1. Approve Regulations on system of preparation and retraining of persons who intend to perform activities of the arbitration manager, preparation, retraining and advanced training of arbitration managers which is applied.

2. Declare invalid the order of the Ministry of Justice of Ukraine of December 27, 2012 No. 1973/5 "About approval of the Regulations on system of preparation and retraining of persons who intend to perform activities of the arbitration manager (the manager of the property managing sanitation, the liquidator), and advanced trainings and retrainings of arbitration managers (managers of property, managing directors of sanitation, liquidators), their preparation on cases on bankruptcy of insurance companies", registered in the Ministry of Justice of Ukraine on January 02, 2013 for No. 6/22538 (with changes).

3. To department concerning justice and safety (Oleynik A. N.) submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

4. This order becomes effective from the date of enforcement of the Code of Ukraine on insolvency proceedings, but not earlier than day of official publication of this order.

5. To impose control of execution of this order on the deputy minister of justice concerning executive service Glushchenko S. V.

Regulations on system of preparation and retraining of persons who intend to perform activities of the arbitration manager, preparation, retraining and advanced training of arbitration managers

I. General provisions

This Provision determines procedure for preparation and retraining of persons who intend to perform activities of the arbitration manager, procedure for advanced training and retraining of arbitration managers and procedure for preparation and advanced training of arbitration managers on cases on bankruptcy of non-bank financial institutions and procedure for training of arbitration managers on cases on bankruptcy of the state companies and economic societies in which authorized capital more than 50 percent of shares (shares) belong to the state.

II. Training of persons who intend to perform activities of the arbitration manager

1. Training of persons who intend to perform activities of the arbitration manager consists of two stages: the first - training of persons who intend to perform activities of the arbitration manager, the second - training of persons which intend to perform activities of the arbitration manager.

2. Training of persons who intend to perform activities of the arbitration manager consists in carrying out by institutions of higher education (organizations) which meet the requirements established in Item 5 of this Section (further - organizations), training courses on knowledge acquisition in the sphere of recovery of solvency of debtors or recognitions by their bankrupts and implementation of activities of the arbitration manager during production of case on bankruptcy (insolvency) (further - rates) with issue of the certificate on training in the sphere of recovery of solvency of debtors or recognitions by their bankrupts.

3. The citizen of Ukraine who has the higher legal or economic education of the second (master) level (further - person) is allowed to passing of rates.
