About procedure of payments of payments in case of payment by installments of payment of cost of state-owned property

Based on Item 14 of the Regulations on procedure for the order state-owned property approved by the Presidential decree of the Republic of Belarus of September 19, 2022 No. 330, of part one of subitem 1.11 of Item 1 of the Decree of the President of the Republic of Belarus of May 7, 2012 No. 6 "About stimulation of business activity in the territory of averages, small residential locations of the rural zone" the State committee on property of the Republic of Belarus DECIDES:

1. Determine that:

1.1. in case of payment of cost of the real and personal estate which is in state-owned property determined in Items 1-4 of appendix 1 to the Presidential decree of the Republic of Belarus of the September 19, 2022 No. 330 "About the order property" (further – property) sold with payment payment by installments, the size of initial payment is specified by the buyer in the statement for provision of this payment by installments and shall constitute at least 20 percent of the price of its sale taking into account earlier deposited amount of deposit if such is paid (further – initial payment).

If in case of the conclusion of the purchase and sale agreement concerning two and more objects of property the initial payment is equal or more than the cost of one of such objects, then agreement parties have the right to offset it on account of the cost of this object;

1.2. the payment due date of initial payment shall not exceed 30 calendar days from the date of the conclusion of the purchase and sale agreement;

1.3. the remained amount is paid monthly during the payment by installments term provided according to the purchase and sale agreement (less month of payment of initial payment) with equal shares (further – monthly payment), since the month following after month in which the term established by subitem 1.2 of this Item expired.

The monthly payment is made no later than the last working day of the month specified in part one of this subitem.

The buyer has the right to fulfill the obligation on payment of property ahead of schedule;

1.4. the monthly payment is indexed proceeding from price indexes of the producers of industrial output of technological appointment (further - price indexes) published by National Statistical Committee in month in which it is necessary to pay monthly payment.

For indexation of monthly payments the price indexes published by National Statistical Committee in addition are posted by the State committee on property on its official site on the global computer Internet.

In case of change by National Statistical Committee of the price indexes published earlier additional indexation of monthly payment is not made;

1.5. the first indexed monthly payment is equal to the work of monthly payment and the published price index.

The second and the subsequent indexed monthly payments are equal to the work of monthly payment and the published price indexes, since the month following after month of payment of initial payment till month of introduction of the current monthly payment.

If the size of the published price index constitutes less than 100 percent, the indexed monthly payment which is subject to payment cannot be less monthly payment;

1.6. the buyer monthly no later than the 20th is notified by the seller on the applied price indexes and the amount of the indexed monthly payment by means of fax, electronic or other connection, including with use of the global computer Internet.

Terms and methods of the notification are established in the purchase and sale agreement by agreement of the parties;

1.7. the money deposited by the buyer over monthly payments for the purpose of early obligation fulfillment on payment of property is indexed by it independently proceeding from the price indexes applied to implementation of the current monthly payment;

1.8. in case of untimely budget contribution of means the buyer of this property pays penalty fee in the amount of 1/360 refunding rates of National Bank on the date of execution of monetary commitment from outstanding amount for each day of delay to payment of the property which was in state-owned property.

2. Recognize invalid:

the resolution of the State committee on property of the Republic of Belarus of July 31, 2012 No. 25 "About procedure of payments of payments in case of payment by installments of payment of the alienable property which is in property of the Republic of Belarus";

the resolution of the State committee on property of the Republic of Belarus of September 19, 2013 No. 44 "About modification of the resolution of the State committee on property of the Republic of Belarus of July 31, 2012 No. 25".

3. This resolution becomes effective since November 15, 2019.
