About enforcement of part two of the Civil code of the Russian Federation

Accepted by the State Duma on December 22, 1995

Article 1. Enact part the second the Civil code of the Russian Federation (further - the Code part two) since March 1, 1996.

Article 2. Recognize voided since March 1, 1996:

the Section III "Liability law" of the Civil Code of the Russian Federation approved by the Law RSFSR of June 11, 1964 "About approval of the Civil Code of the Russian Federation" (Sheets of the Supreme Council of RSFSR, 1964, N 24, Art. 406; 1969, N 23, Art. 783; 1970, N 26, Art. 511; 1972, N 33, Art. 825; 1973, N 51, Art. 1114; 1977, N 6, Art. 129; 1985, N 9, Art. 305; 1986, N 23, Art. 638; 1987, N 9, St, 250; 1988, N 1, Art. 1; Sheets of the Congress of People's Deputies of the Russian Federation and Supreme Council of the Russian Federation. 1992, N 15, Art. 768; N 34, of Art. 1966; 1993, N 4, Art. 119; Russian Federation Code, 1994, N 32, Art. 3302);

Items 3, 6 and 15 Decrees of Presidium of the Supreme Council of RSFSR of June 12, 1964 "About procedure for enforcement Civil and Civil procedural codes of RSFSR" (Sheets of the Supreme Council of RSFSR, 1964, N 24, the Art. 416);

the resolution of the Supreme Council of the Russian Federation of February 13, 1992 "About enforcement of the Regulations on checks" (Sheets of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1992, N 24, the Art. 1283);

Items 3 - 7, and also Item 8 (regarding application of provisions of Chapter 13 of Bases of the civil legislation of USSR and the republics) resolutions of the Supreme Council of the Russian Federation of March 3, 1993 "About some questions of application of the legislation of USSR in the territory of the Russian Federation" (Sheets of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1993, N 11, Art. 393; Russian Federation Code, 1994, N 32, Art. 3302).

Article 3. Since March 1, 1996 in the territory of the Russian Federation are not applied:

Section III "Liability law" of Bases of the civil legislation of USSR and republics (Sheet of the Congress of People's Deputies of the USSR and Supreme Council of the USSR, 1991, N 26, Art. 733);

Bases of the legislation of USSR and federal republics about lease of November 23, 1989 (The sheet of the Congress of People's Deputies of the USSR and the Supreme Council of the USSR, 1989, N 25, Art. 481; 1991, N 12, Art. 325);

the resolution of the Supreme Council of the USSR of November 23, 1989 "About procedure for enforcement of Bases of the legislation of USSR and federal republics about lease" (Sheets of the Congress of People's Deputies of the USSR and the Supreme Council of the USSR, 1989, N 25, the Art. 482).

Article 4. Until reduction of the laws and other legal acts existing in the territory of the Russian Federation in compliance with the Code part two the laws and other legal acts of the Russian Federation, in also acts of the legislation of USSR existing in the territory of the Russian Federation in limits and according to the procedure, stipulated by the legislation the Russian Federation are applied so far as they do not contradict the Code part two.

The Code parts two published before enforcement the regulations of the Supreme Council of RSFSR, the Supreme Council of the Russian Federation which are not the laws, and regulations of Presidium of the Supreme Council of RSFSR, the President of the Russian Federation and the Government of the Russian Federation, and also the regulations of the Supreme Council of the USSR which are not the laws and regulations of Presidium of the Supreme Council of the USSR, the President of the USSR and the Government of the USSR applied in the territory of the Russian Federation on questions which according to part two of the Code can be regulated only by the Federal Laws are effective until enforcement of the relevant laws.

Article 5. The part two of the Code is applied to the obligations relations which arose after its introduction in action.

On the obligations relations which arose till March 1, 1996, the part two of the Code is applied to those rights and obligations which will arise after its introduction in action.

The terms of limitation period and the rule of their calculation established by the Code part two are applied to those requirements which the presentation terms provided by earlier existing legislation did not expire till March 1, 1996.

Article 6. Code part two regulations about procedure for the conclusion and form of agreements of separate types, and also about their state registration are applied to agreements, offers to conclude which are directed after enforcement of part two of the Code. To agreements, offers to conclude which are directed till March 1, 1996 and which are concluded after March 31, 1996, Code part two regulations about form of agreements of separate types, and also about their state registration are applied.

Until enforcement of the Federal Law on registration of the rights to real estate and transactions with it the operating order of registration of real estate transactions is applied.

The Code part two regulations determining contents of agreements of separate types are applied to the agreements signed after its introduction in action.

Article 7. Until enforcement of the Federal Law on registration of the rights to real estate and transactions with it for the agreements provided by Articles 550, 560 and 574 Civil codes of the Russian Federation the rules about the obligatory notarial certificate of such agreements established by the legislation before enforcement of part two of the Code are valid.

Article 8. Code part two regulations, obligatory for agreement parties, about the bases, about consequences and about procedure for agreement cancelation of separate types are applied also to agreements which continue to be effective after enforcement of part two of the Code, irrespective of date of their conclusion.

Code part two regulations, obligatory for agreement parties, about responsibility for violation of contractual commitments are applied if the corresponding violations were allowed after enforcement of part two of the Code, except as specified, when other responsibility for such violations was provided in the agreements signed till March 1, 1996.

Article 9. In cases when one of the parties in the obligation is the citizen who is using, acquiring, ordering or having intention to acquire or order goods (works, services) for personal domestic needs, such citizen has rights of the Party in the obligation according to the Civil code of the Russian Federation, and also the rights granted to the consumer by the Law of the Russian Federation "About consumer protection" and other legal acts published according to it.
