the Republic of Kazakhstan, and also appointed and exempted in coordination with Administration of the President of the Republic of Kazakhstan, the approved Presidential decree of the Republic of Kazakhstan of July 31, 2023 No. 290 "About some questions of personnel policy in system of public authorities" *.

* – except for chiefs (heads) of departments of own safety and operational divisions of law enforcement agencies which purpose is performed in coordination with the Head of Administration of the President of the Republic of Kazakhstan.

5. Approval of the Presidential reserve of law enforcement agencies is performed by the legal decision of the Commission in case of the President of the Republic of Kazakhstan concerning the personnel policy in law enforcement agencies (further – the Commission) formed according to the Presidential decree of the Republic of Kazakhstan of April 3, 2013 No. 537 "About some questions of personnel policy in law enforcement agencies of the Republic of Kazakhstan".

Approval of the Presidential reserve of special state bodies is performed by the Head of Administration of the President of the Republic of Kazakhstan on the representation of Department of military safety and defense of the Security Council of the Republic of Kazakhstan (further – Department of military safety and defense) approved with the Secretary of the Security Council of the Republic of Kazakhstan according to these rules.

Approval of the Presidential reserve of staff of Service of the state protection of the Republic of Kazakhstan (further – Service of the state protection) is performed by the Head of Administration of the President of the Republic of Kazakhstan on representation of the Chief of Service of the state protection.

Approval of the Presidential reserve of staff of bodies of civil protection is performed by the Head of Administration of the President of the Republic of Kazakhstan on the representation of Department of topical issues of safety of the Security Council of the Republic of Kazakhstan (further – Department of topical issues of safety) approved with the Secretary of the Security Council of the Republic of Kazakhstan according to these rules.

6. The organization of work on forming of the Presidential reserve is assigned:

law enforcement agencies of the Republic of Kazakhstan – on Department of law-enforcement system of Administration of the President of the Republic of Kazakhstan (further – Department of law-enforcement system);

special state bodies of the Republic of Kazakhstan – on Department of military safety and defense;

bodies of civil protection of the Republic of Kazakhstan – on Department of topical issues of safety.

The organization of work on forming of lists of the staff of Service of the state protection recommended in the Presidential reserve of management of special state bodies of the Republic of Kazakhstan, and preparation of the documents specified in Item 10 of these rules are assigned to Service of the state protection.

7. These rules do not extend to positions of the first heads of law enforcement, special state bodies, and also to position of the first head of authorized body in the sphere of civil protection.

2. Forming of the Presidential reserve

8. Forming of the Presidential reserve is performed quarterly taking into account the forecast of the current and perspective demand in candidates for occupation of executive positions of law enforcement and special state bodies, bodies of civil protection of the Republic of Kazakhstan.

The presidential reserve is created of number of persons employed:

1) conforming to the qualification requirements including requirements for service length, the professional training level, provided to replacement on expected position;

2) corresponding according to the solution of certifying commission of post, including recommended for transfer in personnel reserve or promotions for higher position;

3) not having authority punishments at the time of the direction of materials.

The first head of law enforcement, special state body and authorized body in the sphere of civil protection in the Presidential reserve in case of compliance to qualification requirements can recommend the employees attached to state bodies and the international organizations.
