ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules on the organization of flight work in civil aviation of the Republic of Kazakhstan

According to subitem 41-36) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" PRIKAZYVAYU:

1. Approve the enclosed Rules on the organization of flight work in civil aviation of the Republic of Kazakhstan.

2. To committee of civil aviation of the Ministry of investments and development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printed publicity materials and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules on the organization of flight work in civil aviation of the Republic of Kazakhstan

Chapter 1. General provisions

1. Rules on the organization of flight work in civil aviation of the Republic of Kazakhstan (further - Rules) are developed according to subitem 41-36) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft".

2. These rules determine procedure for the organization of flight work in civil aviation and are obligatory for operators of the civil air vehicles performing airborne transportations and aerial works, flights for the purpose of general aviation on air vehicles with the certified take-off mass more than 5700 kilograms and air vehicles with gas turbine engines irrespective of take-off mass.

3. The organization of flight work includes:

1) planning of flight work;

2) professional training of flight personnel;

3) the admission of flight personnel to flights;

4) forming of crews of air vehicles;

5) proficiency checks of flight personnel;

6) flight personnel training;

7) blamestorming sessions;

8) analysis and control of the organization of flight work and aviation safety;

9) flight and methodical work.

4. In these rules the following concepts are used:

1) airline - the legal entity having the air operator certificate of civil air vehicles;

2) aeronautical personnel - the physical persons having special and (or) professional training, performing activities for accomplishment and flight servicing of air vehicles, airborne transportations and aerial works, maintenance of air vehicles, the organization and air traffic maintenance, air traffic control;

3) authorized body in the field of civil aviation - the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

4) preliminary preparation - main type of air crew training to flight (flights) in the course of which are carried out studying of materials, preparation of documents, working off of actions and control of readiness of crew for task performance on flight;

5) especially important flights - the status given by the state bodies authorized by the Government of the Republic of Kazakhstan to flights of air vehicles, and also routes (runs) of their following in case of airborne transportations of protected persons of the Republic of Kazakhstan;

6) the aircraft commander - the physical person which underwent the corresponding training having the certificate of the pilot and the admission on the right of independent control of the air vehicle of this type to which duties the management of crew activities on the organization and accomplishment of flights belongs;

7) the member of cabin crew - person belonging to aeronautical personnel who for the benefit of safety and for the purpose of servicing of passengers and (or) carriage of goods carries out the obligations onboard the air vehicle charged to it by the operator or the aircraft commander, but not being the member of flight crew;

8) the service employee - person, constantly or temporarily holding the position connected with accomplishment organizational and administrative or administrative type duties;

9) preflight action - the crew preparation stage to accomplishment of the forthcoming flight containing transactions from the moment of appearance in aerodrome control point (Briefing) (in case of aerial works - on working airfield) till launch of the engine of the air vehicle for flight;

10) flight division - structural division of civil aviation organization which task is the organization of flight work, preparation and accomplishment of flights;

11) flight training - training process of flight personnel for the purpose of acquisition (recovery) and maintenance of skills of flight work;

12) flight work - the work which is carried out by flight personnel on task performance on flight;

13) the organization of flight work - system of actions for planning of flight work and to management of flight divisions and crews of air vehicles of civil aviation for safety control, regularity and cost efficiency of flights;

14) planning of flight work - development of procedure, the sequence and effective methods of accomplishment of perspective, current and operating plans of work of flight personnel of civil aviation organizations at the scheduled time;

15) safety of flight - the package of measures, the flights providing safe carrying out in case of which the risk of damnification of life or to human health or drawings damage to property is reduced to acceptable level and is supported at this or more low level by means of continuous process of identification of sources of danger and control of risk factors;

16) flight personnel - the members of flight crew having special preparation and the certificate on the right of flight operation of the air vehicle of this type and (or) its equipment;
