About approval of the Regulations on patent fees and payments and rates of patent fees and payments

For the purpose of further development of scientific and technical and innovative activities, efficiency of use of scientific potential, cost reduction of the legal entities and physical persons connected with provision of legal protection to inventions, useful models, industrial designs, selection achievements, registration of trademarks, service marks, names of places of goods origin, the computer programs and databases, topology of integrated chips, the Cabinet of Ministers decides:

1. Approve:

Regulations on patent fees and payments, according to appendix No. 1;

Rates of patent fees and payments according to appendix No. 2.

2. Determine that the means of patent fees and payments arriving into accounts of the Agency on intellectual property of the Republic of Uzbekistan are distributed in the following procedure:

a) the means arriving from legal entities and physical persons - nonresidents of the Republic of Uzbekistan:

90 percent of means - into the account of Fund of support of innovative development and the innovative ideas:

2 percent of means - into the corresponding account of the Government budget of the Republic of Uzbekistan;

8 percent of means - into the off-budget account of the Agency on intellectual property of the Republic of Uzbekistan for their use on strengthening of material and technical resources of the Agency and participation in the international organizations in the field of legal protection of objects industrial and other types of intellectual property (at least 50 percent), and also on material stimulation of workers;

b) the means arriving from legal entities and physical persons - residents of the Republic of Uzbekistan:

20 percent of means - in the income of the Government budget of the Republic of Uzbekistan;

80 percent of means - into the off-budget account of the Agency on intellectual property of the Republic of Uzbekistan for their use on strengthening of material and technical resources of the Agency and participation in the international organizations in the field of legal protection of objects industrial and other types of intellectual property (at least 50 percent), and also on material stimulation of workers.

3. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 07.12.2013 No. 322.

4. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 4.

5. To the state patent authority of the Republic of Uzbekistan to bring the regulations into accord with this resolution in a month.

6. This resolution becomes effective since July 1, 2006.

7. To impose control over the implementation of this resolution on the Deputy prime minister of the Republic of Uzbekistan Azimov R. S.

Regulations on patent fees and payments

1. This Provision establishes procedure:

payments of patent fees (further - duties), and also the bases for release from their payment or their return for making of the legally significant actions connected with provision of legal protection to inventions, useful models, industrial designs, selection achievements, registration of trademarks, service marks, names of places of goods origin, topology of integrated chips;

collections of payment, and also the basis for exemption or return of payment for making of the legally significant actions connected with registration of the computer programs or databases and registration of agreements on transfer of property rights for use of the computer programs and databases.

2. Payment of duty or introduction of payment is performed by transfer of the corresponding amounts to settlement accounts of the Agency on intellectual property of the Republic of Uzbekistan (further - the Agency) and is confirmed by the payment document.

3. The document confirming payment of duty or introduction of payment shall contain registration requisition number or the patent, certificates and the name of action for which the duty is paid or the payment, and also the identification taxpayer number (ITN) is brought. If registration number, the specified document along with the name of action for which the duty is paid is not assigned to the request yet or the payment is brought, shall contain the name of the invention, useful model, industrial design, selection achievement, the trademark, service mark, the name of the place of goods origin, topology of integrated chip, the computer program and the database, and also surname of the original author or the name of the applicant. The agency has the right to refuse adoption of the document in which there are no specified data.

4. Compliance of the size of the paid duty or the brought payment to established is determined for date of submission of the document confirming payment of duty or introduction of payment.

5. In case of non-presentation of the document confirming payment of duties or introduction of the payments connected with legal protection of inventions, useful models, industrial designs, selection achievements, trademarks, service marks, names of places of goods origin, and topology of integrated chips, the computer programs and databases, legally significant actions are not performed.

6. If the document confirming payment of the filing fee or duty on conducting state examination in the amount of less the established size of duty on application and conducting examination on group of inventions, useful models, options of industrial design is submitted, expertize is carried out concerning those inventions, useful models, options of industrial design which are chosen by the applicant, or in the absence of such choice, are specified the first in formula of the invention, useful model or in the description of industrial design and for which the duty is paid.
