1. Approve the enclosed Rules of financing of projects of commercialization of results of scientific and (or) scientific and technical activities.

2. To committee of science of the Ministry of Education and Science of the Republic of Kazakhstan (Zholdasbayev of Page E.) in the established legislative procedure to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Balykbayev T. O.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of financing of projects of commercialization of results of scientific and (or) scientific and technical activities

Chapter 1. General provisions

1. These rules of financing of projects of commercialization of results of scientific and (or) scientific and technical activities (further - Rules) are developed according to the subitem 4) of article 4 of the Law of the Republic of Kazakhstan of October 31, 2015 "About commercialization of results of scientific and (or) scientific and technical activities" and determine procedure for financing of projects of commercialization of results of scientific and (or) scientific and technical activities (further - financing).

2. In these rules the following basic concepts are used:

1) the grantee - the physical person or legal entity which signed the contract on grant financing of the project for commercialization of results of scientific and (or) scientific and technical activities (further - RNTD);

2) authorized body in the field of science (further - authorized body) - the state body performing cross-industry coordination and management in the field of science and scientific and technical activities;

3) the operator on grant financing of projects of commercialization of RNTD (further - the operator) - the legal entity having necessary experiment on the organization of financing of projects of commercialization of RNTD, determined by authorized body;

4) the project of commercialization of RNTD (further - the project) - the document including content of the expected work directed to practical application of RNTD, including results of intellectual activities, for the purpose of conclusion to the market of new or advanced goods, processes and services, directed to commercialization;

5) grant on commercialization of RNTD (further - grant) - the budgetary and (or) extrabudgetary funds provided on non-paid and irretrievable basis for projects implementation of commercialization of RNTD within priority sectors of economy;

6) tender - the actions directed to determination of the most perspective projects declared within tender and directed to commercialization of RNTD;

7) the tender documentation - the documentation determining conditions, procedure and terms of carrying out tender on grant financing, developed and approved by the operator in coordination with authorized body;

8) the request - the statement of the established form on the participation in tender with application of documents which is drawn up strictly according to the tender documentation;

9) the applicant - the physical person or legal entity which received during the course of performance scientific and (or) scientific and technical activities of RNTD and submitted for consideration the request for receipt of grant according to these rules;

10) industry authorized body - the state body enabling the realization of state policy in the field of science and scientific and technical activities and coordination of works on carrying out scientific research in the corresponding industry;

11) the ranged list - the list of requests arranged from the greatest to the smallest got point following the results of examinations;

12) examination - the activities connected with assessment of relevance, scientific and technical potential, readiness for commercialization, technical and industrial hazards and also with assessment of commercial attractiveness and justification of the declared financial and economic indicators of the project.

Chapter 2. Procedure for financing of projects of commercialization of RNTD

3. The authorized body for the organization of procedure for financing of projects of commercialization of RNTD determines the operator.

4. The operator will organize and carries out competition for determination of the most perspective projects of commercialization of scientific and (or) scientific and technical activities for grant financing.

4-1. Joint financing availability at least 10% of total cost of the project is the mandatory requirement for participation in tender.

5. The tender documentation is developed and affirms the operator in coordination with authorized body. The tender documentation contains the following data:

1) the name of priority sectors of economy within which financing is provided;

2) the tender purpose on grant financing of projects of commercialization of RNTD;

3) project implementation plan;

4) the form of provision of the bid approved by the operator;

5) admissible amount of financing of one project;

6) joint financing conditions by extrabudgetary funds;

7) the name of the operator who announced competition;

8) financing amount.

6. Tender on grant financing appears the operator through republican periodic printing editions in the Kazakh and Russian languages and is subject to obligatory placement in open entry on official Internet resources of authorized body and (or) industry authorized body.
