About approval of some regulations providing functioning of the Law No. 246/2017 on the state and municipal companies
(Extraction)

Based on part (3) Articles 2, Item c) parts (2) and parts (5) Articles 7, parts (1) and Item n) parts (7) Articles 8, parts (2) article 10 of the Law No. 246/2017 on the state and municipal companies (The official monitor of the Republic of Moldova, 2017, Art. No. 441-450, 750), with subsequent changes, DECIDES: the Government

1. Approve:

1) the Standard charter of the state company, according to appendix No. 1;

2) the Standard charter of the municipal company, according to appendix No. 2;

3) Standard regulations on the organization and carrying out tender on replacement of vacant position of the managing director of the state company, according to appendix No. 3;

4) the Sample of the individual employment contract of the managing director of the state/municipal company, according to appendix No. 4;

5) Standard regulations on administrative board of the state company, according to appendix No. 5;

6) Standard regulations on audit committee of the state company, according to appendix No. 6.

2. In a month from the effective date of this resolution to provide to bodies of the central public management approval of charters of the state companies which are in their management and the provisions provided in appendices No. 3, 5 and 6.

3. In a month to provide to bodies of local public authority approval of charters of the municipal companies. Recommend to bodies of local public authority use of the provisions specified in appendices No. 3, 5 and 6, for development of the normative / administrative acts connected with activities of the municipal companies.

4. To provide to bodies of the central public management in a month from the effective date this resolution the conclusion of individual employment contracts with managing directors of the state/municipal companies.

5. Recognize invalid:

1) the Order of the Government No. 770/1994 about approval of the regulations providing functioning of the Law on the state company (The official monitor of the Republic of Moldova, 1994, No. 14, the Art. 117), with subsequent changes;

2) the Order of the Government No. 387/1994 about approval of the Approximate regulations on the municipal company (The official monitor of the Republic of Moldova, 1994, No. 2, the Art. 16), with subsequent changes;

3) the Order of the Government No. 761/1994 about approval of the Regulations on sanitation, reorganization and liquidation of insolvent enterprises (The official monitor of the Republic of Moldova, 1994, No. 13, the Art. 112), with subsequent changes.

6. This resolution becomes effective from the date of publication.
